Motion: A motion by Lachowitzer, second by Sha to deny the request due to lack of
representation.
Voting: All members in favor (except Bergerud who had not yet returned from the break).
Timothy G. & Amv S. Lindoren - Tabled To August 8. 2001:
A Conditional Use Permit Application to install retaining wall on lake front 60’ w x 10’ h.
Fill behind retaining wall T with aggregate for drainage. Back fill to wall on southeast
corner of lot - approximately 25 cubic yds of fill required. Retaining wall will be installed
by contractor. The property is described as Lot 14 Abie’s Acres, Section 35 of Dora
Township; Star Lake (56-385), GD.
Tim Lindgren represented the Application.
Motion: A motion by Lachowitzer, second by Maske to table the Application to August 8,
2001 (at the Applicant’s request), to allow an engineer or a soil scientist to design a plan.
The plan is to be fon/varded to Land & Resource Management so it can be mailed to the
Planning Commission Members prior to the meeting for their review.
Voting: All members in favor.
Steven J. Brue - Approved With A Condition:
A Conditional Use Permit Application to excavate and fill 450’ of driveway, beginning at
Lot 4 entry from existing gravel road, parallel to road across Lot 4 and curving into Lot 5
toward West Red River Lake and ending approximately 300’ from OHWL of Lot 5.
Driveway will be 16’ wide and graded with Class 5 gravel. Will also install an 18” culvert
for natural drainage, as well as a one-foot ditch along the north and east side of the
driveway. The requested fill provides a natural use of the slope of the lots for a
residential driveway into the property and exceeds 300 cubic yards. The property is
described as Lots 4 & 5 BIk 1 Bridgeview, Section 27 of Friberg Township; West Red
River Lake (56-711), NE

A Conditional Use Permit Application to increase the limit of camping spots on resort by

Conditional Use Permit - Jeffrey J. & Beth Voels:
Motion by Lee, second by Nelson, to deny a Conditional Use Permit to replace and repair a
retaining wall to prevent shoreline erosion as recommended by the Planning Commission. Chair
Froemming recognized Mr. Voels for discussion purposes. Mr. Voels requested that this CUP be
referred back to the Planning Commission because he had made a mistake on the date of the last
meeting; therefore, missed the Planning Commission meeting when this was being considered.
Motion by Lee, second by Nelson, to amend the previous motion to refer this CUP request back to
the Planning Commission with the agreement by the applicant to waive the 60-day rule and
understanding that this request will not be considered until August. Motion carried.
Conditional Use Permit - Steven J. Brue:
Motion by Lee, second by Mosher, and unanimously carried to approve a Conditional Use Permit
to excavate and fill 450’ of driveway with conditions as recommended by the Planning
Commission. The property is described as Lots 4 & 5 BIk 1, Bridgeview, Section 27 of Friberg
Township; West Red River Lake (56-711).
Conditional Use Permit - Kurtz’s Family Campground:
Property owner, Paul Tongen, discussed two concerns regarding this Conditional Use Permit
request; 1) safety concern where the boat ramp goes into Marion Lake which is very close to
Kurtz’s property, and 2) encouraged the Board to choose noft to allow the permit to be transferable.
County Attorney, David Hauser, stated that from his research, the permit runs with the land and to
not allow the permit to transfer ownership may not be a condition that would be allowable.
Discussion took place regarding the fact that the number of units exceeds the frontage and area
requirements of the Shoreland Management Ordinance; therefore, a variance may be required.
The County Attorney will check further on these issues. Motion by Nelson, second by Mosher, to
approve a Conditional Use Permit to increase the limit of camping spots on the resort by 11 with
conditions No. 1 & 2 as stated by the Planning Commission, and to change condition No. 3 for the
campground to be reviewed in 12 months (June, 2002) rather than 24 months. The property is
described as Pt of GL 1 (8.12 Ac) & Merryland Park Lots 13, 14, and 15, Section 7 of Rush Lake
Township; Marion Lake (56-243). Chair Froemming called for a roll call vote:

Permit to tear down three cabins and build one new residence as presented. The property is
described as Sublot 2 of GL 4, Section 23 of Rush Lake Township; Rush Lake (56-141).
