Box 48 Kent, Minnesota 56553 Dear Mr. Falk and Mr. Basehore: Subject: Variance from Minnesota Rules, Chapter 4725, for Construction of a Water-Supply Well, Minnesota Unique Well Number 752972, on the Dale Basehore Property at 24946 Wall Lake Point Circle, Located in the NE Va of the SW 14 of Section 4, Township 132 North, Range 42 West, Dane Prairie Township, Otter Tail County, Minnesota_________________________________________ This letter is in response to your request for a variance from Minnesota Rules, Chapter 4725, to construct a water-supply well on the subject property, 33 feet from an untested buried sewer on the subject property, 40 feet from an untested buried sewer on the neighboring property to the west, and 30 feet from the ordinary high-water level of Wall Lake. Minnesota Rules, part 4725.4450, subpart 1, item E requires that a water-supply well must be located at least 50 feet from a buried sewer. Minnesota Rules, part 4725.4450, subpart 1, item G does allow a well to be located a minimum of 20 feet from a buried sewer that serves one building or two or less single family residences and is constructed of cast-iron or plastic pipe that meets the materials and pressure testing specifications of Mirmesota Rules, parts 4715.0530 and 4715.2820 (Minnesota Plumbing Code), provided that the sewer is not a collector or municipal sewer and does not serve a facility handling infectious or pathological waste. Minnesota Rules, part 4725.4350, subpart 1 requires that a water-supply well must be a minimum horizontal distance of 35 feet from the ordinary high-water level of a stream, river, pond, storm water retention pond, or lake. On April 22, 2011, Mr. Jeffrey Grugel, district hydrologist with the Minnesota Department of Health (MDH) Fergus Falls district office, met with Mr. Gary Auseth of Fergus Well Company and inspected the subject property. Mr. Grugel reported that there is no location for a well on the property that satisfies all of the isolation requirements of Minnesota rules. The proposed well location identified in the variance request application appears to provide the greatest practicable separation from the known potential contamination sources and hazards. The variance application indicates that the proposed well would be constructed by the rotary drilling method to an estimated depth of 60 feet. The well would have 56 feet of 4-inch diameter polyvinyl chloride (PVC) well casing, and the annular space surrounding the casing would be filled with bentonite grout. In order to accommodate the timely replacement of the water supply, Mr. Grugel explained to Mr. Auseth the conditions under which a variance would be granted and did provide verbal approval on May 5, 2011, to allow drilling to begin. Based on Mr. Grugel’s inspection, information provided in the variance request, and in accordance with Minnesota Rules, Chapter 4725, a variance is hereby granted to Mr. Dale Basehore and Fergus Well Company for construction of a new water-supply well, Minnesota Unique Well Number 752972, 33 feet from an untested buried sewer on the subject property, 40 feet from an untested buried sewer on the neighboring property to the west, and 30 feet from the ordinary high-water level of Wall Lake at 24946 Wall Lake Point Circle, Fergus Falls, Minnesota. The variance is granted because there is no accessible location for a well on the subject property that complies with all required isolation distances. The proposed well location appears to provide the greatest practicable separation between the well and known potential contamination sources. Because the isolation distances between the proposed well and the buried sewers and lake is less than required in rule, additional construction methods and precautions are required in order to reduce the potential for contamination of the well and groundwater. The following list of additional conditions and requirements should provide the necessary additional protection for the well and groundwater. The variance is granted with the following conditions: You must contact Mr. Grugel at 218/332-5148 at least 24 hours prior to beginning well construction so that arrangements for inspection during well construction may be made. 1. The well casing for the proposed well must extend to a depth of at least 50 feet and penetrate at least 10 feet of clay or sandy clay material. 2. 3.The annular space between the well casing and the bore hole wall must be filled with neat-cement grout, cement-sand grout, or bentonite grout as defined in Minnesota Rules, part 4725.0100. Bentonite grout must be a mixture of water and a minimum of 15 percent by weight powdered or granular bentonite that is NSF approved, must be designed by the manufacturer as a well sealant or grout, and must be mixed to the manufacturer's specifications. Grout must be inserted through the casing or through a tremie pipe from within 10 feet of the bottom of the casing up to the ground surface or base of the pitless connection. The disposal of drilling mud, cuttings, treatment chemicals, and discharged water must be in accordance with applicable state and local regulations. Suitable containment or temporary erosion control measures must be provided so that contaminants do not enter the lake. 4. Mr. Gary Auseth Mr. Dale Basehore Page 3 May 11,2011 5. The existing well on the subject property must be permanently sealed by a Minnesota licensed well contractor or licensed well sealing contractor in accordance with Minnesota Rules, Chapter 4725, within 30 days after completion of the new well. 6. All other provisions of Minnesota Rules, Chapter 4725, are in effect. Mr. Grugel was on the site on May 9, 2011, during completion of the well construction. Mr. Grugel was informed that the water-bearing formation that was expected at a depth of 60 feet, based on a construction record for a neighboring well, was not encountered. Instead, the well was drilled to a depth of 140 feet, with 136 feet of 4-inch PVC well casing and 4 feet of stainless steel screen. The annular space was grouted with bentonite grout from a depth of 126 feet up to the ground surface. Alternative measures or conditions attached to a variance have the force of law and effect of applicable rule. If a party violates the alternative measures or conditions attached to the variance, the party is subject to enforcement actions and penalties provided in the applicable law or rule. This variance is conditioned upon the applicable acceptance of and compliance with the conditions of the variance. Failure by the applicant to comply with the conditions prescribed in the variance will result in the immediate expiration of the variance.
