1. APPLICATION FOR PERMIT TO retain fill material, and place additional fill in
wetlands adjacent to Long Lake. The applicant placed fill material in an area of
wetland along the shoreline of the lake to provide access and a yard area. The
applicant proposes to place additional fill to complete the project.
If it is determined that issuance of an after-the-fact permit is not in the public
interest, corrective action may be taken in connection with the work already accomp
lished.

PROJECT LOCATION: The project worksite is located in section 29, township
137 N., range 40 W., Otter Tail County, at Vergas, Minnesota.
QUANTITY AND TYPE OF ;FILL: Approximately 100 cubic yards of rock, sand and
earthen material has been placed in the wetland. An additional 140 cubic yards of
gravel would be placed in the wetland and topped with a layer of black dirt.
An area 47 feet long (along the shoreline) and 38 feet wide (landward)

SUBJECT:Notice of Application for Permit
This application is being coordinated with the. U.S. Fish and Wildlife Service and
the National Marine Fisheries Service. Any comments they may have concerning en
dangered or threatened wildlife or plants or their critical habitat will be con
sidered in our final assessment of the described work.
3. JURISDICTION: Long Lake is part of the tributary system o|f the Otter Tail

This Public Notice has been sent to the Minnesota Pollution Control Agency
and is considered by the District Engineer to constitute valid notification to
that agency for water quality certification. The Minnesota Pollution Control
Agency has indicated that it intends to review this project to determine the
appropriate action under Section 401 of the Clean Water Act.! Any comments rel

5. HISTORICAL/ARCHAEOLOGICAL
This public notice is being sent to the National Park Servicei, the State
Archaeologist, and the State Historic Preservation Officer to| determine if
there are known cultural resources which may be affected by the described
work. Any unknown archaeological, scientific, or historical ^data could be
lost or destroyed by the work described in the permit application. However,
the latest version of the National Register of Historic Places has been con
sulted and no listed properties (known to be eligible for inclusion, or
included in the Register) are located in the project area. |

7. REPLIES/COMMENTS
Interested parties are invited to submit to this office written facts* arguments,
or objections within 30 days of the date of this notice. These statements should
bear upon the suitability''of the location and the adequacy of the project and
should, if appropriate, suggest any changes ijelleved to be desirable. Comments
received may be forwarded to the applicant.
8. PUBLIC HEARING REQUESTS
Any person may request, in writing, within the comment period specified in this
notice, that a public hearing be held to consider this application. Requests for
public hearings shall state, in detail, the reasons for holding a public hearing.
A request may be denied if substantive reasons for holding a hearing are not
provided or if there is otherwise no valid interest to be served.

We have considered all comments received regarding this permit application,
and we have completed our environmental assessment. We have decided to deny
the permit for the proposed placement of fill material and order restoration of
the wetland. Our public interest review showed that the benefits of the project
did not outweigh the detriments. Mr. Larimer did receive authorization to re
tain a 15-foot wide at the base access path through the wetland.
