Harlow Case - Denied. (8:34 p.m.)
After discussion and consideration, Randall Mann made a motion, seconded by Cecil Femling and unanimously
carried, to deny the variance as requested as no adequate hardship unique to the property had been shown that
would allow for the granting of the variance as requested and there is adequate room to meet the setback
requirements from the bluff and the ordinary high water level. The Board noted that they are approving any variance
or variance(s) that the Land and Resources Department or the Planning Commission might require before they can
grant to the applicant the necessary approvals/permits for the removal of the existing structure and/or the filling of the
affect area once the structure as been removed.

Harlow Case - Denied. (8:34 p.m.)
Harlow Case, Sub Lot 1 of Government Lot 2, Section 3 of Hobart Township by Grahm Lake, requested a
variance of 26’ from the required ordinary high water level setback of 100’ and a variance of 30' from the
required top of bluff setback of 30' for structural changes to an existing roof and for a 12' by 24’ addition 74’
from the ordinary high water level and 0’ from the top of the bluff. Randall Mann, Chair, polled the
audience with no one speaking for or against the variance as requested. A letter from Fred Harker in
opposition to the variance as requested was read for the record. After discussion and consideration,
Randall Mann made a motion, seconded by Cecil Femling and unanimously carried, to deny the variance
as requested as no adequate hardship unique to the property had been shown that would allow for the
granting of the variance as requested and there is adequate room to meet the setback requirements from
the bluff and the ordinary high water level. The Board noted that they are approving any variance or
variance(s) that the Land and Resources Department or the Planning Commission might require before
they can grant to the applicant the necessary approvals/permits for the removal of the existing structure
and/or the filling of the affect area once the structure as been removed.
Wes and Theresa Veltema - Approve as requested with a condition. (8:47 p.m.)
Wes and Theresa Veltema, Lots 3 and 4, Snodgrass Basswood Grove and part of Government Lot 1,
Section 26 of Rush Lake Township by Rush Lake, requested a variance of 55’ from the required ordinary
high water level setback of 75’ and variances of 35’ and 44’ from the required side lot line setback of 50’ for
the following proposed development:
2004 - raise cabin 10 - put new foundation,
2005 - raise cabin 14 - put new foundation, add upstairs on house and add a garage,
2006 - raise cabins 4 and 5 - put new foundation,
2007 - raise cabins 4.5 and 1 - put new foundation,
2008 - tear down house on lot 3 and put up pole building and raise cabins 6 and 7 and put new foundation.
Note - Existing cabins, at closest point, are approximately 20’ from the ordinary high water level and 6’
from the side lot line. The proposed pole building will be 15’ from the side lot line.
Randall Mann, Chair, did not poll the audience, as there was no one in attendance at the time of this
hearing. After discussion and consideration, Paul Larson made a motion, seconded by Cecil Femling and
unanimously carried, to approve the proposed development as described in the variance application dated
August 9, 2004 and as depicted on the drawing submitted with the application with the condition that
whenever a new foundation is part of the proposed development the cabin must be placed at least 25’ from
the ordinary high water level.
With no further business, Randall Mann, Chairman declared the meeting adjourned at 9:00 p.m.
