Genseal Trust - Approved as modified with conditions. (6:54 p.m.)
After consideration and discussion, Michael Conlon made a motion, second by Robert Schwartz to approve a variance of 80’ from
the required ordinary high water level setback of 100’ and a variance of 30’ from the required shore impact zone setback of 50’ for
the enclosure on an existing 10’ by 18’ deck located 20’ from the ordinary high water level with the condition that no more than
25% of the total lot area can be covered with impervious surfaces. This motion failed with Cecil Femling, Randall Mann and Steve
Schierer voting no. After additional discussion and consideration, motion was made by Steve Schierer, second by Randall Mann
and unanimously carried, to approve a 10’ by 12’ enclosure starting at the northwest corner of the house (extending 10’ towards
the septic tank and 12’ towards the lake) with the condition that no more than 25% of the total lot area can be covered with
impervious surfaces and with the condition a 10’ separation from the septic tank must be maintained, therefore, if there is less

After additional consideration, Randall Mann made a motion, second by Steve Schierer and carried with
Michael Conlon voting no, to deny the variance as requested for the deck as no adequate hardship unique
to the property had been shown that would allow for the granting of the variance as requested and the
applicants can obtain a reasonable use of their property without the granting of a variance for the deck.
Genseal Trust - Approved as modified with conditions. (6:54 p.m.)
Genseal Trust, part of Government Lot 6, Section 10 of Hobart Township by Wymer Lake, requested a
variance of 80' from the required ordinary high water level setback of 100' and a variance of 30' from the
required shore impact zone setback of 50' for the enclosure of an existing 10’ by 18’ deck located 20' from
the ordinary high water level. Randall Mann, Chair, polled the audience with no one speaking for or
against the variance as requested. After consideration and discussion, Michael Conlon made a motion,
second by Robert Schwartz to approve a variance of 80’ from the required ordinary high water level

enclosure extending 10’ towards the septic tank will be less than 20’ from the road right-of-way and will be
at least 15’ from the road right-of-way. Hardship is a lot with substandard depth. The Board noted that the
variance as approved does provide the applicant with a reasonable use of the property.
Daniel and Janet Hohenstein - Approved the variance as requested with conditions. (7:11 p.m.)
Daniel and Janet Hohenstein, part of Government Lot 2, Section 34 of Star Lake Township by Dead Lake,
requested the following; replace existing mobile home with new dwelling with attached garage being
approximately 100’ from the ordinary high water level and to have the parcel declared a buildable lot for
residential purposes. Randall Mann, Chair, polled the audience with no one speaking for or against the
variance as requested. After consideration and discussion, Michael Conlon made a motion, second by
Robert Schwartz and unanimously carried, to approve the placement of a dwelling at least 100’ from the
ordinary high water level and to declared Parcel 56-000-34-0253-011 a buildable lot with the following
conditions: 1.) the existing fish house must be either removed or placed in a location that complies with the
setback requirements before a site permit for the proposed new structure can be issued, 2.) the existing
mobile home must be removed within 90 days after the site permit is issued, and 3) all other outbuilding
must be removed before a site permit can be issued for the proposed new structure.
Ronald G. Weibye - Approved the ordinary high water level variance. Side lot line variance denied.
' SC#;:; EDRonald G. Weibye, Lot 9 South Point, West Battle Lake in Girard Township, requested a variance of 15’
from the required ordinary high water level setback of 75’ and a variance of 4’ from the required side lot line
setback of 10’ for the construction of an 18’ by 23’ 6” attached garage 6’ from the side lot line and 60’ from
the ordinary high water level. Randall Mann, Chair, polled the audience with no one speaking for or
against the variance as requested. A letter from Jack Lindner in support of the variance as requested was
read for the record. After consideration and discussion, Paul Larson made a motion, second by Cecil
Femling and carried with Robert Schwartz voting no, to deny the variance as requested. After additional
discussion and consideration, Steve Schierer made a motion, second by Randall Mann and unanimously
carried to approve a variance of 15’ from the required ordinary high water level setback of 75’ for the
placement of an attached garage 60’ from the ordinary high water level and at 10’ from the side lot line.

MOTION AS FOLLOWS:
Motion was made by Craig Anderson, seconded by John Everts and carried with John Everts voting no, to
approve a variance of approximately 80 to 85' from the required ordinary high water level setback of 100'
and a variance of approximately 30 to 35' from the required shore impact zone setback of 50' for the
construction of a 15' by 25' addition no closer to the road right-of-way than the existing structure with the
condition that the applicant will show proof that the public safety concerns have been discussed with the Hobart
Town Board.

