MN • 1-800-346-4S70BK — 0501 A MINUTES OF THE MEETING OF THE OTTER TAIL COUNTY BOARD OF ADJUSTMENT Thursday, July 13, 2006 The Otter Tail County Board of Adjustment met Thursday, July 13, 2006, with the following persons in attendance: Cecil Femling Paul Larson Steve Schierer Rod Boyer Michael Harris Randall Mann Pat Eckert, Land and Resource Management Cherie Clark, Assistant County Attorney Called to Order - Randall Mann, Chair called the meeting of the Board of Adjustment to order at 6:30 p.m. Minutes Approved - The Board of Adjustment approved the minutes of the July 6, 2006 Board of Adjustment meeting as mailed. The Board of Adjustment considered the following applications for variance: ^eith and Joan Kor - Approved the variance application as modified with conditions. (6:32 p.m.) Keith and Joan Kor, part of Government Lot 5, Section 3 of Hobart Township by Graham Lake, requested a variance of 30’ from the required bluff setback of 30’ for the placement of a 16’ by 16’ addition (Addition No. 1) 0’ from the top of the bluff or a variance of 16’ from the required bluff setback of 30’ for the placement of a 16’ by 16’ addition (Addition No. 1)14’ from the top of the bluff and a variance of 16’ from the required bluff setback of 30’ for the placement of a 16’ by 16’ addition (Addition No. 2) 14’ from the top of the bluff. The audience was polled with no one speaking for or against the variance as requested. After discussion and consideration, Randall Mann made a motion, second by Steve Schierer and unanimously carried, to approve the placement of an addition to the rear (roadside) of the existing 24’ by 16’ structure with the following conditions: 1.) the roof tying the new structure to the old structure can be no closer to the bluff than the peak of the existing 16’ by 24’ structure and 2.) there can not be a second story on the old structure. The variance as approved does provide the applicants with a reasonable use of their property. The Board noted that the variance as approved does not directly or indirectly grant any other variances for this development. Truax Trust - Denied. (6:43 p.m.) Truax Trust, Lot 13 Block 1 Round Lake Retreat, Round Lake in Rush Lake Township, requested a variance of 8’ from the required ordinary high water level setback of 75’ for the enclosure of an existing 8’ by 30’ deck 67’ from the ordinary high water level. The audience was polled with no one speaking for or against the variance as requested. After discussion and consideration, Steve Schierer made a motion, second by Rod Boyer and unanimously carried, to deny the variance as requested as no adequate hardship unique to the property had been shown that would allow for the granting of the variance as requested, the applicant could place an enclosed porch on the side of the existing structure and the applicant can obtain a reasonable use of the property without the granting of the variance as requested. After additional consideration and discussion, Steve Schierer made a motion, second by Rod Boyer and unanimously carried, to direct that the applicant must remove the enclosure panels from the deck on or before September 1,2006.
