1. EROSION CONTROL PLAN : All excavation, hauling of fill, and earth moving
will be completed in conjimction with the construction of the new house. We are
planning to begin construction in mid April and expect to have all of the proposed work
completed by September 1, 2005.
Silt fences will be installed before any work begins. Silt fences will be on the East
property line to prevent runoff to the neighboring property as well as on the lakeside of
the house extending to the East property line (See attached drawing). Straw bales will be
placed so as to slow any runoff in the most vulnerable areas. After final grading, all
exposed areas will be seeded with a mixture of quality grass seed and a fast germinating
annual grass/grain and mulched with straw. Sod will be used in the most vulnerable areas
to establish a barrier for possible runoff.
2. No work will be done on the lake ward side of the ridge.
3. All areas west of the driveway fill will drain to the west of the home toward the Lake.

Driveway A is approx. 2,244’ in length & will consist of approx. 1,010 cubic yards of earth

Scott Sealy represented the Application.
Ann Scheidecker expressed concerns (the proposed driveway, near the lake) regarding
traffic, safety, drainage & indicated that there was surveying done on their property. She
stated that they are “very very” concerned with this request. Duane Mavis (Friberg
Townboard) indicated that the Township does not approve of 3 approaches, a 16’ top & the
location of the utility easement: he had questions regarding the location of the approach on
CSAH 3: & he expressed concerns with the use of an easement. Gordv Flannemen
(Friberg Townboard) had questions regarding the location of the proposed road.
Motion: A motion by Trites, second by Maske to table (at the Applicant’s request), to
January 12, 2005 (maps must be received by Land & Resource Management by
December 22, 2004), to allow the Applicant to address the following: 1. Address safety
issues. 2. Locate a cul-de-sac. 3. Provide appropriate verification of Township road
access. 4. Incorporate Township & County specifications. 5. Provide a profile that
includes an elevation scale. Voting: All Members in favor.

6:30 P.M. in the Commissioner’s Room, Government Services Center, Fergus Falls,
Minnesota.

Michelle Eldien represented the County Attorney’s Office and Bill Kalar represented the

Minutes of November 10. 2004: A motion by Sha, second by Maske to approved the
revised minutes which includes a more detailed Motion for Teigen Bros Partnership.

North Shore Additionfferry & Mary Karkala/KW Properties - Approved Revision:
A Preliminary Plat of "North Shore Addition” consisting of 3 single family residential lots, 1
block. The property is described as GL 1 ELY of Hwy #51 ex platted ex trs ex road (16.39
AC), Section 35 of Gorman Township: Little Pine Lake (56-142), GD.
November 10. 2004 - Motion: A motion by Trites, second by Lachowitzer to table, at the

