This is a follow up letter regarding your property on Marion Lake. I did receive your
voicemail message on October 24, 2013 regarding the restoration project along your
shoreline.
On October 29, 2013 I was on your property to view the restoration project. While
onsite I did notice the area has a prpblem growing grass. The only way for this area to
stay vegetated is to remove the sand and replace with black dirt, seed and soil erosion
blanket. Due to the fact that November is not the growing season. I’ll extend the
completion of this restoration project until the spring 2014.

Enclosed is the request for the after- the-fact Conditional use Permit along with the required fee.
We included pictures of the before (old Cabin), during and after. No new work has been started since
receiving your letter. But, all work with the retaining walls and patio was completed before receiving
your letter. The permits for the cabin addition were pulled in ~Oct 2011 and built over the winter. As can
be seen in the second picture the larger cabin size was causing wash out. We reviewed the information
on line and did not see any requirements requiring permits for installing retaining walls or patios. We
also reviewed the Rip Rock requirements and believed that no permits were required. The contractor
who placed the rock also stated permits are not required for Rip Rock.
With the exception for the stairs and patio blocks all retaining wall bricks used were already on the
property, on the sides and around the top of the cabin, which we removed, when the addition was built
and then reused on the hill.
You also asked about the amount of fill or removal of dirt for the 14 X 14ft patio. The only dirt had to be
moved was a few inches of grass and top soil to allow the packing of class five for the patio blocks. The
level of the patio is the same as the ground before.
Less than 10 Yds of Class Five was brought in to pack under the patio and the stairs by the house and
Deck. The extra class five was placed on the already existing drive way.
In your letter you asked about a white pvc pipe coming out of the house this is from the rain water
draining system we have under the deck / above the three season/ screen area.

noticed a newly constructed brick patio, a retaining wall and some rip rap/boulder wall
close to the lake. Also, I noticed multiple retaining walls by the house. Our office has no
record of any permits for this work.
Due to the type of work and location of the projects a Conditional Use Permit is
required. Since the project has already been started, you would need to apply for an
After-the-Fact Conditional Use Permit. I have enclosed all the required paperwork for your
project.
While onsite I also noticed a white pvc pipe coming out of the house. What is being
discharged from the pipe? Please contact our office on or before September 26, 2012.

Planning Commission Recommendations
Conditional Use Permit - Daniel & Jennifer Johnson:
Motion by Johnson, second by Huebsch, and unanimously carried to approve an after-the-fact Conditional
Use Permit with a condition as recommended by the Planning Commission. The project is located in Pt of
GL 2 (2.5 Ac), Section 2 of Dead Lake Township: Marion Lake (56-243), GD.
Prelinninarv Plat - “Beauty Beach on Otter Tail Lake 1^' Addition: Evan Nelson:
Motion by Froemming, second by Huebsch, and unanimously carried to approve the Preliminary Plat
known as “Beauty Beach on Otter Tail Lake 1®' Addition” consisting of two single family residential lots as
presented. The project is located on Lot 11 Beauty Beach & pt of Lot 2 (.50 AC), Section 13 of Amor
Township: Otter Tail Lake (56-242), GD.
Conditional Use Permit - Tom & Pauline Parish:
Bill Kalar, Land & Resource Administrator, indicated that the Planning Commission recommended that this
Conditional Use Permit request be tabled until the April, 2013 Planning Commission meeting, subject to
receiving a letter from the Applicant agreeing to the action to table the request. Mr. Kalar has received a
letter from the applicant agreeing to table the CUP request until the next Planning Commission meeting.
Board of Adjustment
Motion by Johnson, second by Lindquist, and unanimously carried to reappoint Steve Schiererto the Otter
Tail County Board of Adjustment for CY2013.
Marion Lake Improvement District
Motion by Huebsch, second by Froemming, and unanimously carried to accept the Order staying the
establishment of the Marion LID as presented by the County Attorney. The Order is part of these minutes
as Attachment D. The County Attorney indicated that an election for the Marion LID will take place either
July or August of 2013.
Immunization Council Interagency Agreement
Motion by Huebsch, second by Lindquist, and unanimously carried to authorize the Public Health Director
to sign the Immunization Council Interagency Agreement as a partner in the organization.
Family Services Collaborative Interagency Agreement
Motion by Huebsch, second by Johnson, and unanimously carried to authorize the appropriate County
Officials’ signatures to execute the Family Sen/ices Collaborative interagency Agreement as presented by
the Public Health Director.
Non-Union Cost of Living Adjustment (COLA)
Motion by Huebsch, second by Johnson, and unanimously carried to approve a 1% COLA for non-union
employees on December 31,2012 at 11:59 p.m., and a 2% COLA effective January 1,2013. These wage
increases reflect similar collective bargaining negotiation terms.
COMMISSIONERS AND COMMITTEE PER DIEM COMPENSATION
Otter Tail County Resolution No. 2012 - 64
Commissioner Huebsch offered the following and moved its adoption:
WHEREAS, Minnesota Statutes 375.055 provides that County Commissioners may receive per diem
payments and reimbursement for necessary expenses incurred in performance of the duties of the
office and shall receive compensation of annual salaries, as set by resolution of the County Board:

Minutes of November 14, 2012: A motion by Maske, second by Wilson to approve the
November 14, 2012 Minutes as presented. Voting: All members in favor.
