John and Mitzi Hinz own a parcel of land on East Battle Lake; 61.55 acres with 1,000 feet of shoreline on the east end of lake. We access our property by the platted road in Chippewa Island adjacent to the lake shore. There is only one area suitable for building or subdividing. This is the only suitable area for home sites with lakeshore access and view. We do not want or plan to subdivide and the topography makes it awkward and difficult to do so.Chippewa Island. from the garage. The grade is too steep for an attached garage. It was necessary to build a two-story garage because the topography (30 degree grade above the access road) would not allow or would be very difficult to drive up during the winter months to the house. The garage is tucked into the hill. The way we have planned it, a person could park in the garage and walk up the stairs inside the garage to the upper level which comes out more level to the top of the hill. It is very difficult to walk up the hill in the winter. Mr. Hinz has had both hips replaced and a disk repaired in his lower back, which makes steep climbs and snow shoveling prohibitive to a large degree. The garage placement also avoided removal of any trees and should prevent further erosion of the hill. The present garage cannot be seen from the lake as it is hidden by the steep grade and is about 300 feet from the lake shore. We really planned for and consider it an extension of the house, approved sewer disposal system (holding tank). This system will not be used for the house. Our home would be more than 100 feet from the lake shore, 400 feet from the only neighbor (on the West) , the East is our land for 600 feet more, and an adjoining cow pasture after that. There is about 30 acres of wildlife area to the South that is our property. We wish to preserve as much of the natural beauty as possible providing for deer, wildlife, loons, ducks and geese that reside there, environmentally friendly not to widen and put in a public road and split the lot into two or more lots just to accommodate both our garage and a house. By allowing two structures on one lot of 61.5 acres, the shoreline impact would be minimized. We propose this would be the only development and would enhance public interest, would not damage property values as the second structure is well back from the lake and several adjacent properties have similar structures. After discussion and consideration, motion was made by John Everts, seconded by Robert Schwartz and unanimously carried, to deny the variance as requested as no adequate hardship had been shown. The applicant was directed to work with the Land and Resource Administrator and/or the County Highway Engineer to determine a reasonable time for the removal of the non-complying structure. James Sherer - Approved James Sherer, Pelican Rapids, MN, requested a variance to subdivide a 200’ by 231.5’ parcel (approximately 1.06 acres) from and existing 5.3 acre parcel. The property is described as Tract 1, Crystal Hills 5*^ Addition (Auditor’s Subdivision #108), Lake Crystal in Lida Township. The audience was polled with no one speaking for or against the request. After discussion and consideration, motion was made by Cecil Femling, seconded by Randall Mann and unanimously carried, to approve the subdivision of a 200’ by 231.5’ parcel from an existing 5.3 acre parcel with the condition that a registered surveyor’s drawing meeting the requirements of the Subdivision Controls Ordinance must be presented at the time of conveyance. Dale William Nelson - Approved Dale William Nelson, St. Cloud, MN, requested a variance of 32’ from the required ordinary high water level setback of 100’ for the addition of a bedroom, the addition of a bath and for the extension of the kitchen area of an existing cabin located 68’ from the ordinary high water level. It should be noted that none of the proposed additions would be any closer to the ordinary high water level than the existing dwelling. The property is described as Lot 37, Bergsten North Shore Park, Crane Lake in Clitherall Township. The audience was polled with no one speaking for or against the request.
