April 15. 2015 - Motion:— A motion by Schwartz, second by Gabe to deny the request, due to the lack of specificities
to make a determination on the environmental impact for the cut and fill requested.
May 20. 2015 - Motion: A motion by Boyer, second by Wilson to approve as presented on the
drawing received May 1, 2015, provided: 1. The grade line on the trail starts with a negative
slope from the lake for the first 100’. 2. The cut is as shown for the first 40’ on Lot 15. 3. The

Conditional Use Permit- Patrick Peck:
Motion by Rogness, second by Huebsch, and unanimously carried to approve a Conditional Use Permit for
a private boat access as presented. The project is located in the SI/2 NE1/4 SW1/4, SW1/4 SW1/4 &
SI/2 of Lot 3 (79.75 AC), Section 20 of Scambler Township; Rankle Lake (56-935), NE.
Conditional Use Permit - Dustin & Rachel Ebersviller:
Motion by Huebsch, second by Johnson, and unanimously carried to approve a Conditional Use Permit for
a zoo to be developed in accordance with all government requirements on the applicant’s property as
presented. The project is located in the SW1/4 NW1/4, Section 10 of Candor Township; Unnamed Lake
(56-533), NE.
Conditional Use Permit - Jerome M. & Patricia J. Kirscht:
Motion by Rogness, second by Johnson, and unanimously carried to approve a Conditional Use Permit to
operate a business. Northern Plains Retrievers, as presented provided that all state and federal
requirements are met and the number of dogs onsite may not exceed 75. The project is located in Pt of
GL 1 and NE1/4 NW1/4 and SE1/4 NW1/4, Section 16 of Effington Township; Block Lake (56-79), RD.
Conditional Use Permit - Tami Bover and Robert & Terri Lanalie:
Motion by Rogness, second by Johnson, and carried with Johnson abstaining to approve a Conditional
Use Permit to cut part of a hill by the lake area for better access as recommended by the Planning
Commission. The proposal is located on Lots 14, 15 & 16 Freedom Flyer Estates, Section 29 of Hobart
Township; Long Lake (56-388), RD.
OCTA Trail Route Reduction
A Grant-in-Aid Trail Permit form was provided by MN DNR to Bill Kalar, Land & Resource Director, to be
signed. Mr. Kalar requested this matter be delayed due to conflicting interests that need to be addressed.
Mr. Kalar will reschedule this matter once resolution has occurred.
Subsurface Sewage Treatment Rules
Commissioners discussed the State’s Subsurface Sewage Treatment (SSTS) as set forth in Minnesota
Rules Chapters 7080 through 7083, which are also contained in what is commonly referred to as the
“Purple Book.” Discussion was held with Bill Kalar, Land & Resource Director, regarding the State rules
compared with the Otter Tail County Sanitation Code.
Bid Award - CSAH 35
After previously advertising for bids for SA.P. 056-635-033, bids were opened on May 20, 2015, at the
GSC in Fergus Falls, MN. Motion by Johnson, second by Rogness and unanimously carried to award the
Bituminous Milling, Wear Courses, Aggregate Shoulders and Topsoil project to the low bidder, Tri-City
Paving, Inc., of Little Falls, MN, at the bid amount of $2,113,272.72, as recommended by the Public Works
Director.
Bid Award - CSAH 65
After previously advertising for bids for S.A.P. 056-665-009, bids were opened on May 20, 2015, at the
GSC in Fergus Falls, MN. Motion by Foemming, second by Johnson and unanimously carried to award the
Full Depth Reclamation and Bituminous Overlay project to the low bidder, Tri-City Paving, Inc., of Little
Falls, MN, at the bid amount of $1,570,880.54, as recommended by the Public Works Director.
Amendment to Proposal - CSAH 38 MPCA Permit and EAW Preparation
Rick West, Public Works Director, presented that Bolton & Menk, Inc., of Burnsville, MN, conducted a
preliminary visual inspection of CSAH 38 Reconstruction Area of Potential Effect. During this inspection,
several areas were identified as requiring subsurface testing because archaeological materials may be
present. Motion by Johnson, second by Rogness and unanimously carried to authorize an amendment to
the original proposal for CSAH 38 to amend this service agreement to include an archaeological survey as
presented by the Public Works Director.Ai

