We are requesting a variance to do an expansion of the existing cabin which will include: a
second story, a new roof, two additions, and a deck. Cabin is approximately 42 feet from the
OHWL and 8 feet from the lot line. The 12' x 18' existing portion will get a 6 foot extension and
a new roof. The second expansion is a 28' x 32' 2-story addition attached to the 12' x 18'
existing structure. The proposed project will not be any closer to the lake than the existing
structure. Please see attached variance application dated September 2, 1993. We are also
requesting a new garage located as follows: minimum required 20 foot setback from RROW
and about 120 feet from OHWL.

April 5, 2012 meeting - The audience was polled with no one speaking for or against the variance as requested. An
email from Linda Bowhall expressing concern with the variance as requested was read for the record. After discussion
and consideration, Steve Schierer, with the verbal agreement of the applicants made a motion, seconded by Michael
Harris and unanimously carried, to table the applicants’ request until the next scheduled meeting of the Board of
Adjustment to provide the applicant with an opportunity to consider other possible alternatives that would substantially
reduce the variance requested. May 3, 2012 meeting - The office received a letter from Mr. Martinson prior to the
meeting requesting the tabling of his application until a future meeting date. After consideration and discussion, Steve
Schierer made a motion, seconded by Thomas Lee and unanimously carried, to table, as requested by the applicant, the
variance hearing until the next scheduled meeting of the Board of Adjustment. June 7, 2012 meeting - After
consideration and discussion, Steve Schierer made a motion, second by Michael Harris and unanimously carried to
approve a variance of 140’ from the required ordinary high water level setback of 200’ for the placement of the proposed
development 60’ from the ordinary high water level as depicted on the amended drawing with the condition that the
existing structure must be removed (the removal date will be established by the Land and Resource Department when the
site permit is issued). The applicant’s amended proposal will locate the proposed development more centrally on his
property.

Joel and Susan Peterson, Lot 47 Bergsten N Shore Park, Crane Lake in Clitherall Township, requested a variance of 10’
from the required ordinary high water level setback of 100’ for the placement of a dwelling 90’from the ordinary high water
level. The audience was polled with no one speaking for or against the variance as requested. After consideration and
discussion, Steve Schierer made a motion, second by Thomas Lee and carried with Michael Harris voting no, to approve
a variance of 10’ from the required ordinary high water level setback of 100' for the placement of a dwelling 90’ from the
ordinary high water level as depicted on the drawing submitted with the variance application. The hardship/practical
difficulty is the unique shape of the applicants’ lot. The proposed development will be behind the general building line in
this particular neighborhood. It was also noted that other dwellings in this immediate area are closer to the ordinary high
water level than the proposed development.
Cheryl Boche - Approved the variance as requested with a condition. (7:08 p.m.)
Cheryl Boche, Lot 79 Nedberg - Nye Survey Lots of Government Lot 1, 2 and 3, Section 1 of Edna Township by Devils
Lake, requested the following: Proposing to replace the existing garage with a 26’ by 20’ two story garage with bedroom
being 45’ from the ordinary high water level. Requesting a variance of 30’. Also proposing a breezeway to connect the
proposed garage to the existing dwelling. The proposed breezeway will be 57’ from the ordinary high water level.
Requesting a variance of 18’ from the ordinary high water level. The required structure setback is 75’. Will be tying the
proposed addition to the existing cabin, which may warrant a roofline change. The applicant’s husband appeared with the
applicant at the public hearing. The audience was polled with no one speaking for or against the variance as requested.
After consideration and discussion, Steve Schierer made a motion, second by Thomas Lee and unanimously carried, to
approve the variance as requested in the application dated May 14, 2012 and as depicted on the drawings submitted with
the variance application with the condition that the applicant’s property must have a certified septic system. It should be
noted that the applicant’s proposed development includes raising the existing cabin etc. as noted on the second page of
the applicant’s drawings.
Sally H. Mudge - Approved the variance as requested. (7:15 p.m.)
Sally H Mudge Trust, part of Government Lot 4, Section 6 of Girard Township by Blanche Lake, requested the following:
Purchasing credits from a wetland bank that is not located within the minor watershed of Blanche Lake. Approval has
been granted by Rick West to purchase the wetland credits. The applicant was represented by Jacqueline Henning and
Cindy Thernell. The audience was polled with no one speaking for or against the variance as requested. After
consideration and discussion, Thomas Lee made a motion, second by Paul Larson and unanimously carried, to approve
the variance as requested in the variance application dated February 3, 2012 noting that the approval is consistent with
past actions of the Board of Adjustment.

May 3, 2012 meeting - After discussion and consideration, Steve Schierer made a motion, seconded by Thomas Lee
and unanimously carried, to approve a variance of 8’ from the required 20’ road right-of-way setback and a 2’ variance
from the required 10' septic tank setback for the placement of a 20’ by 20’ car closed vehicle shelter 12’ from the road
right-of-way and 8' from the septic tank with the condition that no more than 30.5% of the total eligible lot area can be
covered with impervious surfaces. It was noted that the granting of the variance as requested will provide the
applicants with a reasonable use of their property and will provide the applicants with an opportunity to enjoy the
same rights and privileges as others in this immediate area as there are many properties in this immediate area which
have impervious surface coverage in excess of 25% and structures that are closer to the road right-of-way than the
required 20’ setback. The applicants must have the impervious surface coverage reduced to 30.5% on or before
September 1, 2012. It was noted that the applicants have a difficult lot and they are doing the best they can with the
lot.