Motion by Mosher to increase the County Commissioners’ salary by approximately 1.5% to
$25,560 annually effective January 1, 2005. Motion failed for lack of a second.
Conditional Use Permit - Hovev's on Star/Doualas & Nancy Hovev:
Motion by Lee, second by Froemming, and unanimously carried to approve a Conditional Use
Permit to replace an existing trailer with an up-graded trailer, replace an existing storage
shed, and install a deck with conditions as recommended by the Planning Commission. The
property is described as Pt GL 2...,Section 3 of Star Lake Township & Pt SW % SW % & Pt
GL 5..., Section 34 of Dora Township; Star Lake (56-385)
Conditional Use Permit - Glenn Freeland & Richard Weum:
Motion by Mosher, second by Block, and unanimously carried to approve a Conditional Use
Permit to create a storm water runoff pond pursuant to Minnesota Pollution Control Agency
(MPCA) rules as presented. The property is described as NE 14 ex S.L.A & ex tr N 4 14 rods
of S.L. 1,2,3 & of NE 14 NE 14 SE % ..., Section 17 of Fergus Falls Township; Pelican River (56-PR).
Motion by Nelson, second by Lee, and carried, with Froemming and Mosher opposed, to
increase the County Commissioners’ salary by 3% to $25,956 annually and to increase the
employer contribution for benefits by $50 per month effective January 1,2005.
Per Diem & Mileage Set for CY2005
Motion by Mosher, second by Lee, and unanimously carried to establish the Otter Tail County
per diem at $47.50 for Calendar Year 2005.
Motion by Mosher, second by Froemming, and unanimously carried to establish the Otter Tail
County mileage rate at the Internal Revenue Service (IRS) rate of $0,405 per mile effective
January 1, 2005.
Recess & Reconvene
At 10:05 a.m. Chairman Nelson declared the meeting of the Otter Tail County Board of
Commissioners recessed for committee meetings. The meeting was reconvened at
10:32 a.m.
Planning Commission Reappointments
Motion by Froemming, second by Mosher, and unanimously carried to reappoint the following
Otter Tail County Planning Commission members effective January 1, 2005, for a three year
term:Facilities Discussion
Physical Plant Manager, Rick Sytsma, and Solid Waste Director, Mike Hanan, briefed the
County Board regarding plans to relocate the Solid Waste Administrative offices to the
Recycling Center. Motion by Lee, second by Block, and unanimously carried to authorize the
Physical Plant Manager to proceed with Request for Proposals (RFP) for bids to add-on to
the Recycling Center on the Northwest side of the facility. Cost of the addition would be paid
out of the Solid Waste Department Capital Improvement Fund and proposed construction is
during the 2005 construction season.

Sewer System Inspections
Land & Resource Director, Bill Kalar, presented a letter from the Pelican Group of Lakes
Improvement District (PGOLID) requesting sewer system inspections on the Pelican chain of
lakes. Mr. Kalar reported that inspections of other lakes that have not had sewer system
inspections are scheduled through the summer of 2006. The PGOLID chain of lakes will be
completed again after that schedule is complete. These lakes were inspected in the mid- 1980’s.
Shredded Paper
Commissioner Mosher stated that he has received information from Extension Educator,
Vince Crary, that there is a demand, on the market, for shredded paper (confetti type). The
Solid Waste Director will research this opportunity and report back to the County Board.
Purchase of Patrol Vehicles
Motion by Lee, second by Block, and unanimously carried to authorize the purchase of seven
(7) Ford Crown Victoria patrol vehicles, at a cost of $20,058 each, and one (1) Ford Explorer
Utility vehicle, at a cost of $23,217, to be paid from the Sheriffs Department Capital
Improvements Expenditure Fund.

Motion by Froemming, second by Nelson, and unanimously carried to approve the Final Plat
of Clark A. Squires & Toni Squires and John Squires known as “Squires Acres’’ located in
Section 13, Township 135, Range 39, Rush Lake Township, Rush Lake (56-141).

Motion by Nelson, second by Lee, and unanimously carried to approve the Preliminary Plat of

Civil Process Fees
Motion by Lee, second by Froemming, and unanimously carried to approve the Otter Tail
County Sheriffs Office Civil Process Fee-for-Service Schedule submitted by Chief Deputy,
Stacy Paulseth. The schedule (attached to the official minutes as Attachment B) includes an
increase to $50.00 for filing of redemption documents.
Sheriffs Department Staffing
Sheriff, Brian Schlueter, and Chief Deputy, Stacy Paulseth, briefed the County Board
regarding the upcoming loss of many years of experience in the Sheriffs Department due to

We received notice of this hearing on June 21,20000 and had planned to attend. Circumstances will now
prevent our being there so I am forwarding a comment.
I have no coomment about the first part of the application and believe that the commission will decide
what is in the best interest of everyone. I do .however, have a concern about filling in the "gully near the
rock pile on the lake shore". This gully does not appear to impede their using the shore and I feel this
change to the lake shore is not necessary and would be detrimental to the beauty and natural topography
of the shoreline. We are across the lake and have left our lot almost exactly as we found it. We are also
attempting to encourage those around us to leave the shore line in as natural a state as possible. Carrol
Henderson of the DNR has an excellent book on this subject. The river has many springs which add to
the beauty of the shoreline and water quality. Many of these flow to the lake through "gullies".! would
hope
that these folks are not attempting to make a "town lot" out of a piece of shoreline property.

