Mark & Julie Bechtel - Approved With Conditions / Denied Request #3: A Conditional Use Permit Application (as stated by the Applicant on the Application): 1) I would like to level an area on south side of cabin to place a >2 circle patio. It would be level with the walk-out door & also allow to place 2 windows along the south basement wall allowing for an egress window in the basement bedroom. I would shave into the hill eastward approx. 3 ft tapering to 0 (approx. 100 cu. yds) level & move it westward to level the area. I would then erect a boulder wall (as shown on diagram) to hold soil stable. 2) I would like to level the area to west of the house 24 ft westward (approx. Ill cu. yds) running along the house 50 ft. I would remove all the old railroad ties & erect a tapering boulder wall on the west side. This would help to control surface water run off that puddles on the neighbor’s property to the west as it would have greater surface area to perk through. If not able to level this area then a boulder wall would be placed in area (denoted on diagram) to contain north side of patio. Septic tank would be moved north. 3) Place boulders 20 ft back from rip-rap shoreline on the elevated slope to hold/stabilize hill. (Diagram is available for viewing at Land & Resource Mgt.) I will have the shoreline rip-rap by Oct. 1®^ but would like until Nov. 1®' to finish project & will stabilize soil by that date. OTC Board of Commissioners’ Minutes September 14, 2010 Page 4 Amor 800 MHz Radio Tower Site Lieutenant McGuire reported that, because there is a wetland on the proposed Amor tower communication site, to move forward with the original purchase agreement, a variance would be required He discussed various options with the Board including a 99 year lease or splitting out the wetland from the purchase. Motion by Huebsch, second by Lindquist, and unanimously carried to authorize the Sheriff’s Department to negotiate acquisition of the proposed Amor tower communication property by either easement or purchase. Highway Contract Motion by Huebsch, second by Erickson, and unanimously carried to authorize the Chairman’s signature to execute a contract between the County of Otter Tail and BNSF Railway Company for the installation of active warning devices and concrete surfaces on CSAH 67 in the City of New York Mills at a cost of $215,579.00. High Water Update Highway Engineer, Rick West, reported on several high water roadways. CSAH 88 is being built up to keep traffic going through the area. County Road 10 between Elizabeth and County Road 27 is flooded. The Highway Department is working with other government agencies to find a solution for the area. There is water on County Highway 118 about one half mile East of CSAH 21. Water from Lake Iverson is now running over County Road 25. CR 25 is narrowed down to one lane. Mr. West discussed the need to proceed with temporary relief on CR 25 to keep the water off the roadway for the winter. Motion by Lindquist, second by Huebsch, and unanimously carried to approve emergency, temporary culvert installation under CSAH 25 to allow the roadway to remain open this winter. Mr. West noted that the long term solution for CSAH 25 is an outlet to move some water out of the area in a controlled manner. Planning Commission Recommendations Preliminary Plat - “Deconcini’s Acres”. Christopher & Lynn Deconcinci: Motion by Huebsch, second by Froemming, and unanimously carried to approve the Preliminary Plat entitled “Deconcini's Acres” consisting of two single family residential lots with a condition as recommended by the Planning Commission. The property is described as Pt of GL 2 (2.23 AC), Section 26 of Gorman Township; Little Pine Lake (56-142), GD. Preliminary Piat - “Adams Rose Point”. Kent Adams: Motion by Huebsch, second by Erickson, and unanimously carried to approve the Preliminary Plat entitled “Adams Rose Point” consisting of 10 lots (5 single family residential, 3 lake lots, & 2 non- residential backlots) with conditions as recommended by the Planning Commission. The structure would be placed on the precise footprint of the existing cabin with the additional 10’ going to the south (towards HWY). The cabin will be between 15’ to 18’ high to the peak instead of the 8’ flat roof building. Currently 44 units - will remain as 44 units.
