Maureen C. Torphy - Approved
Maureen C. Torphy, Madison, Wl, requested a variance for construction in accordance with the
submitted plan. It is the applicant’s intention to repair the roof, walls and foundation of the front 26 feet
(lake side) of the old cottage and to newly construct the back area with a 28’ by 28’ addition as shown
on the applicant’s submitted plan. This repair and construction is to include the replacement of
sheathing, rafters and studding that are no longer structurally sound by reason of breakage, aging or
leaking. The existing structure is approximately 25’ from the lake. The proposed 28’ by 28’ addition is
approximately 5T from the lake. The property is described as Lot 5, Block 4, Crystal Lida Beaches,
Lake Crystal in Lida Township. Wesley D. Tweetoh, Contractor, represented the applicant at the public
hearing. A letter from Cal and Loretta Larson in favor of the applicant’s request was read for the
record. The audience was polled with no one speaking for or against the request. After discussion and
consideration, motion was made by John Everts, seconded by Robert Schwartz and unanimously
carried, to approve the variance as submitted noting that the proposed addition and the proposed
remodeling will be no closer to the ordinary high water level than the original structure and noting that
the variance request is approved contingent upon the removal of the existing boat house, in
accordance with the instructions and/or plans of the Land and Resource Department and the Solid
Waste Department, on or before June 1, 1998.
Gary D. and Sharon L. Thompson - Approved
Gary D. and Sharon L. Thompson, Lisbon, ND, requested the following: “The northeast corner of the
garage is 2 feet to close to the township road right-of-way. Therefore 2 feet of the east wall of the
garage and 3.5 feet of the north wall of the garage are in violation of the 20’ setback rule.” The property
is described as Lots 3 and 4, Block 5, Lida Shores, North Lida Lake in Lida Township. A letter from
John Lowe in support of the applicants’ request was read for the record. A letter from the Lida
Township Board of Supervisors indicating that they had no objections to a corner of the garage being
slightly within the setback area was read for the record. After discussion and consideration, motion was
made by Cecil Femling, seconded by Craig Anderson and unanimously carried, to approve the
placement of the garage in its present location noting that the lot lines are not at a right angle to the
road right-of-way.
Ronald J. Rolfes - Denied
Ronald J. Rolfes, Minnetonka, MN, requested a variance of 2’ from the required structure setback of 10’
for the location of a holding tank approximately 8’ from the dwelling. The property is described as part
of Lot s and all of LotIO, Bill-RA-AL Acres, Heilberger Lake in Friberg Township. The audience was
polled with no one speaking for or against the request. After consideration, motion was made by
Randall Mann, seconded by Craig Anderson and unanimously carried, to deny the variance as
requested as no adequate hardship had been shown and noting that the holding tank must be legally
located on or before June 1, 1998.

RE:
Dear Mr. Rolfes:
On November 21, 1997, I was on your lot to verify your well to
septic system separation. At that time, I found the separation
from the well to septic system to be within the guidelines.
However, I also found that at least part of the septic system is
less than the minimum setback requirement to the dwelling.
Our original septic system installation inspection in 1988
indicated that the septic system setback to the dwelling met the
requirements. In checking the County Assessor's records, it
appears that in 1990 an 18' x 30' addition was added to the
dwelling. It appears that it is this addition that does not meet
the setback requirements.
I checked our records and could not locate a Permit for this
addition. To resolve this matter, one of the following must be
done:
Move the septic system to a legal location and apply for
an After The Fact Site Permit for the 1990 addition.
1.
Apply for a variance to leave the 1990 addition in its
current location.
The Fact Permit would be required.
2.
If the variance is approved, an After
Remove the 1990 addition.3 .
Please contact me by December 22, 1997 regarding this matter.

the addition is on the back side of the existing structure and that the addition is no

DeniedMartha J. Hart
Martha J. Hart, Fort Collins, CD, requested a variance to subdivide three substandard
contiguous lots which have been combined per the requirements of the Shoreland Management
Ordinance. The applicant is proposing a modification to the south property line of Lot 1,
Freeman’s Beach First Addition, by transferring 30’ from Lot 1, Freeman’s Beach First
Addition to Lot 5, Freeman’s Beach. Lot 1, Freeman’s Beach First Addition currently has
approximately 105’ of frontage and approximately 16,300 square feet of area and Lots 4 and
5, Freeman’s Beach, currently have a combined frontage of approximately 120’ and a
combined area of approximately 18,700 square feet. If the variance is granted Lot 1,
Freeman’s Beach First Addition, would have approximately 75' of frontage and approximately
11,500 square feet of area and Lots 4 and 5, Freeman’s Beach would have a combined
frontage of approximately 150’ and a combined area of approximately 23,500 square feet.
The minimum size requirements for platted lots on a natural environment lake is 200’ of
frontage and 80,000 square feet of area. The property is described as Lots 4 and 5,
Freeman's Beach and Lot 1, Freeman’s Beach First Addition, Dead Lake in Dead Lake
Township. The applicant was represented by Mervin and Phyllis Freeman. The audience was
polled with no one speaking for or against the request. A letter from Jill Freeman Owens
if favor of the applicant's request was read for the record. After consideration, motion
was made by Craig Anderson, seconded by John Everts and unanimously carried, to deny the
variance as requested as no adequate hardship had been shown and the granting of the
variance will make a substandard situation more substandard.
Darlene J. Bucholtz - Approved
Darlene J. Bucholtz, Ottertail, MN, requested a variance to subdivide a parcel of less
than 5 acres from an existing 13.29 acre parcel. The parcel would be approximately 2.66
acres. The property is described as part of Government Lots 7 and 8, Section 34 of Rush
Lake Township on McGowan Lake. The audience was polled with no one speaking for or
against the request. After consideration, motion was made by Craig Anderson, seconded by
Cecil Femling and unanimously carried, to approve the variance as requested as the 2.66
acre area is a well defined lot, has adequate room for two septic systems, has public road
access and is the last parcel of land within the 13.29 acre tract bordering the Otter Tail
River. It was noted that this 2.66 acre parcel has adequate room for building and will
not require any additional variances.
