Mick & Kevin Moore:
As you are aware, on November 26, 2006, the County Board passed a motion to approve
your Conditional Use Permit request with conditions. One of these conditions required the
impervious surface, onsite, not to exceed 25%.
Our Office went onsite (November 29, 2006) to calculate the existing impervious surface,
and it was determined to be 27.88%. Since this is the case, on or before February 1, 2007,
you should provide our Office with a written plan and drawing identifying how you intend to
comply (including the proposed project) with the 25% requirement. Once we receive this
information and confirm that you will comply with this requirement, we can process your
Conditional Use Permit.
Please note that the two additional conditions on your approval include: 1. The walkway to
the north is removed and made into a pervious area. 2. The sand beach area is not
constructed.

Motion: A motion by Erickson, second by Schwartz, to approve provided: 1. The
lakeside patio is limited in size to conform with the 25% impervious surface requirement
(Land & Resource must verify Applicant’s drawing/calculation prior to processing the
Conditional Use Permit). 2. All surface water run-off must be diverted away from the
constructed area and the lake. 3. The Applicant must provide an erosion control plan to
Land & Resource prior to processing the Conditional Use Permit; reason for approval is
the minimization of the amount of surface water runoff (drainage, impervious surface and
the house), and the finished slope will be av\/ay from the lake. Note: This Permit is
permissive and does not include any County liability should the project fail.
