OTTER TAIL COUNTY BOARD OF ADJUSTMENT
November 4,1999
The Otter Tail County Board of Adjustment met Thursday* November 4, 1999, with the following
persons in attendance:
Linda Bergerud
John Everts
Cecil Femling
David Holmgren
Randall Mann
Mark Steuart
Pat Eckert, Land and Resource Management
Barbara Hanson, Assistant County Attorney
Call to Order - Chairman John Everts called the meeting to order at 7:00 p.m.
Minutes Approved -
Hearing no corrections or additions the minutes of the October 14, 1999, meeting was approved as
mailed.. t
The following variance requests were heard:
Michael Karsnia - Approved with modifications.
Michael Karsnia, Fergus Falls, MN, requested a variance of 43’ from the required ordinary high water
level setback of 100’, a variance of 7’from the required road right-of-way setback of 20’, a variance of
10’ from the required lot.line setbabk.of 10’ and a variance of 53’ from the required ordinary high water
level setback of 100’ for the location of a dwelling 57’ from the ordinary high water level and 13’ from
the road right-of-way, for the location of a septic system 0’ from the lot line and for the placement of a
deck 47’ from the ordinary high water level. The property js described as Lot 36, Heilberger Lake
Estates, Heilberger Lake in Friberg Township. Michael Karsnia presented letters in support of his
request from the Friberg Town Board and from Gregg and Nancy Johnson. The audience was polled
with no one speaking for or against the request. After consideration, motion was made by Cecil
Femling, second by John Everts and.unanimously carried, to approve a variance of 50’ from the
required ordinary high water level setback.of 100’ for the placement of a dwelling and deck 50’ from the
ordinary high water level with the following conditions: 1. the 10’ deck area in front of the main dwelling
(lakeside) cannot exceed 36” in heightj'and 2. the deck will be considered the applicant’s water-
oriented accessory structure. After discussion and consideration, motion was made by Randall Mann,
second by David Holmgren and unanimously carried, to approve a variance of 10’ from the required
road right-of-way setback of 20’ for the placement of the applicant’s proposed project 10’ from the road
right-of-way. After additional discussion and consideration, motion was made by Randall Mann,
second by David Holmgren and unanimously carried, to approve a 5’ variance from the required side lot
line setback of 10’ for the placement of a drain field 5’ from the lot line and extending as close to the
road right-of-way, but not into the road right-of-way, as necessary to provide the lineal footage needed
for the system. It was noted that the;granting of these variances would not establish precedence for
this area. Hardship is a substandard lot of record and the terrain features of the applicant’s property.
