Diane Kutzer - Approved the application as requested with a condition. (8:23 p.m.)
Diane Kutzer LLC, Lot 6 Sandy Shore Development, Otter Tail Lake in Everts Township, requested a variance to have
Lot 6 Sandy Shore Development declared buildable for residential and nonresidential use. The plan is to construct a
32’ by 48’ by 10’ storage shed. The audience was polled with no one speaking for or against the variance as
requested. A letter from Ray DeBoever in support of the variance as requested was read for the record. After
consideration and discussion, Steve Schierer made a motion, second by Rick Wilson and unanimously carried, to
declare Lot 6 Sandy Shore Development buildable for either residential or nonresidential use with the condition that
no more than 25% of the total eligible lot area can be covered with impervious surfaces. It was noted that the
variance as approved does not directly or Indirectly grant any other variances for any proposed or future development.
Andrew & Leanne Magnotto - Approved the application as requested with a condition. (8:26 p.m.)
Andrew and Leanne Magnotto, Lots 51 and 52 Block 1 of Crystal Beach, West McDonald Lake in Dora Township,
requested the following: Requesting to replace the roof on the existing 20’ by 28’ structure. The proposed
replacement will be in the same footprint. The existing pitch of the roof is 6:12 and will be replaced by a 12:12 pitch
roof. Requesting to replace existing 16' by 10’ deck, which is currently 36’ from the ordinary high water level and
other impervious surfaces on property with a new 14’ by 16’ covered deck approximately 48’ from the ordinary high
water level. Replacement would decrease the impervious surface from 13.7% to 12.8%. The proposed replacement
project will be approximately 48’ back from the ordinary high water level on West McDonald Lake and 35’ back from
ordinary high water level on Brown Lake. Requesting a 52’ setback variance from the ordinary high water level on
West McDonald and 165’ setback variance from ordinary high water level on Brown Lake. The current structure is
approximately 8’ from the alley. Proposed project will not change location. Current shed is approximately 3’ from the
alley, 23’ from Brown Lake and 75’ from West McDonald Lake. Proposing to replace roof on existing structure.
Requesting setback variance of 177’ from Brown Lake and 25’ variance from West McDonald. Location of shed will
not be changed. Shed is 10’ from holding tank. The audience was polled with no one speaking for or against the
variance as requested. After consideration and discussion, Randall Mann made a motion, second by Steve Schierer
and unanimously carried, to approve the variance as requested and as depicted on the drawing submitted with the
application with the condition that no portion of the proposed development can be within 50’ of West McDonald Lake.
It was also noted that the variances as approved do not directly or indirectly grant any other variances than those
outlined in the request. Hardship/practical difficulty is substandard lots of record and lakes on two sides of the
property.
l^^ugene R and Shirley A Seaver - Approved the application as requested. (8:37 p.m.)
Eugene R and Shirley A. Seaver, part of the Southeast Quarter of the Southeast Quarter, Section 17 of Henning
Township, requested the following: Currently we have two parcels. One contains 3.67 acres and the other one
contains 2.39 acres. We would like to take a portion of the 2.39 acre parcel (which measures 100’ by 400’ and attach
it to the 3.67 acre parcel, creating a parcel that would be 4.62 acres and creating a parcel that is substandard at 1.46
acres. We would like both lots to remain as buildable lots for residential use. The audience was not polled as there
was no one in attendance at the time of this public hearing. After consideration and discussion, Steve Schierer made
a motion, second by Thomas Lee and unanimously carried, to approve the variance as requested in the application
dated March 17, 2011 and as depicted on the drawing submitted with the application. The variance as approved will
provide the applicants with the ability to enjoy the same rights and privileges as others in this immediate area, both
existing parcels contain dwellings and the smaller parcel of the two proposed parcels does meet the minimum size
requirements for platted lots in a non shoreland area.
With no further business, Randall Mann, Chairman declared the meeting adjourned at 8:42 p.m.
Prepared by:
Wayne^Stein, Secretary
The minutes were mailed on Friday, April 15, 2011 to the Otter Tail County Board of Adjustment. Official action
regarding these minutes will be taken by the Board of Adjustment at their next regularly schedule meeting.