STABILIZATION MAN FOR CONDITIONAL USE PERMIT
1. Silt fence will be erected: near the shore line for the leveling of the low area near
the rock pile.
2. AH exposed areas will be seeded with a grass and grain mixture upon completion
of the grading.
3. All exposed areas will be mulched with loose straw to prevent erosion.
If the permit is issued and I am able to arrange an excavator, I expect to complete
the work the first week of August If I am unable to complete this project in August
I will wait until next spring. 1 still hope to move some trees to the property this fall
if I complete the leveling. 1 do not anticipate hauling in any fill at this time as it
would be too expensive and I feel it is not the bmtt way to complete the project I
fiilly expect that any work that 1 do will be completed in one day.

Motion by Lee, second by Mosher, to approve a Conditional Use Permit to do site work to prepare the lot for
tree planting and moving on West Red River Lake (Sec. 29, Twp. 134, R. 42, Friberg Township, Lake No.
56-711) with conditions as recommended by the Planning Commission. Motion carried.
Conditional Use Permit-Ted Bellmore/Last Resort:
Motion by Lee, second by Mosher, to approve a Conditional Use Permit to re-open the bar (including the
1995 Conditional Use Permit #5425 for the beer garden) at the Last Resort on Long Lake (Sec. 11, Twp
134, R. 43, Elizabeth Township, Lake No. 56-784) with conditions as recommended by the Planning
Commission. Motion carried.
Conditional Use Permit - Robert W. Johnson:
Motion by Lee, second by Nelson, to approve a Conditional Use Permit to construct a driveway near Rush
and Lizzie Lakes (Sec. 4 & 5, Twp. 136, R. 42, Lida Township, Lake No. 56-760A) with conditions as
recommended by the Planning Commission. Motion carried.
Conditional Use Permit-Amor Township:
Motion by Froemming, second by Lee, to approve a Conditional Use Permit to remove and replace an
existing 12" corrugated metal pipe near Otter Tail Lake (Sec. 22, Twp. 134N, R. 40W, Amor Township, Lake
No. 56-242) as presented. Motion carried.
Conditional Use Permit - Chris Mickman:
Motion by Mosher, second by Lee, to approve a Conditional Use Permit for a cluster development
consisting of two dwellings and possibly a 3"^ dwelling long-term on Long Lake (Sec. 2, Twp. 131,
R. 41, St. Olaf Township, Lake No. 56-390) with conditions as recommended by the Planning Commission
as well as the following clarifications; 1) The Applicant must follow the Shoreland Management Ordinance ^ regarding parking, and 2) Condition 4 of the Planning Commission minutes dated June 21, 2000, should C
read “Any construction under this Conditional Use Permit must be completed within 5 years." Motion
carried.
Waiver of Exhibition and Shows Ordinance
Marvin Heisler, owner of Heisler’s Country Store, requested a waiver of the County’s Exhibition and Shows
Ordinance for a Mud Run Event scheduled for July 2, 2000. Mr. Heisler stated he was unaware that he
would need a permit under the ordinance until Deputy, Mike Boen, recently advised him. Discussion
followed regarding the provisions of the ordinance relative to security, adequate parking, adequate restroom
facilities, etc.
Motion by Lee, second by Nelson, to waive the Otter Tail County Exhibition and Shows Ordinance for a Mud
Run Event scheduled on July 2, 2000, by Marvin Heisler, conditioned upon a minimum of 4 uniformed
security guards, proof of appropriate insurance for the event, and that all other conditions of the ordinance
are met for the event. Motion carried.

