MOTION AS FOLLOWS:
Motion was made by George Walter, seconded by Craig Anderson and unanimously carried, to approve a variance of
approximately 8 to 13’ from the required ordinary high water level setback of 75’ for the replacement of a 10’ by 48’ 6”
trailer home with a 52’ by 28’ manufactured home approximately 62 to 67’ from the ordinary high water level. It
should be noted that the structure would be setback approximately 57’ from a line between the two southern most lot
stakes of the property. It was noted that the new manufactured home will be no closer than the existing home to the
ordinary high water level and that the current home was behind the existing building line prior to changes (relocation)
of the structure on the adjacent property. Hardship being the terrain and topography of the applicants’ property.

Variance Requested is:
Variance from the 75’ setback for a new structure. Requesting to locate new manufactured 52’ x 28’
home along front-line of existing 10’ x 48’6” trailer home (to be removed), averaging 57’ back from a line
between the two southernmost lot stakes of the property (along the shore of Marion Lake). It should be
noted that the assumed setback line has been measured from these stakes rather than the Ordinary high
water level (OHWL) of Marion Lake. The true OHWL actually falls between 5 and 10’ south of the lot
stakes, which would result in the requested setback variance to an average of between 62’ and 67’.
The “Existing Buildings” grid plot plan shows the lot as it is today. The “Without Variance” plot plan
shows how the new building would need to be placed in order to meet the setback requirement. The
“Proposed Placement of New Home” plot plan shows the placement of the new home should a variance be
granted.
Most other property owners in this samerarea currently maintain structures within the 75’ setback, and as
of the date of this document, the neighbors on each side of tliis lot have homes that, if a stringline were
stretched between the nearest corners of their homes, would allow placement of the home without
variance. However, the neiglibor to, the east, Roger Lind, is currently in the process of removing the
southernmost home on his lot. By the time’a permit could be granted, this house on the Lind lot will be
gone. The liieiglibor to the west, Don Forness, has many buildings on his lot, several of which are inside
the 75’ setback,.iricluding one which is within 10’ of the OHWL of Marion Lake.
Compliance with the 75’ setback would cause at least3 major hardships:
1) The existing deck and concrete apron surrounding three sides of the current trailer home
would have to be removed in order to keep from having an “island of conerete” in the middle of the yard
^between the home and the lake. New concrete aprons/walkways would need to be installed. This expense,
including the deck, could run several thousand dollars.
2) The existing back yard of the property would be rendered useless, an may cause the existing
drive to be shortened significantly, if not completely eliminated. If the variance is granted, the back yard
would still be useful in size and slope, and the existing drive (along the steep slope and along the east
edge of the property) could still be used as it is currently.
3) A new fresh water well would probably need to be drilled, to avoid locating a pump station in
the middle of the yard between the home and the lake. If the variance is granted, the existing well could
be maintained.
Althougli the septic tank may clear the 10’ building setback, it would be much closer to the home than.it
would be if the variance was granted.

Klimp’s Kamp Resort - Approved
Kimp’s Kamp Resort, C/0 Jarpes and John Kimple, Dent, MN, requested a variance to replace an existing 16’ by 24’
two bedroom cabin with a 24’ by 24’ story and a half three bedroom, cabin in the same location as the existing cabin.
The cabin would be approximately 50’ from the ordinary high water level, 105’ from the septic tanks and 35’ from the
duplex dump system. The property is described as Lots-1 through 13, Block 1 and Lots 1 through 3, Block 2, Yaquina
Bay and part of Government Lot 4, Section 8 of Dead Lake Township by Dead Lake. The cabin that is being
proposed for replacement is located on Lot 8, Block 1, Yaquina Bay. The audience was polled with no'one speaking
for or against the request. A letter from the' Dead Lake Association in favor of the variance request was read for the
record. After consideration, motion was made by Cecil Femling, seconded by Craig Anderson and unanimously
carried, to approve a variance to replace an existing 16’ by 24’ two bedroom cabin with a 24’ by 24’ story and a half
three bedroom cabin in the same location as the existing cabin.
Fisherman’s Village Resort (David Paul Thompson) - Approved
Fisherman’s Village Resort, C/0 David Paul thompson, Battle Lake, MN, requested a variance of 60’ from the
required ordinary high water level setback of 100’ for the replacement of two 16’ 6” by 22’ 6” cabins with a 33’ by 22’
6” two story year round ADA approved dwelling 40’ from the ordinary high water level. The property is described as
Lots 5, 6, and7, Beauty Beach, Deer Lake in Everts Township. The audience was polled with no one speaking for or
. against the request. After consideration, motion was made by John Everts, seconded by Craig Anderson and
unanimously carried, to approve a variance of 60’ from the required ordinary high water level setback of 100’ for the
replacement of two 16’ 6” by 22’ 6” cabins with a 33’ by 22’ 6" two story year round ADA approved dwelling 40’ from
the ordinary high water level. It should be noted that the new structure will use no more land area than the original
■ two structures that are being replaced.
Jerry J. and Dennis D. Dodd - No Variance Required
Jerry J. and Dennis D. Dodd, Clear Lake, lA, requested variances from the required ordinary high water level setback
of 75’ for the constnjction of five decks to five existing cabins less than 75’ from the ordinary high water level. The
decks range in size from 96 square feet to 240 square feet. The drawings would indicate that the setbacks from the
ordinary high water level range from approximately 34' to approximately 7T. The property is described as
Government Lot 2 and part of Government Lot 4, Section 8 of Maplewood Township by South Lake Lida. The
audience was polled with no one speaking for or against the request. After consideration and discussion, motion was
made by Craig Anderson, seconded by Randall Mann and unanimously carried, to allow the applicants to withdraw
their variance request since all of the proposed decks will be under three feet in total height and to authorize a partial
refund of the variance application fee.
Susan C. Ward and Judy M. Wees - Approved
Susan C. Ward and Judy M. Wees, Perham, MN, requested a variance of approximately 8 to 13’ from the required
ordinary high water level setback of 75’ for the replacement of a 10’ by 48’ 6” trailer home with a 52’ by 28’
manufactured home approximately 62 to 67’ from the ordinary high water level. It should be noted that the structure
would be setback approximately 57’ from a line between the two southern most lot stakes of the property. The
property is described as part of Government Lot 1, Section 1 of Dead Lake Township by Marion Lake. Arthur Gorup
represented the appiicants at the public hearing. The audience was polled with no one speaking for or against the
request. A letter from Don Fomess stating no objections to the variance requested was read for the record. After
consideration, motion was made by George Walter, seconded by Craig Anderson and unanimously carried, to
approve a variance of approximately 8 to 13’ from the required ordinary high water level setback of 75’ for the
replacement of a 10’ by 48’ 6” trailer home with a 52’ by 28’ manufactured home approximately 62 to 67’ from the
ordinary high water level. It should be noted that the structure would be setback approximately 57’ from a line
