Kyle Bergren:
On August 12, 2009 the Planning Commission passed a motion to recommend approval of
your request. Their motion is as follows:
A motion by Erickson, second by Maske to approve as requested with conditions: 1.
Land & Resource must be notified prior to the work being started, with some supervision
from the Land & Resource Office throughout the project. 2. An erosion control plan must
be submitted to and approved by Land & Resource. 3. The project must be completed
by October 10, 2009.
On August 18, 2009 the County Board of Commissioners passed a motion to approve the
request as recommended by the Planning Commission.
As you can see, there are conditions placed on this approval. Once these conditions are
met, our Office will process your Conditional Use Permit.

Michael & Stacey Foss - Approved With Conditions:
A Conditional Use Permit Application {as stated by the Applicant): Build retaining walls & back fill
to bring structure into 18’ height compliance and get proper drainage for building. Proposed
fill area of 5’ average width & 3’ average depth. Approximately 40 cubic yards of fill. 2 6’
retaining walls 3!4 to 4’ in height in front. 2 8’ retaining walls 3Vz to 4’ in height in rear. The
property is described as Lot 4 & Lot 3 ex E 40’ BIk 1 Lemar & W 17’ of Lot 20 & all of Lot 21
Maplehurst, parcels not to be split, Section 26 of Lida Township; Lake Lida (56-747), GD.
Michael & Stacey Foss and Todd Nelson (contractor) represented the Application.
Julia Miller expressed concerns regarding drainage.
Motion: A motion by Erickson, second by Schwartz to approve as presented with
conditions; 1. Drainage is addressed so that water collected around the building drains
away from the neighbor, toward the driveway. 2. Land & Resource is notified prior to
anymore work being done. 3. Appropriate erosion control measures must be implemented.
Voting Yes: Erickson, Gill, Kinzier, Olson, & Schwartz. Voting No: Boyer, Maske, Wilson, &
Zimmerman.
Robert & Susan Mitchell - Approved As Presented:
A Conditional Use Permit Application (as stated by the Applicant):
To erect 42’ steel tower and attached wind energy turbine within 290/300 ft of lake (maxing
at 48’ 10” clearance, including the blades). The property is described as FrI SI/2 NW1/4 ex
trs and pt NE1/4 SW1/4 com SI/4 cor Sec 6 (69.24 AC), Section 6 of Otto Township; Albert
Lake (56-118), NE.
Robert & Susan Mitchell represented the Application.
Motion: A motion by Wilson, second by Maske to approve as presented; reasons being
there is not any adverse effect regarding the lake or lotlines. Voting: All members in favor,
except Zimmerman.
Break: At 7:35 the Commission took a 7 minute break.
Kyle Berqren - Approved With Conditions:
A Conditional Use Permit Application (as stated by the Applicant): Install 4 retaining walls: 1).
60’ long x 5’ high. 2). 70’ long x 5’ high. 3). 70’ long x 5’ high. 4). 25’ long x 5’ high. Install
4 sets of concrete steps - Step A, B, and C will be 9 steps high, 4’ wide and 12” treads.
Step D will be 4 steps high, 4’ wide and 12” treads.
Proposed walls will be placed in same location of existing rock walls with very little
excavating. The only digging needed is for 6” base under walls and steps and for T thick
layer 3/4“ rock behind all walls. Materials needed would be 30 cu. yds. fill sand for area 5,
20 cu. yds. class 5 gravel, 20 cu. yds. % rock and 20 cu. yds. topsoil to fix grass. Total
earthmoving 100-150 cu. yds. Property is described as Cedar Park Club Lot 2, Section 30
of Dane Prairie Township; Swan Lake (56-781), RD.
Kyle & Tonya Bergren and John Emery (Natures Garden World) represented the Application.
The Applicant indicated that they also request to replace a small retaining wall adjacent to
the house on the west side (6-8’).