Otter Tail Beach Club. Inc. - Approved As Presented:
A Conditional Use Permit Application to replace 2 manufactured homes - Bernie
Piotrowski replace a 12’ x 66’ with a 14’ x 66’; Karen Hofmann replace a 10’ x 50’ with a
14’ X 66’. This request is an After-The-Fact Application. The property is described as Pt
GL’s 3 & 5, Section 12 of Amor Township: Otter Tail Lake (56-242), GD.
Stan Fluto and Jim PresI represented the Application.
Motion: A motion by Lachowitzer, second by Maske to approve as presented; reasons
being: 1. The trailers were in need of replacing. 2. The number of bedrooms did not
increase. 3. The request has been approved by the Health Department. 4. Ten (10)
foot wide mobile home trailers are no longer available.

Otter Tail Township - Approved With Conditions:
A Conditional Use Permit Application to repair and maintain existing deteriorating road,
approximately 10,000 yards. The property is described as 290“’ Street and Sherman
Lake Road, Sections 27, 28, 33 & 34 of Otter Tail Township: Round Lake (56-206), NE.
Merle Lange (Otter Tail Townboard Member) represented the Application.
Motion: A motion by Sha, second by Estes to approve as presented, provided: 1. All
required State & Local permits are obtained. 2. An erosion Control Plan is provided to
Land & Resource for their approval. 3. The borrow pit be identified, a restoration plan is
provided to Land & Resource for their approval, and Land & Resource is contacted for a
final inspection.

Rodney Anderson/Genevieve Austin - Approved With Conditions:
A Conditional Use Permit Application to do site work to prepare my lot for tree planting
and moving. The work will consist of leveling and moving fill from the higher areas to the
lower area in the center of the lot. The amount of fill to be moved is 800 - 1000 cubic
yards. I am also requesting to level the gully near the rock pile by the lake and to also
establish an approach from the Township Road. I would put a silt fence near the lake if I
were allowed to level the gully. 1 hope to move or plant 50 - 75 trees on the property in
the next year and my plan Is to build a home on the land in 3 to 4 years. The property is
described as Lot 3 Scenic River View Acres, Section 29 of Friberg Township; West Red
River Lake (56-711), NE.

Meeting of the Otter Tail County Planning Commission was held on July 12, 2000 at 7:00
P.M. in the Commissioner's Room, Courthouse, Fergus Falls, Minnesota.
Roll Call:
Members Present: Linda Bergerud, Rod Boyer, Les Estes, Frank Lachowitzer, Joe
Maske, Bert Olson, Robert Schwartz, Richard Sha, and Leona Zimmerman.
Member Absent: David Trites.
Barb Hanson (7:10 P.M.) represented the County Attorney's Office and Bill Kalar
represented the Land & Resource Management Office.
Minutes of June 21. 2000:
A motion by Boyer, second by Bergerud to approve as amended, with the motion for the
Rodney Anderson/Genevieve Austin (page 4, provision #2) request to include “600 cubic
yards to come from offsite". Voting: All members in favor.
Leaf Lake Partnership - Approved With Conditions:
A Conditional Use Permit Application stating: The Leaf Lake Partnership property has 7
cabins, 1 garage, 1 utility shed that once served as a bait house, and 1 utility building that
houses a fish cleaning room. This property and these buildings were all formerly the
Arrowhead Resort. Seven family members (6 brothers / sisters and 1 cousin) bought the
property in 1987, and own it privately now. We request permission to park a 15’ travel
trailer on the property, and also to place 2 bunkbeds in the utility building (marked as FH
(fish house) on the map). Our children have grown, and some now have grandchildren.
For those few weekends that we are lucky enough to have everyone together, we need a
little more sleeping space than our cabins provide. Your consideration of this request is
appreciated. The property is described as Part of Government Lot 2, Section 23 of Leaf
Lake Township; East Leaf Lake (56-116), RD.
Art LaPoint represented the Application.
Motion: A motion by Estes, second by Lachowitzer to approve 1. The bunkhouse as
requested. 2. The RV provided it is relocated to meet the Shoreland Management
Ordinance setback requirements. The septic system must be reviewed by the Land &
Resource Office.
