(7:20 p.m.) Crane Lake LLC, part of Government Lot 1, Section 26 of Clitherall Township by Crane Lake, requested the following: proposing to replace existing Cabin No 2 being 75’ from the ordinary high water level. Required setback is 100’. Requesting a 25’ variance. The new cabin will be a 32’ by 16’ (wanting to change roofline and square off structure). The applicant was represented by David and Candace Meyer. The audience was polled with no one speaking for or against the variance as requested. After discussion and consideration, Steve Schierer made a motion, second by Rick Wilson and carried with Thomas Lee voting no, to approve a 25’ variance from the required ordinary high water level setback of 100’ for the replacement of Cabin No. Two with a 32’ by 16’ structure 75’ from the ordinary high water level as described in the variance application dated September 17, 2015 and as depicted in the supporting drawing submitted with the variance application. The applicant’s proposal is generally in the same foot print as the existing structure and is away from the ordinary high water level. (7:27 p.m.) James Caliandro, Lot 1 Block 1 North Turtle Lake Shores, requested the following: Requesting a structure setback change from 200’ to 150’ for environmental impact reason’s similar to variances given to others on our lake. After discussion and consideration, Rick Wilson made a motion, second by Thomas Lee and unanimously carried, to approve a variance of 50’ from the required ordinary high water level setback of 200’ for the location of a building site 150’ from the ordinary high water level. Hardship/practical difficulty is the terrain of the applicant’s property. The variance as approved is consistent with past actions of the Board of Adjustment and will provide the applicant with a reasonable use of his property. It was also noted that the location of a building site 150’ from the ordinary high water level will result in less disturbance to the lot than if the building site is placed at the required 200’ setback. After discussion and consideration and with the applicant’s verbal consent, Steve Schierer made a motion, second by Thomas Lee and unanimously carried, to table this hearing until the August 13, 2015 meeting date to allow the applicant an opportunity to review his ability to move the proposed structure further back from the road right-of-way than what is currently proposed. Safety concerns with the proposed location were expressed. It was also noted that the proposed garage is setback further than the dwelling, which would be an improvement. Moving the holding tank was also discussed. August 13, 2015 meeting - After consideration and discussion, Steve Schierer made a motion, second by Thomas Lee and unanimously carried, to deny the variance as requested due to the failure of the applicants to appear at the public hearing unless the applicants submitted a letter/email granting the Board of Adjustment permission to table the public hearing until the September 10, 2015 meeting. September 10***, 2015 Meeting - No letter or email requesting the tabling of this application was received in a timely manner after the August 13, 2015 meeting; therefore, the requested variance has been denied based upon the action taken at the August 13, 2015 meeting. As neighbors (50560 Wymer Lake Loop, John and Mary Olson) we received notice of the original hearing scheduled for August 13, and now rescheduled for tomorrow. 2. As of two days ago, Denise Lakeman ( her brother is David Geizler) has died. Her visitation is tomorrow evening in Moorhead, the funeral Friday, also in Moorhead. I do not know if anyone will be at the hearing to represent the family. I am guessing that no one is thinking about it. 3. I am writing to inform you of these things and to speak on behalf of Denise and David, and the very small deck in question. I thought I had more time. The deck is quite small and in no way could obstruct the view or bother the neighbor, Vivian Anderson (whose husband recently died) who brought all of this to your attention. My husband, a builder/carpenter, says that the size of the Anderson lot and the placement of the Geizler/Lakeman deck should be no problem at all. There are even a few bushes and trees between the Anderson and Geizler/Lakeman properties. Vivian has some bad feelings about the Geizler/Lakeman family, having to do with iron markers and Vivian's disagreement of such placement. It is my understanding that Vivian was upset one day because the Lakeman laundry hanging on a clothesline blew a little bit over the property line, which at that point, is MANY feet from the Anderson house. I hope this reaches you before tomorrow and that you are able to make whatever adjustments are needed. It is quite possible that Vivian Anderson does not know of Denise Lakeman's death as it was just a day or so ago, and fairly sudden, and in Moorhead where she resides.
