Conditional Use Permit - Dennis & Suzanne Nelson:
Motion by Froemming, second by Lee, and unanimously carried to approve a Conditional Use
Permit for a grade and fill project with conditions as recommended by the Planning
Commission. The property is described as Lot 3 Block 1 Elwill Beach 2"*^ Addition, Section 5
of Girard Township; Lake Ethel (56-193).
Conditional Use Permit - Clay Amundson:
Motion by Froemming, second by Mosher, and unanimously carried to approve a Conditional
Use Permit for a road project with conditions as recommended by the Planning Commission.
The property is described as Public Road adjacent to: Lots 1,2,3 Block 1, Coney Island
Acres Second Addition on Coney Island Trail, Section 33 of Girard Township; West Battle

Conditional Use Permit - Lorin L & Anna Mae Remmick:
Motion by Froemming, second by Lee, and unanimously carried to approve a Conditional Use
Permit for grade and fill projects with conditions as recommended by the Planning
Commission. The property is described as Lot 3, West Shady Nook Beach, Section 15 of

Conditional Use Permit Extensions
Land & Resource Director, Bill Kalar, presented a request from PAC Investments to extend
the Conditional Use Permit for the subdivision of “Waters Edge” on Sewell Lake. Discussion
took place. Motion by Mosher, second by Lee, and unanimously carried to extend
Conditional Use Permit #6142 until November 1, 2004.
Motion by Mosher, second by Lee, and unanimously carried to approve the extension request
of John Mark from Dane Prairie Township for Conditional Use Permit #6106 to repair work on
County Ditch No. 43 until November 2, 2004.
Motion by Lee, second by Block, and unanimously carried to extend Conditional Use Permit
#6152 until November 15, 2004, to construct a road. This extension request was submitted
by Charles Kvare.
Final Plat
Motion by Lee, second Froemming, and unanimously carried to approve the Final Plat of
Terry Reyman known as “Mooring Stone 2"*^ Addition located in Section 16, Township 137,
R.42, Dunn Township on Pelican Lake (56-786) and Fish Lake (56-768).
Absentee Ballot Board
Motion by Lee, second by Mosher, and unanimously carried to authorize the Auditor to
establish the Absentee Ballot Board for the General Election.
Temporary Assistance Authorized
Motion by Mosher, second by Lee, and unanimously carried to authorize the Auditor to
proceed with hiring temporary help as needed for assistance with the general election.
Payment Approval
Motion by Lee, second by Block, and unanimously carried to authorize payment of $420.00

cul-de-sac conforming to the County’s Subdivision Controls Ordinance is constructed at the
end of the existing road. 2. The old road is removed to the satisfaction of Land &
Resource Management. Reasons for the cul-de-sac requirement include safety (i.e. school
busses) & maintenance. Voting: All Members in favor, except Maske & Olson.

Kevin Poore / Edna Township - Approved As Requested:
A Conditional Use Permit Application (As stated by the Applicant): Lot owner and Township
propose to construct a driveway utilizing an adjacent portion of a dedicated roadway. Aim
is toward minimal land impact and safety for residents and public (drawings on file with
Land & Resource Mgt. Office). Drive would begin at the existing township road, extend
180’, than bend onto the adjacent lot itself. Dedicated roadway portion will be built to
township road width/slope/top specifications so as to in no way impede completion of the
road should it be built. Township specifies a 40’ culvert and connecting point for roadways
not to exceed existing road elevation. Roadway side slope grade 3:1; maximum cut/fill
intended is 31/2 ft. and 2 ft. respectively and maximum 1500 cu. yds. earthmoving
expected. Propose extra earth be placed 100’ minimum north of township road on Lot 1
BIk 2, also same owner. The property is described as Lot 4 BIk 1& Lot 1 BIk 2, Little
McDonald North Shore Estates and Dedicated Road bet Lot 4 BIk 1 & Lot 1 BIk 2, Little

revised drawing (dated April 21, 2004) and a Conditional Use Permit to construct a road to
service the proposed plat, with conditions as recommended by the Planning Commission.

Conditional Use Permit - Gerald A. & Deborah M. Lubenow:
Motion by Lee, second by Froemming, and unanimously carried to approve a Conditional Use
Permit to operate a commercial business to be fully operational within 5 years, with
conditions as recommended by the Planning Commission, and to add a 6*^ condition as
follows: 6. This Conditional Use Permit is to be reviewed by the Land & Resource
Department every year. The property is described as Pt Lot 1 W of Hwy & S of E & W Subd
Road ex tr. Section 11 of Dunn Township: Pelican Lake (56-786)
Conditional Use Permit - Corliss Township & Maureen Richter:
Land & Resource Director, Bill Kalar, briefed the Board regarding the proposed, revised
relocation (Alternate B) of Nitche Lake Road. Corliss Township proposed a 24’ x 50’ turn
around. The Planning Commission is recommending a cul-de-sac rather than a turn around.
Project Engineer, Jeff Stabnow, presented letters from the Perham Bus Company and the Big
Pine Lake Association, both in favor of the turn around proposal. This is an existing

