PAUL AND JEANNE BEARE - DENIED
Paul and Jeanne Beare, Moorhead, MN, requested a variance to construct a 36' by 28' house on
Winer Lake with the front of the house 97' from the lake and the front of the deck 89' from the
lake. The 12' on the north end of the deck will be a screened porch with a roof. The property is
described as part of Lot 1 Block 2. Karinall and part of Government Lot 8, Section 3 of Hobart
Township. The audience was polled with no one speaking for or against this request. A letter
from Ken and Marlys Jacobson in favor of granting the variance request was read for the record.
After consideration, motion was made by Dan Oehler, seconded by John Everts and carried with
Victor Petterson voting nay to deny this variance request as no adequate hardship had been
shown.

ALBERT SKAR - PARTIAL REFUND OF APPLICATION FEE.&

The variance request of Albert Skar was tabled from the September 5th ,1991 meeting due to
the incompleteness of his variance application. Since it has been determined that a new variance
request is needed before any action can be taken a motion was made by Dan Oehler, seconded by
Victor Petterson and unanimously carried to refund to Albert Skar the $ 10.00 recording fee
that he paid as a part of his variance application fee. The new variance request will be heard at
the October 3rd, 1991 meeting,

mostly unsightly brush growth.

This request is for a variance to build a 36 x 28 house on

The purpose of the variance request is to save a number of
large trees which would have to be removed if the front of
the screened porch were at 100 ft. setback. Of primary
concern is a six foot circumference oak which is seven feet
directly behind the proposed house and will overhang the
entire structure if allowed to remain. This oak is the
largest and nicest tree on the lot. If the house were moved
back, the garage, which will be built in the future but not
this year, could not be in the natural opening, as indicated
on attached sketch. The garage would have to be moved back
the same eleven feet as the house eliminating a number of
significant oak trees and requiring a good deal of fill to
level the site. If the variance were granted, the garage
would fit conveniently in the existing clearing and would
require no fill.
As shown on the sketch, the driveway will curve through the
lot and terminate behind the house, in front of the future
garage.

All efforts have been made to preserve trees on this
building site. Only dead trees, brush, and very small
softwoods have been removed to date, except for one large
cottonwood which would be removed whether or not the
variance were granted. At some point in the lots recent
history someone almost clear cut the south 70 feet, leaving
small trees, all the same size which have grown only since
the cutting. It would be highly desirable to save as many
large trees as possible, particularly the giant oak directly
behind the building site. Moving the building site north or
south to save this large oak would only result in the
removal of other large, valuable trees.
