Kalar of Land & Resource Management. The original request was for a 100' set back from Dead Lake, which requires a 200' set back, with a variance of 70' tioned approval. Motion was made by Dan Oehler, seconded by Craig Anderson and unanimously carried, to authorize the recording of a new permit with the correction to show the decision as made by the board at 130' from the water, not 100' as requested. The matter of the approval for Edward Holger on October 5, 1989, re­ quired a clarification. Motion was made by Cecil Femling, seconded by Carl Johnson and unanimously carried, to approve a 20' x 22' structure, no closer to lake than the original request, on Lots 13 & 14, Block 2, Yakina Bay, Dead Lake Township, amending the motion of October 5th. After consideration, motion was made by Cecil Femling to allow the fence to remain. The motion was seconded by Carl Johnson but failed with Oehler, Everts, Anderson and Walter voting "no". Motion was then made by George Walter to deny, no hardship shown, allowing until June 1, 1990 to remove or alter. The motion was seconded by Dan Oehler and carried with Femling and Johnson voting "no". Quentin Walseth, Frazee, MN, requested permission to sell a strip of land 16' (lakeside) x 165' x 20' (roadside) out of Sublot A, G.L. 9, Section 3, Hobart Township in Wimer Lake. After considera­ tion, motion was made by Carl Johnson, to approve, to allow would increase the size of the neighbor's substandard lot, enhancing both properties. The motion was seconded by Cecil Femling and car­ ried, with John Everts moving "no". Charles Malmstrom, Battle Lake, MN, requested permission to increase resort from 11 units and 1 dwelling to 13 units and one dwelling, on an 8.95 acre 309.7' lake frontage in Section 1, Everts Township on Blanche Lake. Appearing and speaking to the issue were Patrick Green and Emil Madsen. After consideration, motion was made by Cecil Femling to grant, hardship being, since the acreage space allows for 14 units, with the new cabins not encroaching onto the lake, with the cabins being constructed as handicapped accessible. The motion was seconded by Craig Anderson and carried, with John Everts abstaining. James C. Huebsch, Perham, MN, requested permission to convey a parcel of land 110' x 200' out of a 2.01 acre parcel in the N>sSE>s of Section 22, Perham Township, without platting. After consideration, motion was made by Craig Anderson, seconded by JOhn Everts and unanimously carried, to approve, does not have potential for further platting, meets all requirements for building, access to public road, survey stakes, etc., subject to submitting a surveyor's drawing. So as not to have so many driveways, close together, entering the Township road, Gary Ware had a lease arrangement giving him the right to cross the corner of the Walseth-Mcintire property. (Shown on drawing) Later, when he had to dig up his drain field, he had a new one much larger than projected needs for his place PLUS and additional field. A deal was made whereby Walseth-Mcintire paid Gary Ware the cost of the small, extra, drainfield, for the right to use it - in exchange for Ware's right to cross the corner of the Walseth-Mcintire lot. Ware had boats and acquired an RV and requested permission to park them, over winter, in the area between the Walseth-Mcintire boathouse and his dwelling. Since the strip is located so Walseth-Mcintire were not using it and since Ware had use for it, a deal was made to sell a strip sixteen (16) feet on the lakeshore and twenty (20) at the back, which put the dividing line at the point where the two driveways joined.