repeater. Currently, the County is paying $75 per day for rent on that tower. He explained
that Arvig Communication Systems has a tower on County Road 8 that could be a new
location and that tower would provide approximately 100 ft. of additional elevation. There
have been some problems with reception with the Perham Tower in the past. Mr. Paulseth
requested permission to replace the current Perham Tower repeater with a new one and run
new wire and install the new repeater on the ACS Tower. The ACS tower rental is $200 per
month. He also requested permission to replace the Pelican repeater and move it from the
Pelican Tower, which currently costs $75 per month, to the Erhard Tower that is owned by
the County. Motion by Froemming, second by Nelson, and unanimously carried to authorize
the Sheriffs Department to replace the repeaters at the Perham and Pelican Towers at a cost
of $7,900, which includes moving, wiring, and installing. The majority of the cost will be paid
out of the Sheriffs Department Capital Improvement Fund with a small portion paid from the
Sheriffs Department Operating Budget.
RESOLUTION AUTHORIZING EXECUTION OF AGREEMENT
Otter Tail County Resolution No. 2003 - 48
Commissioner Block offered the following and moved its adoption:
BE IT RESOLVED, that Otter Tail County enter into a grant agreement with the Minnesota
Department of Public Safety, Office of Traffic Safety, for the project entitled SAFE & SOBER
COMMUNITIES during the period from October 1, 2003 through September 30, 2004.
The Sheriff of Otter Tail County is hereby authorized to execute such agreements and
amendments as are necessary to implement the project on behalf of the Otter Tail County
Sheriffs Office and to be the fiscal agent and administer the grant.
Commissioner Mosher seconded the motion and upon being put to a vote, the above
resolution was unanimously adopted.

County Ditch No. 43
Ditch Inspector, Randy Wasvick, informed the Board that Dane Prairie Township will lower
Rosvold Lake that flows into County Ditch No. 43. They will replace a culvert underneath
their township road (190^^ Street) and replace some tile on Lindquist’s property to control
flooding concerns. Motion by Mosher, second by Block, and unanimously carried to
authorize Dane Prairie Township to lower Rosvold Lake and replace a culvert and tile as
described, subject to the township working with the DNR on this project.
Lake Oscar -120“’ Avenue Flooding Concern
Oscar Town Board Member, David Hegseth, requested permission for the Township to
proceed with work on 120*” Avenue because of a flooding concern from the increased water
levels of Lake Oscar. The Town Board has applied for a Conditional Use Permit under the
ordinance. Discussion followed. Motion by Mosher, second by Block, and unanimously

Level to protect the Township Road (270‘*’ Ave.) in Dane Prairie Township.

.5 below the Ordinary High Water Level to prevent raising Madsen Lake and flooding

ROSVOLD LAKE (56-63 IP) AND BALSTAD LAKE (56-642P), OTTER TAIL COUNTY
On October 29 and October 31,2003,1 surveyed water elevations on these two lakes, and found the
following.
Rosvold Lake (56-63IP) was found to be at elevation 1315.9 or 1.1 feet above the ordinary high
water elevation of 1314.8. You can lower the lake 1.1 feet without a DNR permit but you should
contact Randy Wasvick, the Otter Tail County Ditch Inspector. I set a stake near the outlet in 1.1
feet of water to indicate how much you can lower the lake.
Balstad Lake (56-642P) was found to be at elevation 1308.9 or 0.4 feet below the ordinary high
water elevation of 1309.3. If you decide to provide a functioning outlet for Balstad Lake, it should
be no lower than 0.4 feet above the existing lake level.
I have a local bench mark set near the two lakes if you need further information. I would appreciate
you letting me know when this might happen.

On the SE side of Basin 56-642, water is presently outflowing slightly to Basin 56-643 over the top of
some sandbags that have been placed in a 6' wide low area of the lake bank. The top of the sandbags
are at elevation 1309.5 and the bottom within the low area itself is 1308.9. The water level of Basin
56-643 is 1306.8, but on the 1973 USGS quadrangle it appears to be landlocked up to at least 1320.
On the south side of Basin 56-642, there is a ditch connection to a non-inventoried basin in the NE-SE
of Sec. 22 and the NW-SW of Sec. 23. The present connecting elevation is 1307.9 and the two basins
are equalized. On the 1973 USGS quadrangle, the non-inventoried basin appears to be landlocked up
to 1320 also. However, an old plan of County Ditch 43 shows a connection between the non-
inventoried basin and Basin 56-641 to the west. As such, we investigated this area to see what we
could find.
There is no ditch connection at this area, so if a coimection exists it must be an underground tile hne.
If there is a tile line, it must be sufficiently plugged, since outflow is presently occurring at the other
area to the SE. We found the top of the ridge at this area to be at elev. 1318.7 and, as such, under
present conditions. Basin 56-642 is landlocked up to at least that elevation.
The most significant O.H.W.L. tree evidence we documented were numerous dead birch and
cottonwoods, indicating stages of water levels at 1303.2 and 1304.8. Some very limited additional tree
evidence (two oaks and a basswood) suggest a higher stage at 1309.3. No stainline or washline
evidence was observed. The water level of the basin is shown at 1304 on the 1973 USGS quadrangle.
Since Basin 56-642 is landlocked up to at least elev. 1318.7, the appropriate O.H.W. level of the basin
is 1309.3.
One picture was taken of the connecting ditch between Basin 56-642 and the non-inventoried basin.
