motion is as follows:
A motion by Wilson, second by Rosenthal to approve as presented, provided the
Applicant works with Land & Resource for a stabilization plan for the entire project; it
was noted that there was an existing path prior to the work being done.
On July 24, 2018, the County Board approved your proposal with the conditions as
recommended by the Planning Commission.
As you can see, there are conditions placed on this approval. Once these conditions are
met, our Office will process your Conditional Use Permit.

Planning Commission Recommendations
Conditional Use Permit - Trudy Swanson:
Motion by Lindquist, second by Froemming and unanimously carried to deny a Conditional Use Permit to
raise the existing slab patio out of the water, raise existing boathouse structure and reinforce existing
retaining wall due to the length of time since the original application on July 9, 2014, and due to the unknown
outcome of the LMKP Lakes Outlet project, as recommended by the Planning Commission. The proposal
is located in Pt of GL 2 & NW% of the NE%, Section 14 of Edna Township; Paul Lake (56-335), RD.
Preliminary Plat - “Marion Shores”/ David Adams, et al & Jeremy Donabauer:
Motion by Huebsch, second by Rogness and unanimously carried to approve the Preliminary Plat titled
“Marion Shores” consisting of 5 single family residential riparian lots with conditions as recommended by the
Planning Commission. The proposal is located in GL 4 Ex Rr RN\I Ex Trs Ex Platted Aka Parcel D Ex Trs,

Conditional Use Permit - Robert & Rachel Posch:
Motion by Huebsch, second by Rogness and unanimously carried to approve an after-the-fact Conditional
Use Permit to repair and stabilize existing walking path along shoreline and going up the bluff with a condition
as recommended by the Planning Commission. The proposal is located in a 20.12 Ac., Pt of GL 3 & 4,18.10

Conditional Use Permit - Seclusion Point LLC/ Craig Peterson, et al:
Motion by Rogness, second by Huebsch and unanimously carried to approve a Conditional Use Permit to
add 6 recreational camping units in tier 1 and include 6 boat slips allowed by the Shoreland Management
Ordinance. This is a modified request. The proposal is located in Government Lot 7, Except the South 1100
feet. Section 29 of Edna Township; McDonald Lake (56- 386), RD.
Conditional Use Permit - Jade Nielson Properties. LLC:
Motion by Huebsch, second by Lindquist and carried, with Johnson abstaining, to convert White Haven
Resort into a Common Interest Community (CIC) plat of 16 residential dwelling units with a condition as
recommended by the Planning Commission. The proposal is located in Part of Government Lot 6 & Part of
Government Lot 1, Sections 9 & 16 of Dead Lake Township; Dead Lake (56-383), NE.
Conditional Use Permit - Ortand Ohe/Juhl Energy Development:
Motion by Froemming, second by Lindquist and unanimously carried to approve a Conditional Use Permit
for construction of a small solar wind hybrid project in cooperation with Lake Region Electric Cooperative as
presented. The proposal is located in the NW% SE% & SWA NE% and NE% SE% & SE% NE’A
Section 13 of Trondhjem Township; Non-Shoreland Area.
Final Plat - Bollinger Addition
Motion by Huebsch, second by Froemming and unanimously carried to approve the Final Plat known as
“Bollinger Addition” consisting of two single family, non-riparian lots located in Lot 1, Section 7,
Township 39W, Marion Lake (56-243), GD.

Joan Hutmatcher commented on the effect the current rains has had on the wetland.
Motion: A motion by Trites, second by Wilson to approve provided: 1. The proposed septic area is
fenced off to prevent disruption and/or compaction. 2. The building setback line be established 25'
landward from the delineated wetland. 3. Property owners must work with Land & Resource for lake
access across the wetlands. Voting: All Members in favor.
Battle View Homeowners Association - Approved As Presented:
A Conditional Use Permit Application (as stated by the Applicant on the Application): Proposing to
Amend Conditional Use Permit (CUP) #6812. On November 9, 2016 we were approved to rebuild
cabins (2, 3, 4, 5 & 6) with a 6/12 Pitch Roof. We would like to amend that language to read that the
“Roofs Will Not Exceed 20’ In Height”. The proposal is for Units 2 - 6 & Limited Common Elements &
Int in Common Elements
Battle View Common Interest Community (CIC) #81, Section 33 of Girard Township: West Battle Lake
(56-239), General Development (GD).
Steve Heidenson represented the Application.
Motion: A motion by Stone, second by Frazier to approve as presented. Voting: All Members in
favor.

moved. 20 yards of clean granular material packed upon pathway surface, pathways are
approximately 8’ wide and 600’ long. All disturbed areas appropriately stabilized with straw rolls and
natural grass seed. Leveled existing ice ridge. Requesting to maintain completed work as is. The
proposal is located in a 20.12 Ac., Pt of GL 3 & 4, 18.10 Ac in GL 3 & .9 Ac in GL 4 on N Shore, Section
16 of Hobart Township: Rose Lake (56-360), Recreational Development (RD).

this would not have been approved if requested prior to the work taking place.
Seclusion Point. LLC / Craig Peterson, et al - Approved As Modified:
A Conditional Use Permit Application (as stated by the Applicant on the Application): Add 15 Recreational
Camping Units (RCU) to the existing 21 Units for a total of 36 Units. The proposal is located in
Government Lot 7, Except the South 1100 feet. Section 29 of Edna Township: McDonald Lake (56-
386), Recreational Development (RD).
Craig Peterson and Josh Pfeffer (Meadowland Surveying) represented the Application. Mr. Pfeffer
indicated they would like to modify the request and eliminate the sites in tier 2 & maintain the 6 units
in tier 1 and include 6 boat slips allowed by the Shoreland Management Ordinance.
Mark Nygaard (Dead Lake Association) spoke in support of the proposed 6 sites. Dick Dubord
expressed concerns on the effects to the environment.
Motion: A motion by Trites, second by Boyer to approve the modified request for 6 additional units.
Voting: All Members in favor.
Break: At 7:23 p.m. the Commission took a 7-minute break.
