Motion was made by Cecil Femling to approve a 40’ variance or a 60’ ordinary high water level setback with the condition that the Land and Resource Department review the property for the existence of a bluff. This motion was withdrawn. After additional discussion and consideration, motion was made by John Everts, second by Cecil Femling, to approve the placement of the proposed development no closer than 10’ back from the second tier break, which is assumed to be approximately 90’ from the ordinary high water level. Hardship is the terrain and topography of the applicant’s property, which makes development and a reasonable use of the property difficult without a variance. This motion failed with Bert Olson, David Holmgren and Randall Mann voting no. After additional discussion and consideration, motion was made by Cecil Femling, second by John Everts and unanimously carried, to approve residential elopment of this property with the condition that the applicant or the applicant’s representative must meet on-site w^representatives of both the Land and Resource Department and the Department of Natural Resources to det^mine the best type of development and the best location for the placement of this residential development so that the applicant will have a reaso noted. \ \ ^ use of her property. On October 14, 1999, the Otter Tail County Board of Adjustment approved a building site that was to be determined by the Land and Resource Department and the Department of Natural Resources. This task has been completed and upon a suggestion from the County Attorney’s office the Otter Tail County Board of Adjustment will approve a variance, with conditions, for the recommended site as follows: Upon presentation of the recommended building site and upon additional discussion, motion was made by Mark Steuart, second by John Everts and carried with Linda Bergerud abstaining, to approve a variance of 10’ and a variance 20’ from the top of the bluff for the location of a deck 10’ from the bluff and for the location of a dwelling 20’ from the bluff with the following conditions: 1. the proposed development must be at least 12’ from the slope to provide the necessary buffer as identified by the Land and Resources Department and the Department of Natural Resources, 2. the existing cabin must be removed before a site permit for the new development can be issued, 3. there can be no excavation to the east in the area as identified by the Land and Resources Department and the Department of Natural Resources, and 4. all other measures for stabilization, for example retaining walls, must be implement as recommended by the Land and Resource Department and the Department of Natural Resources. It was noted that this variance will place the proposed development approximately 100’ from the ordinary high water level and that the proposed project is a substantial improvement over the present situation. Hardship is the terrain and topography of the applicant’s property.
