OTTER TAIL COUNTY BOARD OF ADJUSTMENT
Thursday, October 5, 2006
The Otter Tail County Board of Adjustment met Thursday, October 5, 2006, with the following persons in
attendance:

Called to Order - Randall Mann, Chair called the meeting of the Board of Adjustment to order at 6:30 p.m.
Minutes Approved -
The Board of Adjustment approved the minutes of the September 14, 2006 meeting as mailed.
The Board of Adjustment considered the following applications for variance:
Diane M. McLeod and Paul Jeffers - Approved the variance as requested. (6:32 p.m.)
Diane M. McLeod and Paul Jeffers, Sub Lot 1 and part of Sub Lot 2 of Government Lot 3, Section 27 of Rush Lake Township
by Round Lake, requested a variance of 10’ from the required ordinary high water level setback of 75' for the purpose of
enclosing an existing carport located 65’ from the ordinary high water level. Terry Lee, Contractor, represented the applicant’s
at the public hearing. The audience was polled with no one speaking for or against the variance as requested. After
discussion and consideration, Paul Larson made a motion, second by Michael Harris and unanimously carried, to approve a
variance of 10’ from the required ordinary high water level setback of 75’ for the purpose of enclosing an existing carport
located 65’ from the ordinary high water level. The Board noted that the proposed enclosure is on the side of the existing
structure and will be no closer to the ordinary high water level than the existing structure.
Daniel and Dolores Hodgson - Approved the variance as requested with conditions. (6:39 p.m.)
Daniel and Dolores Hodgson, part of Government Lot 11, Section 3 of Hobart Township by Wymer Lake, requested the
following: Instead of using the closest corner of neighbors house (String Line A), we would like to request using the corner
closest to the lake (String Line B). Approximately 75’ to ordinary high water mark required setback is 100’ from ordinary high
water mark. Michael Lovelace, Contractor, appeared with the applicants at the public hearing. The audience was polled with
Jeffrey Johannsen speaking for the variance as requested. A letter from Summer and Jeffrey Johannsen and from Evie and
Phillip Thomas in support of the variance as requested was read for the record. After discussion and consideration, Steve
Schierer made a motion, second by Randall Mann and unanimously carried, to approve development no closer to the ordinary
high water level than what would be allowed by String Line B, as depicted on the drawing dated September 5, 2006, with the
following conditions: 1.) no more than 25% of the total lot area can be covered with impervious surfaces, and 2.) the existing
storage structure located near the water must be either removed or placed in a location which complies with the setback
requirements of the Shoreland Management ordinance on or before June 1, 2007.
Gary A. and Linda Layman - Denied. (6:53 p.m.)
Gary A. and Linda Layman, Lot 2 Sunny Beach Resort, Little Pine Lake in Gorman Township, requested a variance of 39’
from the required ordinary high water level setback of 75’ for the placement of a 12’ by 22’ deck 36’ from the ordinary high
water level. Marv Monson, Contractor, represented the applicant at the public hearing and presented a letter from the
applicant. The audience was polled with no one speaking for or against the variance as requested. After discussion and
consideration, Steve Schierer made a motion, second by Cecil Femling and unanimously carried, to deny the variance as
requested as no adequate hardship unique to the property had been shown that would allow for the granting of the variance
as requested and noting that the applicants can obtain a reasonable use of their property under Part III Sub Part 4 Paragraph
H of the Otter Tail County Shoreland Management Ordinance.
