Jeffrey Pogalz - Approved
Jeffrey Pogalz, Prior Lake, MN, requested a variance of approximately 10’ from the required lot
line setback of 10’ for the installation of a drain field adjacent to the property line. The property
is described as Lot 7, Block 1, Pine Lake Shores, Little Pine Lake in Gorman Township. The
audience was polled with no one speaking for or against the request. After consideration and
discussion, motion was made by John Everts, seconded by Craig Anderson and unanimously
carried, to approve a variance of 10’ from the required lot line setback of 10’ for the installation
of a drain field adjacent to the property line. Hardship is the unique terrain features of the
applicant’s property.
Richard Falk - Approved
Richard Falk, Moorhead, MN, requested a variance of approximately 5’ from the required lot line
setback of 10’ for the installation of a holding tank approximately 5’ from the back lot line (road
right-of-way). The property is described as Lot 10 and the Easterly 10’ of Lot 11, Kozelnik’s
Beach Second Addition, Big McDonald Lake in Edna Township. The audience was polled with
no one speaking for or against the request. After consideration and discussion, motion was
made by Craig Anderson, seconded by Robert Schwartz and unanimously carried, to approve a
variance of 5’ from the required lot line setback of 10’ for the installation of a holding tank 5’ from
the back lot line subject to the approval of the Edna Town Board.
Mandley Johnson - Approved
Mandley Johnson, Hillsboro, ND, requested a variance of approximately 13’ from the required
ordinary high water level setback of 75’ for the installation of a septic tank located approximately
62' from the ordinary high water level. It should be noted that the drain field would be located
75' from the ordinary high water level. The property is described as Lots 4 and 5, Block 1,
Engstrom Beach First Addition, West McDonald Lake in Edna Township. The audience was
polled with no one speaking for or against the request. After consideration and discussion,
motion was made by Craig Anderson, seconded by John Everts and carried with Cecil Femling
voting no, to approve a variance of 13’ from the required ordinary high water level setback of 75’
for the installation of a septic tank 62' from the ordinary high water level. It was noted that the
drain field has been placed in a location that meets all setback requirements.
yViiliam T. Gallagher - Approved
William T. Gallagher, Fargo, ND, requested a variance of approximately 67 to 72’ from the
required ordinary high water level setback of 100’, a variance of approximately 17 to 22’ from
the required shore impact zone setback of 50’ and a variance of approximately 2’ from the
required side lot line setback of 10’ for the addition of a 12’ by 24’ three season room to an
existing mobile home located approximately 28 to 33’ from the ordinary high water level and
approximately 8’ from the side lot line. The height of the pitch will be approximately 18’. The
property is described as Lot 16, Clearwater Beach First Addition, Lake Six in Hobart Township.
The audience was polled with no one speaking for or against the request. After consideration
and discussion, motion was made by Craig Anderson, seconded by Cecil Femling and
unanimously carried, to approve a 12’ by 24’ addition, towards the lake, as depicted on the
applicant’s drawing. Hardship is a substandard lot of record.

County Shoreland Management Ordinance and/or the Subdivision Controls Ordinance. The Otter Tail County Board of
Adjustment will assemble for this hearing on
August 14,1997, at 7:00 p.m..
in the Commissioners’ Room of the Otter Tail County Courthouse, Fergus Falls, MN. (Please use the west Law
