request. After consideration, motion was made by Craig Anderson, seconded by Randall
Mann, to approve the variance as requested by the applicant. After additional discussion,
motion was made by Craig Anderson, seconded by George Walter and unanimously carried, to
table the variance request, until the August 3rd, 1995, Board of Adjustment meeting, to
allow an opportunity for all of the board members to view the applicant's property.

October 13th, 1994 Meeting - After much discussion and consideration, motion was made by
Craig Andersen, seconded by Cecil Femling and unanimously carried, to table the variance
request until July 1995 for additional information regarding a pending court case in
Hubbard County.
August 3rd, 1995 Meeting - After consideration and discussion, motion was made by Craig
Anderson, seconded by John Everts and unanimously carried, to allow a subdivision creating
two lots having a minimum area of at least 49,000 square feet and a minimum lot width and
lake frontage of at least 133*.

Arnold and Janice Ness, Barnesville, MN, and Lynn Goerger and Janice Friedrich, West
Fargo, ND, requested a variance of 27' from the required ordinary high water level setback
of 75' for the location of two septic tanks 48' from the ordinary high water level, a
variance of 7’ from the required structure setback of 10' for the location of a septic
tank 3' from the cabin located on Parcel C and a 10' variance from the required structure
setback of 10' for the location of a septic tank 0’ from the cabin located on Parcel B.

On Thursday, July 6th, 1995, the Board of Adjustment took action requiring the applicants
to discuss vith various officials the applicants’ plans, to review other possible
alternatives and to submit a report of those discussions to the Board of Adjustment for
their consideration on August 3rd, 1995. The applicants were not able to complete the
requirements by Thursday, August 3rd, 1995, and requested an eMtension until the September
7th, 1995, meeting. After consideration, motion was made by George Walter, seconded by
Craig Anderson and unanimously carried, to grant the applicants the requested e;itension.
With no further business. Chairman Waiter declared the meeting adjourned at 10 p. m.

Allen and Norma Braun, Frazee, MN, requested a variance that vould permit Lot 2 of Sky
Blue Water Beach to remain as a separate lot instead of being combined with Lots 3 and 4
of Sky Blue Water Beach. Lots 2, 3, and 4 are substandard contiguous lots which have been
combined for purposes of the Otter Tail County Shoreland Ordinance. The minimum lot size
requirement for platted lots on a recreational development lake is 40,000 square feet of
area and 150' of water frontage and lot width. The property is described as Lots 2, 3,
and 4, Sky Blue Water Beach, Lake Six in Hobart Township. The audience was polled with no
one speaking for or against the request. After consideration, motion was made by Craig
Anderson, seconded by Carl Johnson and unanimously carried, to table the variance request
until the October 13th, 1994, meeting for additional information and clarification of the
ordinance. After much discussion and consideration, motion was made by Craig Anderson,
seconded by Cecil Femling and unanimously carried, to table the variance request until
July 1995 for additional information regarding a currently pending court case.
Clarifications:
Mark Caspers appeared before the Board to request a modification of the variance that was
approved at the October 6th, 1994, Board of Adjustment meeting. It was the general
consent of the Board that no modification or additional action would be granted.
Tim Griep, Land and Resource Management, asked the Board for additional information and
clarification regarding Richard and June Bjorgum's variance request which was denied at
the October 6th, 1994, Board of Adjustment meeting. It was the general consent of the
Board that they would not reconsider any of the variance requests that were denied at the
previous meeting.
Allen Chase appeared before the Board to request a broader interpretation of two
previously granted variance requests. After much discussion and consideration, motion was
made by John Everts, seconded by Carl Johnson and unanimously carried, to direct the
County Auditor to place on the November 3rd, 1994, agenda, for reconsideration the two
variance requests which were previously approved on March 24th, 1994, and on September
8th, 1994.
With no further business, Chairman Walter declared the meeting adjourned at 11:10 p.m.

Lori Beck and Carol Olmsted - Approved
Lori Beck and Carol Olmsted, Plymouth, MN, requested a variance of 53' from the required
ordinary high vater level setback of 100' and a variance of 3' from the required shore
impact .zone setback ..of 50' for the construction of a 16' by 24' addition to an existing
cabin 47' from the ordinary high vater level. The property is described as part of Lot 1
and part of Reserve F, Block 1, Leaf Lake Pleasure Grounds, West Leaf Lake in Leaf Lake
Township. The audience was polled with no one speaking for or against the request. After
consideration, motion was made by Carl Johnson, seconded by Cecil Femling and unanimously
carried, to approve a variance of 53' from the required ordinary high water level setback
of 100' and a variance of 3' from the required shore impact zone setback of 50' for the
construction of a 16' by 24' addition to an existing cabin 47' from the ordinary high
water level.The addition will be no closer to the lake than the existing structure.
Tom Geiser and Greg Jacobson - Denied
Tom Geiser and Greg Jacobson, Fergus Falls, MN, requested a variance of 70' from the
required ordinary high water level setback of 200' and a variance from the bluff impact
zone for the location of a gazebo in the bluff impact zone and 130' from the ordinary high
water level.The property is described as Lot 6, First Addition to Scenic Riverview
Acres, Otter Tail River/West Red River Lake in Frlberg Township. The audience was polled
with no one speaking for or against the request. After consideration, motion was made by
George Walter, seconded by John Everts and unanimously carried, to deny the variance as
requested as no adequate hardship had been shown.
Sheldon Hein - Approved
Sheldon Hein, Battle Lake, MN, requested a variance to exceed the maximum height
requirement for non-dwelling structures by 7'. The applicant's structure will be 25' in ■ •
height. The property is described as part of Government Lot 1, Section 29 of Amor
Township on Otter Tail Lake. The audience was polled with no one speaking for or against
the request. After consideration, motion was made by John Everts, seconded by Cecil
Femling and unanimously carried, to approve the variance as requested. It should be noted
that the granting of this variance request will not obstruct the view of adjacent property
owners and does not violate the intent of the ordinance as it relates to height
restrictions.