variances as follows to add an attached garage and utility area.
1. Variance of 9’ to place addition 1 ’ from lot line. Existing developments in this area do not meet setbacks due to
property line misidentification in the past.
2A. Impervious surface variance of 13% to allow 38% coverage. Existing coverage is at 41.2%. Removal of existing
coverage will reduce coverage by over 3%.
2B. Or apply to vacate old road and add 1200 square feet of lot size to property. Impervious surface coverage would
then be reduced to 34%, requiring a 9% variance to impervious surface coverage.
The audience was polled with no one speaking for or against the variance as requested. After consideration and
discussion, Paul Larson made a motion, seconded by Marion Gill and carried with Michael Harris voting no, to
approve a variance of 5’ from the required side lot line setback of 10’ for the placement of the proposed development
5’ from the east side lot line at it closest point and to allow the applicant to include the non-vacated road area when
making the impervious surface coverage calculation, which means that no more than 34% of the total modified eligible
lot area can be covered with impervious surfaces after completion of the proposed development. The applicant’s
proposed development will reduced the overall impervious surface coverage from 41.2% to 34%. It was noted that it
is only practical to allow the applicant to use the non-vacated portion of the road when making the impervious surface
calculation as all existing impervious materials will be removed from this area.

The porch is 89.5’ from the ordinary high water level at its closest point. The audience was polled with no one
speaking for or against the variance as requested. After discussion and consideration, Michael Harris made a motion,
second by Steve Schierer and unanimously carried, to deny the application for variance as requested as no adequate
hardship/practical difficulty unique to the property had been shown that would allow for the granting of the variance as
requested, a reasonable use of the property can be obtained without the granting of the variance as requested and
granting the variance as requested would establish precedence.
Lu Jean Schei - Approved the variance as requested. (8:34 p.m.)
Lu Jean Schei, part of Government Lot 1, Section 6 of Tordenskjold Township by an unmanned lake, requested the
following: The ordinance requires all non-dwelling structures within 400’ of a lake to be less than 20 feet high. A
variance would provide a safer environment for our employees, patrons and the general public. It would also enable
our footprint to get bigger allowing for better traffic patterns, including friendlier turning radius’s, space between trucks
and visibility. In addition, our structures would be farther away from both highways insuring greater visibility on the
roadways. The structures will meet the required lake setback of 200’ but not the required 400’ setback to exceed 20
feet of height. Two grain bins at 88’ 6” and two grain bins at 69’ IT. Potential future grain bins would be as high was
95’ 10”. The leg tower will be approximately 120’ tall. The potential bin structures would be approximately 275’ from
the lake. David Anderson, Surveyor and Jerry Kramer represented the applicant at the public hearing. The audience
was polled with no one speaking for or against the variance as requested. After discussion and consideration, Steve
Schierer made a motion, second by Thomas Lee and carried with Michael Harris voting no, to approve variances to
exceed the maximum height as requested in the variance appiication dated March 14, 2012 for the construction of a
number of grain bins and a leg tower in the locations as depicted on the drawing submitted with the application. It
should be noted that the variance as approved allows the proposed development to exceed the 20’ maximum height
of non-dwelling structures which are located within 400’ of the ordinary high water level. However, it should also be
noted that the variance as approved does not apply should the proposed development be determined a prohibited use
in the shoreland management area or if a conditional use permit cannot be obtained for the proposed development.
Note - Randall Mann excused himself from the balance of the meeting prior to the following hearing.
Mike Wickenheiser - Approved the variance application with a condition. (8:45 p.m.)
Mike Wickenheiser, Government Lot 3, Section 3 and part of Sub Lot B of Government Lots 10 and 11, Section 4 of
Dora Township by Loon Lake, requested a variance of 65’ from the required ordinary high water level setback of 100'
for an addition to an existing structure 35’ from the ordinary high water level. Josh Lessman represented the applicant
at the public hearing. December 1, 2011 Meeting -The audience was polled with no one speaking for or against the
variance as requested. After discussion and consideration, Steve Schierer with the verbal agreement of the

VARtANCE REQUESTED IS:
. My cabin has a poor roof construction because of the way prior expansions
were done. The flat slope and multiple lines cause reliability problems
and make expansion difficult.
The desire is to build a new clean roof with conventional pitch over the
top and at the same time add badly needed space. Square footage would
increase from about 450 now to about 1000. Appearance is enhanced and the building squared to allow an even roof line.
1). Request a variance of 60' from the required 100' setback from the OWHL
for construction of the two additions and the new roof. The addition
would not be any closer to the lake than the existing structure.
2). At the Oct. 2, 1992 meeting, a variance was granted for a 24'X26' garage.
I have determined that a third stall is needed.Therefore, a revision to this motion is requested to allow a 24'X36' garage with no affect to setbacks.
Note: the 36' width dimension is parallel to the shoreline. -
In order to properly evaluate the situation, please provide as much supplementary information as possible, such as: maps, plans,
information about surrounding property, etc. APPLICANT SHALL BE PRESENT AT THE SCHEDULED HEARING.

the following: We are requesting a variance to do an expansion of the existing cabin which will Include: a second story, a
new roof, two additions, and a deck. Cabin is approximately 42’ from the ordinary high water level and eight feet from the
lot line. The 12’ by 18’ existing portion will get a six foot extension and a new roof. The second expansion is a 28’ by 32’
2-story addition attached to the 12’ by 18’ existing structure. The proposed project will not be any closer to the lake than
the existing structure. We are also requesting a new garage located as follows: minimum required 20 foot setback from
road right-of way and about 120 feet from ordinary high water level.
