for the sewage system violation on condition he correct to
specification within six months of date of permit.

above-named Court and says that he believes this information and other persons from whom it
is obtained to be reliable and that probable cause exists to support a warrant of arrest

for the following reasons:
Complainant is the duly appointed and acting Shoreland Administrator for Otter Tail
County, Minnesota, who individually and with members of his staff conducted an
investigation of the hereinafter described offenses:
Defendant owns Lots 34, 35 and 36 of Heilberger Lake Estates on Heilberger Lake
and R. D. Lake, located in Friberg Township, Otter Tail County, Minnesota. Based
upon on-site inspection made on May 5, 1974, of the building to which the permit
refers was constructed 43 feet from the closest point of the building to the lake-
shore; it should have been set back 60 feet from the lakeshore. No veiriance was
granted by either the Shoreland Management Office or Planning Commission for said
building to be 43 feet from the lakeshore. A deck attached to the land and to
the building aforesaid is 30 feet from the lakeshore, also in violation of the
building permit. Defendcint also failed, according to law, to ask for an on-site

Based on the foregoing, complainant states that on or before May 5, 1974, in the
Township of Friberg, Otter Tail County, Minnesota, and within the jurisdiction of

individually, wrongfully and unlawfully did install a sewage system on parts of his
property on Lots 34, 35 and 36, Heilberger Lake Estates on Heilberger Lake without
first obtaining a permit as required by Otter Tail County Ordinances, contrary to
the form of the ordinance in such cases made and provided and against the peace
and dignity of the State of Minnesota, and the County of Otter Tail.

building permit dated August 3, 1972, by then and there failing to construct said
building in accordance with set-back requirements and by further failing to seciire
an on-site inspection as well as a Certificate of Occupancy as required by Otter
Tail County Ordinances, contrary to the form of the ordinance in such cases made
and provided and against the peace and dignity of the County of Otter Tail and
State of Minnesota,
WHEREFORE, Complainant prays that said offender be arrested and dealt with
according to law.