Dustin & Rachel Ebersviller - Approved With A Condition:
A Conditional Use Permit Application (as slated by the Applicant on the Application): I would like to
make my property into a zoo in the Detroit Lakes/Vergas area. It will be a Licensed USDA
facility following all USDA guidelines. It will be built in 4 phases and will be a total of 40
acres. Phase 1 will have 20 species on about 10 acres. It will have 20 - 30 parking spaces
and will be completed late summer of 2015. The zoo will be open Memorial Day - Oct. 31,
7 days a week, 10 am - 6 pm weather permitting. There is a projected 10,000 - 15,000
people annually to visit the Zoo. Phase 2 will be completed by Spring 2018, with 40 species
on 20 acres and 50 parking spaces. Phase 3, 30 acres and 60 species by 2020. Phase 4,
40 acres and 80 species completed by 2024. The project is located in the SW1/4 NW1/4,
Section 10 of Candor Township; Unnamed Lake (56-533), NE.
Dustin & Rachel Ebersviller represented the Application.
David Ebersviller, closest neighbor, indicated that he has livestock and does not have any
concerns regarding this request.

Jerome M. & Patricia J. KIrscht - Approved With Conditions:
A Conditional Use Permit Application (as staled by the Applicant on the Application): We would like
a permit to operate our business. Northern Plains Retrievers, on the property located at
48828 Co. Hwy 6, Parkers Prairie, MN. At Northern Plains Retrievers we train retrievers for
waterfowl and upland bird hunting, and we raise Labrador Retriever puppies. Additional
Information on file at Land & Resource. Property is located approximately 6 miles west of
Parkers Prairie on County Hwy 6. The project is located in Pt of GL 1 and NE1/4 NW1/4

Conditional Use Permit- Deanna Alama:
Motion by Rogness, second by Froemming, and unanimously carried to approve a Conditional Use Permit
to allow the applicant to; 1) add the circular patio with maximum of 20’ diameter with the fire pit, 2) remove
existing timber retaining walls and replace with boulders, and 3) construct a patio under the existing deck;
provided there is no removal of existing trees between the house and the lake, or any earthmoving or
placement of structures within the shore impact zone. These conditions are as recommended by the
Planning Commission. The project is located in Pt of GL 4 (3.32 AC), Section 20 of Leaf Mountain
Township; Spitzer Lake (56-160), NE.

Motion by Froemming, second by Huebsch, and unanimously carried to approve the Preliminary Plat titled

Conditionaf Use Permit - Craig Dresser:
Motion by Rogness, second by Froemming, and unanimously carried to approve a Conditional Use Permit
for this land alteration project which will reduce current impact on the lake as presented. The project is
located in Engstrom Beach 5®^ Addition Lot 49 BIk 1, Section 18 & 19 of Edna Township; Big McDonald

Conditional Use Permit- Paul Ross Tst:
Motion by Froemming, second by Huebsch, and unanimously carried to deny a Conditional Use Permit to
construct a private access approach off of N Silver Lake Rd due to safety and water drainage concerns as
recommended by the Planning Commission. The proposal is located on Silver View Park Lots 8 & 9,
Section 21 of Everts Township; Silver Lake (56-302), RD.
Heisler's Country Store. Marvin & Sandra Heisler/Chad Canton:
Land & Resource Director Bill Kalar read a letter from the City of Vergas requesting a fence be built to
effectively screen view by the public due to the number of abandoned vehicles on this site. Mr. Kalar
indicated that Mr. Canton has been cleaning up the site. Discussion followed. Motion by Rogness, second
by Huebsch, and carried with Lindquist opposed, to approve a Conditional Use Permit to operate a vehicle
repair shop as presented with the following condition: The Applicant must submit a site storage plan which
includes fencing and location for a maximum of twenty vehicles to the Land & Resource Management
Office. The project is located in the NE!4NWI4 ex trs & GL 3 (66.05 AC), Section 35 of Candor Township:

RE: Conditional Use Permit Status
At the Planning Commission meeting on April 15, 2015 for a conditional use permit, the board
encouraged us to table our request for permission to make changes on Lot 14 and Lot 15 on Long Lake
Freedom Flyer Estates, Section 29 of Hobart Township. There was an error in judgment on our part due to
an unfortunate timing of the motion and the suggestion to separate the original request into two
requests (one request for the ridge down by the lake and another request for the swale areas/basement
excavating/landscaping).
We respectfully request that you consider changing the status of our application from denied to tabled.