LeRoy H. Caron - Approved
LeRoy M. Caron, Perham, MN, requested a variance of approximately 41' from the required
ordinary high water level setback of 75' and a variance of approximately 3.5' from the
required shore impact zone setback of 37.5' for the construction of an 8' by 16' addition
to an existing garage structure approximately 34' from the ordinary high water level. The
property is described as Lots 37, 38 and 39, Nedberg-Nye Subdivision, Devils Lake in Edna
Township. The applicant was not in attendance at the hearing. After consideration,
motion was made by Carl Johnson, seconded by Cecil Femling and unanimously carried, to
table the variance request until the October 13th, 1994, meeting. The audience was polled
with no one speaking for or against the request. After consideration, motion was made by
George Walter, seconded by Cecil Femling and unanimously carried, to approve a variance of
41' from the required ordinary high water level setback of 75' and a variance of
approximately 3.5' from the required shore impact zone setback of 37.5' for the
construction of an 8' by 16' addition to an existing garage approximately 34' from the
ordinary high water level. The addition will be no closer to the ordinary high water
level or the road right-of-way than the existing structure.

Ten Mile Resort - Approved
Ten Mile Resort and Steakhouse, Pat and Mike Schultz, Dalton, MR, requested a variance of
17' from the required ordinary high water level setback of 100' for the construction of a
26' by 30' attached garage to an existing dwelling 83' from the ordinary high water level.
The property is described as part of Government Lot 3, Section 21 of Tumuli Township on
Ten Mile Lake. The audience was polled with no one speaking for or against the request.
After consideration, motion was made by Randall Mann, seconded by Cecil Femling and
unanimously carried, to approve a variance of 17' from the required ordinary high water
level setback of 100' for the construction of a 26' by 30' attached garage to an existing
dwelling 83' from the ordinary high water level. Hardship being the terrain and
topography of the applicant's property.
Walter Hordholm - Approved
Walter Hordholm, Et. Al, Silvius, IL, requested a variance of 43' from the required
ordinary high water level setback of 150' for the placement of a cabin 107' from the
ordinary high water level. The property is described as Lot 17, Channel View, Otter Tail
River in Otter Tail Township. The audience was polled with no one speaking for or against
the request. After consideration, motion was made by Craig Anderson, seconded by Cecil
Femling and unanimously carried, to approve a variance that would permit the applicant to
place a cabin having a width of 24' on the river side, a depth of 20' and a width of 18'
on the road side 12' from the the side lot line and 20' from the road right-of-way and
107' from the ordinary high water level. It was noted that the proposed location is the
most appropriate location for the placement of the applicant's cabin.

Vernon John Berge, Milan, MN, requested a variance of approximately 3-4" from the required
side lot line setback of 10' for the remodeling of an existing garage 6'8* from the side
lot line. The property is described as Lot 5, Wall Lake Point, Wall Lake in Dane Prairie
. Township. The audience was polled with no one speaking for or against the request. A
letter from Michael David Haugen opposing the applicant's request was read for the record.
After consideration, motion was made by Carl Johnson, seconded by Cecil Femling and
unanimously carried, to approve a variance of approximately 3'4* from the required side
lot line setback of 10' for the remodeling of an existing garage 6'8" from the side lot
line with the condition that it not exceed the maximum height requirement as stated in the
ordinance. Hardship being a substandard lot of record.
Gary Benson - Approved
Gary Benson, Dent, MN, requested a variance of 2' from the required 10' holding tank
setback for the addition of a garage to the Lodge 8' from the holding tank. The property
is described as Outlet A, Cozy Cove Subdivision-Heinrich Beach, Marion Lake in Dead Lake
Township. The audience was polled with no one speaking for or against the variance
request. After consideration, motion was made by Craig Anderson, seconded by Cecil
Femling and unanimously carried, to approve a variance of 2' from the required 10' holding
tank setback for the addition of a garage 8' from the holding tank. It should be noted
that the placement of the garage in this location will not restrict maintenance of the
septic system.
Dean R. Fjeld - Denied
Dean R. FJeld, Maple Lake, MN, requested a variance of 47' from the required ordinary high
water level setback of 75' for the addition of a three season porch to an existing
dwelling and for a 12' extension of the existing roof 28' from the ordinary high water
level. The property is described as Lot 8, Inlet Beach, 3rd Addition, Lake Lida in Lida
Township. The audience was polled with no one speaking for or against the request. After
consideration, motion was made by Cecil Femling, seconded by Craig Anderson and
unanimously carried, to deny the variance as requested. It was noted that the addition
would exceed the string line and that it would be in the shore impact zone.
