December 10, 2015 meeting - Rick Duval, Contractor appeared with the applicant at the public hearing. The
applicant presented a revised set of plans, which requires the followirlg variances:
Variance of 20’ from the required ordinary high water level setback of 100’ and variance of 3’ from the required
side lot setback of 10’ for a 22’ by 24’ garage.
Variance of 1 % for impervious surface for total of 26%.

After discussion and consideration, Steve Schierer made a motion, second by Thomas Lee and unanimously carried, to
approved a variance of 20’ from the required ordinary high water level setback of 100’, a variance of 3’ from the
required side lot line setback of 10’ and a variance of 1% from the maximum impervious surface coverage of 25% for
the construction of a 22’ by 24’ garage 80’ from the ordinary high water level and 7’ from the side lot line as described
and depicted in the revised plans submitted at the December 10, 2015j meeting. It was noted that the additional 1%
would be impervious with or without the use of permeable pavers because it is the area that will be impacted by
vehicles. Hardship/practical difficulty is a substandard lot of record. The variances as approved do not directly or
indirectly grant any other variances fM^e proposed development.

David and Shelly Hendrickson - Variance application approved as requested. (6:43 p.m.)
David and Shelley Hendrickson, Lot 43 and part of Lot 44 Provan Beach, Pelican Lake in Dunn Township,
requested a variance of 10’ from the required road right-of-way setback of 20’ for the construction of a
detached garage 10’ from the road right-of-way. The audience was polled with no one speaking for or
against the variance as requested. After discussion and consideration, Rick Wilson made a motion, second
by Ward Uggerud and unanimously carried, to approve a variance of 10’ from the required road right-of-
way setback of 20’ for the construction of a 24’ by 24’ detached garage 10’ from the road right-of-way as
depicted on the drawing filed with the variance application. It was noted that the applicants’ current
development has a number of non-complying setbacks which will be eliminated by the proposed
development. It was also noted that other structures in this immediate area are just as close to the road
right-of-way if not closer. The variance as approved does not directly or indirectly grant any other variances
for the proposed development.
Steve and Mary Robar - Variance application approved as requested. (6:48 p.m.)
Steve and Mary Robar, Lot 5 Bush Hill Country Bay, East Battle Lake in Nidaros Township, requested the
following; Proposing to place a second story on the existing dwelling being 35’ from the ordinary high
water level. Requesting a 65’ variance. Required setback is 100’. Also proposing to have the lot declared
buildable for single family residential use. The lot was created November 14, 1972 and only has 30,000
square feet of area and it is required to have 40,000 square feet. November 12, 2015 meeting -The audience
was not polled as neither the applicants or anyone from the public was in attendance for this public hearing.
After consideration and discussion, Steve Schierer made a motion, second by David Wass and unanimously
carried, to deny the variance application for failure of the applicants to attend the public hearing unless the
secretary of board can obtain from the applicants within a reasonable time (two weeks) a letter granting the
Board of Adjustment authority to table their request until the next scheduled meeting of the Board of
Adjustment in which case the application will be considered tabled. December 10, 2015 meeting - Scott
Buchholz, Contractor appeared with the applicants at the public hearing. After discussion and
consideration, Paul Larson made a motion, second by Thomas Lee and unanimously carried, to approve a
variance of 65’ from the required ordinary high water level setback of 100’ for the placement of a second
story on the existing dwelling located 35’ from the ordinary high water level and to declare Lot 5 Bush Hill
Country Bay a buildable lot for single family residential use. The proposed development will be no closer
to the ordinary high water level than the existing development. The variances as approved do not directly or
indirectly grant any other variances for the proposed development.

requested the following:

the required side lot setback of 10’ for a 24’ by 24’ garage.
2. Variance of up to 8’ from the required 10’ side lot line to install driveway of permeable pavers. This
will allow use of township installed driveway/culvert.
3. Variance of 3% for impervious surface for total of 28%.

requested. A letter from Cindy and Darwin Hendrickson in support of the variances as requested was read
for the record. After consideration and discussion and with the applicants’ verbal consent, Thomas Lee
made a motion, second by David Wass and unanimously carried, to table this public hearing until the next
scheduled meeting of the Board of Adjustment, which will provide the applicants with an opportunity to
review the impact of the permeable pavers on the neighbor’s property, to consider reducing impervious
surface coverage to 25% or less, the possibility of extending the culvert to relocate the driveway and to
consider alternatives that will place the proposed garage more than 5’ from the lot line. December 10, 2015

Bob Tyler and Jack Young - Tabled
Bob Tyler and Jack Young, part of Government Lot 3, Section 10 of Dunn Township by Big Pelican Lake,
requested the following:
1. Sewer storage tank setback from proposed Pergola’s as drawn -
i. The North Pergola is 10’ by 16’ and is 6’ from septic storage
ii. The East Pergola is 10’ by 10’ and is 6’ from septic storage tank and we are requesting both a
variance from the tank for the 4’ shortage, and a variance from the south property line of 1 ’ 9”.
2. Variance requested for New Proposed Entry on the North side of the house, the distance to the North
property line would be 7’ 4” a 2’ 8” variance from the normal 10’ setback.
3. A proposed bay window (8’ by 2’ 6”) “No Foundation”. It would be 8’ 6” from the south property line
as opposed to the 10’, a 1’ 6” variance and 44’ to the water setback a 6’ variance.

the following: Requesting variance of 7’ from the 100’ ordinary high water level setback for a 10’ by 16’
addition to attach house and garage, which will be 93’ from ordinary high water level. Josh Eckhoff,
Contractor, represented the applicants at the public hearing. The audience was polled with no one speaking
for or against the variance as requested. Letters from Joanne and Steve Lynk and Joe and Lori Pytlik in
support of the variance as requested was read for the record. After consideration and discussion, Paul
Larson made a motion, second by David Wass and unanimously carried, to approve a variance of 7’ from
the required ordinary high water level setback of 100’ for the placement of a 10’ by 16’ addition to an
existing structure 93 ’ from the ordinary high water level as depicted on the drawing submitted with the
variance application. It was noted that the variance as approved is consistent with past actions of the Board
of Adjustment and will provide the applicants with a reasonable use of their property. The proposed
development is away from the lake and will not obstruct the view from the adjacent properties. The
variance as approved does not directly or indirectly grant any other variances for the proposed development.
Linda Johnson - Variance application approved as requested with a condition. (6:47 p.m.)
Linda Johnson, part of Government Lot 4, Section 2 of St. Olaf Township by Long Lake, requested the
following: Property proposed to be divided at Island Road via metes and bounds. Parcel #1 95,832 square
feet with 10.4% total impervious surface. Parcel 2 126,324 square feet to be adjoined to Krueger property
(Parcel #54000020014008). Resulting Lake front property Parcel #1 would be less than 5 acre minimum as
listed in ordinance. Derek and Mindy Krueger represented the applicant at the public hearing. The audience
was polled with no one speaking for or against the variance as requested. After consideration and
discussion, Thomas Lee made a motion, second by Ward Uggerud and unanimously carried, to approve the
proposed subdivision as described in the variance application dated October 8, 2015 and as depicted on the
drawings submitted with the variance application with the condition that a registered surveyor’s drawing
must be presented at the time of conveyance. The variance as approved does not directly or indirectly grant
any other variances for the proposed development.
