The Otter Tail County Board of Adjustment met Thursday, December 1st, 1394, with the
following persons in attendance:

CALL TO ORDER - The meeting was called to order at 7:00 p. m. by Chairman George Walter.
MIHUTES APPROVED - Hovember 3rd, 1994
Hearing no corrections or additions the minutes of the November 3rd, 1994 meeting were
declared approved as mailed.
The following variance requests were heard:
Karleen D. Krause Tabled
Karleen D. Krause, Fairmount, ND, requested a variance of 26' from the required ordinary
high water level setback of 100' for the location of a 28' by 32' dwelling 74' from the
ordinary high water level and a variance of 55' from the required side lot line setback of
65' for the location of a 12' by 20' water-oriented accessory structure (Boathouse) 10'
from the side lot line. The property is described as Lot 42, Heilberger Lake Estates,
Heilherger Lake in Friberg Township. The audience was polled with no one speaking for or
against the request. Karleen D. Krause indicated that the 36' measurement stated on the
drawing should have been 56'. The members of the Board of Adjustment expressed concern
over the fact that the building site was not marked. After consideration, motion was made
by Cecil Femling, seconded by Randall Mann and unanimously carried, to deny the variance
as requested. After additional discussion, motion was made by George Walter, seconded by
John Everts to grant a 14' by 32' addition on the back of the existing building towards
the road. This motion was later withdrawn. After additional discussion and
consideration, motion was made by George Walter, seconded by Cecil Femling and unanimously
carried, to table the variance request until the next scheduled meeting to allow the Land
and Resource office an opportunity to verify that the location of the 28’ by 32' dwelling
will be at least the same distance from the ordinary high water level as the structure to
the north.

The property is described as Lot 37 and 38, Block 1, Trowbridge Point, Leek Lake in Candor
Township. Steven Hanson represented the applicant at the hearing. The audience was
polled with Jeff Rustvold speaking to the variance request. After consideration, motion
was made by Craig Anderson, seconded by Cecil Femling and unanimously carried, to table
the variance request until the April 6th, 1995, Board of Adjustment meeting for additional
information and recommendations from the Land and Resource Office. Specifically the Board
requested that Mr. Hanson, the proposed buyer, meet on site with Tim Griep, Land and
Resource Inspector, to discuss the proposed location and size of the mobile home on Lot
38, the possibility of locating the garage at a right angle to the existing roadway, to
discuss possible erosion problems and to determine the location of a water and septic
system that would not require any variances. The Board expressed concerns regarding the
very fragile nature of this property, the existing tightness of this area, and for the
safety of the public.
April 6th, 1995, Meeting.
The Board received a report regarding the previously held meeting between Mr. Hanson and
Mr. Griep. Drawings were presented and alternatives were discussed. After consideration,
motion was made by Cecil Femling, seconded by Randall Mann and unanimously carried, to
approve the placement of a garage and the placement of a mobile home in the areas outlined
on the drawing identified as drawing number 2. Hardship being a substandard lot of
record. It was noted that the entrance to the garage would be at a right angle to the
road right-of-way.

Wally Senyk, County Attorney, and Bill Kalar, Land and Resource Director, discussed with
the Board of Adjustment members proposed changes to the County's Subdivision Controls
Ordinance. The Board of Adjustment members were advised of a meeting scheduled for
Wednesday, April 26th, 1995, in the Otter Tail County Commissioners' Room to discuss in
detail the proposed Subdivision Controls Ordinance. Comments and suggestions were
requested from members of the Board of Adjustment.
With no further business. Chairman Walter declared the meeting adjourned at

Arnold and Janice Ness, Barnesville, MN, and Lynn Goerger and Janice Friedrich, West
Fargo, ND, requested a variance of 27' from the required ordinary high vater level setback
of 75' for the location of two septic tanks 48' from the ordinary high water level, a
variance of 7' from the required structure setback of 10' for the location of a septic
tank 3' from the cabin located on Parcel C and a 10' variance from the required structure
setback of 10' for the location of a septic tank 0' from the cabin located on Parcel B.
The property is described as Parcels B and C of Government Lot 2, Section 20 of Dunn
Township on Lake Lizzie. The audience was not polled as there was no one in attendance.
After consideration, motion was made by Craig Anderson, seconded by Carl Johnson and
unanimously carried, to table the variance request until the December 1st, 1994, Board of
Adjustment meeting to allow the applicants an opportunity to discuss possible alternatives
with the Land and Resource office. The Land and Resource Department and the applicants,
due to a misunderstanding as to which party was going to make the contact, did not meet to
discuss possible alternatives prior to the December 1st, 1994, Board of Adjustment
meeting. It was decided by general consent that prior to the next scheduled meeting the
Land and Resource Department would meet with the Health Department to discuss possible
alternatives and that the Land and Resource Department would make a report to the Board of
Adjustment at the next scheduled meeting and that the applicants would not need to attend
any additional meeting to discuss this variance request.
