(7:45 p.m.) LAD Properties LLC, part of Government Lots 8 and 9, Section 26 of Dead Lake Township by Dead Lake, requested the following: a variance to replace existing 50 year old storage sheds within and on the 200’ setback. Proposed storage building in this location would have little environmental impact in regards to grade and fill and tree removal. Closet point of new shed will be 170’ from the ordinary high.water level. The audience was polled with no one speaking for or against the variance as requested. After consideration and discussion, Thomas Lee made a motion, second by Steve Schierer and carried with Michael Harris voting no, to approve a variance of 30’ from the required ordinary high water level setback of 200’ for the construction of storage building no closer than 170’ from the ordinary high water level as described in the variance application dated July 12, 2010 and as depicted on the drawing submitted with the variance application. It should be noted that the new storage structure will replace two existing older storage sheds. The Township adopted an ordinance requiring permits for work within its road rights-of-way in June of 2008, and that ordinance has been explained to the Hermans. They have agreed to complete and pay the permit fee; and the Township Board reviewed the matter Tuesday evening, July 6, and has agreed in principle to approve the permit to be filed by the Hermans. That permit will contain the following language (from the ordinance) to make it clear that the Hermans will be responsible for any damage done to the Township’s right of way as a result of the installation, maintenance, repair, and improvement they have proposed. Specifically, the language of the ordinance states: Limitations. Any person required to obtain a permit under this ordinance shall indemnify and hold the Town harmless from any damage done to the Town’s right-of-way as a result of the installation, maintenance, repair, or improvement necessitating the permit. The Town shall not be liable for any damage to the permitted work as a result of the use, maintenance, repair, or improvement of the town road right-of-way. As you can see, the ordinance also makes it clear that the Township cannot be held liable for any damage to the sewer system as a result of use, maintenance, repair, or improvement of the Township’s right of way.