After consideration, motion was made by Craig Anderson, seconded by John Everts and carried with John
Everts voting no, to approve a variance of approximately 80 to 85' from the required ordinary high water
level setback of 100' and a variance of approximately 30 to 35' from the required shore impact zone setback of
50' for the construction of a 15’ by 25' addition no closer to the road right-of-way than the existing
structure with the condition that the applicant will show proof that the public safety concerns have been
discussed with the Hobart Town Board.
Gerald Larson - Approved
Gerald Larson, Fargo, ND, requested a variance of approximately 55' from the required ordinary high water
level setback of 100' and a variance of approximately 5' from the required shore impact zone setback of 50’
for the construction of a 24' by 36' cabin, which will be attached to an existing structure by an 8’ breeze-
way, 45' from the ordinary high water level. The property is described as Lot 6, Peach’s Silent Lake Beach,
East Silent Lake in Dora Township. The audience was polled with Chris Christenson speaking in favor of the
granting of the variance request. After consideration, motion was made by Craig Anderson. seconded by
Randall Mann to approve the variance as requested. It was noted that the applicant's structure will be setback
farther from the lake than it would have been had the applicant proceeded with his 1984 plans. Hardship being
a substandard lot of record. The motion failed with Cecil Fern ling, Carl Johnson. John Everts and George
Walter voting no. After additional consideration, motion was made by John Everts, seconded by Randall Mann
and unanimously carried, to approve the attachment of a 24' by 36’ addition to the front of the existing 20' by
20' structure. The new structure can extend 24' toward the lake from the front of the existing structure.

high water level setback of 150' for the construction of a dwelling approximately 60' from the ordinary high

The applicant was represented at the hearing by Martin L. Eitreim. The audience was polled with no one
speaking for or against the request. After consideration, motion was made by Craig Anderson, seconded by Carl
Johnson and unanimously carried, to approve a variance of 90' from the required ordinary high water level
setback of 150' and a variance of 15’ from the required shore impact zone setback of 75' for the construction
of a dwelling approximately 60’ from the ordinary high water level. Hardship being a substandard lot of
record. The applicant has adequate back lot area to handle a septic system.

the request. After consideration, motion was made by Cecil Femling, seconded by Randall Mann and carried
with Carl Johnson abstaining, to approve a variance that would allow a boat house to remain 3.5' from the side

Robert N, Ronken, Moorhead, MN, requested a variance of approximately 6 to 7' from the required side lot line
setback of 1 O', a variance of 8’ from the required non-dwelling setback from a drain field of 10' and a variance
of approximately 4 to 5' from the required septic tank setback of 10' for the placement of an 8' by 12' storage
shed approximately 3 to 4' from the side lot line, 2' from the drain field and approximately 5 to 6' from the
septic tank. The property is described as the North 1 /2 of Lot 2, Linden Park, East Battle Lake in Girard
Township. The audience was polled with no one speaking for or against the request. After consideration, motion
was made by John Everts, seconded by Creig Anderson and unanimously carried, to approve a variance of
approximately 6 to ?' from the required side lot line setback of 1 O', a variance of 8' from the required non
dwelling setback from a drain field of 1 0’ and a variance of approximately 4 to 5' from the required septic
tank setback of 1 O' for the placement of an o' by 12’ storage shed approximately 3 to 4’ from the side lot line,
2' from the drain field and approximately 5 to 6' from the septic tank. Hardship being a substandard lot of
record. It should be noted that the applicant should have adequate space to maintain the septic system and that
the proposed structure is not a dwelling. The applicant must place the shed at least 20' from the road right-
of-way.

Russ D. Heimbuch, West Fargo, ND, requested a variance to exceed what the string line would permit by
approximately 7‘. The applicant is considering replacing an existing cottage with a year round home. The new
structure would be setback farther from tr,e ordinary high water level than the existing structure and would
provide the neighboring properties with less view obstruction than the applicant's current structure. The
property is described as the West 50' on the shore and the West 100' in the rear of Lot 1 and 16 1 /2' adjacent
on the West, Linden Park Beach, Pelican Lake in Dunn Township. Steve Rufer, Attorney, appearedwith the
applicant at the hearing. The audience was polled with no one speaking for or against the request. After
consideration, motion was made by Craig Anderson, seconded by Cecil Femling and unanimously carried, to
approve a variance that would allow the applicant to exceed what the string line would permit by
approximately 7'. It should be noted that the new home will be setback approximately 1 O' farther from the
ordinary high water level than the presem. structure. The applicant's new home will be in line with the
structure to the right. Hardship being the original survey of these lots and the skewed placement of the
dwelling on the adjacent neighbor's property. The lot will be substantially improved by the granting of this
variance.
