Motion by Froemming, second by Lee, and unanimously carried to approve a Conditional Use
Permit to expand a dwelling with conditions as recommended by the Planning Commission. The

At 11:15 a.m.. Chair Froemming declared the meeting of the Otter Tail County Board of
Commissioners recessed for a short break. At 11:25 a.m.. Chair Froemming declared the meeting
of the btter Tail County Board of Commissioners closed to the public to discuss pending litigation
in the matter of West Silent Lake Retreat vs. the County of Otter Tail as authorized by attorney-
client privilege, M.S. 471.705 Subd Id. Present were all seated commissioners, the County
Attorney, County Coordinator, Recording Secretary, and Land & Resource Director.

Commissioners reconvened in open session.

porch to be enclosed, with the following conditions; 1. The bait house must be removed

of the work is outside of the Shore Impact Zone. Voting: All members in favor.
Steve & Ruth Lorshbouah - Tabled to February 13. 2002:
An After-the-Fact Conditional Use Permit Application to retain a 16’ wide road (Grade &
Fill Permit authorized a 10’ wide road, this is an after-the-fact request). Detailed request
is on file. The property is described as Pt GL 3, being permanently attached to Lot 7, 1“
Addition to Stenstrom Beach, Section 12 of Elizabeth Township; Long Lake (56-784),
RD.
Steve and Ruth Lorshbough represented the Application.
Doug Bredeson expressed concerns regarding the displacement of water (flooding),
stating that the fill should not be there. Steve Brust expressed concerns regarding the
effect this has had on the feelings amongst neighbors, stating that it does not create any
problems. Mike Partain indicated that all people need to follow the rules and that the
decision tonight must be thought through as it will set a precedent. Bill Larson spoke
against the request, stating that he now has water in his backyard. Joanne Larson
indicated that in 1999, Mr. Lorshbough wanted a 10’ wide road and she was against it
then too - she was opposed to the request. Russ Bredeson expressed concerns
regarding the effect this road has on water levels and spoke against the project.
Motion: A motion by Trites, second by Estes to table (at the Applicant’s request) to
February 13, 2002 to allow the Applicant to consult an engineer to: 1. Provide a design
that would be stable and not expand the base of the road. 2. Determine whether or not
the fill is displacing water onto properties in the area. 3. Review the elevation of the
culverts and its effect on the drainage characteristics of the properties on both sides. 4.
Review the proposed wetland mitigation relative to the water dispiacement. Voting: All
members in favor, except Olson.
Timothy and Cvnthia Hart - Approved With Conditions:
A Conditional Use Permit Application stating: My cosmetology salon burned in a fire on
September 1, 2001 and I would like to relocate the shop in the basement of our home.
The property is described as Lot 2 Biock 1 of Historic Monument Beach 2™* Addition,
Section 11 of Pelican Township; Prairie Lake (56-915), RD.
"Cindy & Tim Hart represented the Application.
Motion: A motion by Trites, second by Lachowitzer to approve as presented, provided:
1. The stainvay access is above ground. 2. The sign is a maximum of 3’ x 4’ in size,
and unlighted. 3. There is designated parking onsite. 4. The hours must not exceed
8:00 a.m. - 8:00 P.M. / Monday through Saturday. 5. A compliant sewage system is
installed onsite. Voting: All members in favor.
David C & Ann P Nelson/Donald H & Dorene Nelson - Approved With A Condition:
A Conditional Use Permit Application to construct a driveway (road) extending west
approximately 500 feet from end of Partridge Drive to our proposed building site. The
road would be 16 feet wide with a gravel surface. It would be 3 feet high with 9 foot
ditches at 1-3 slope. The proposed road would follow along a ridge to reduce the amount
of earth to be moved. The road would end approximately 400 feet away from the lake,
which is it’s closest point to the shoreline. About 1,200 cubic yards needed for the road.

George & Kim Sholv — Approved With A Condition:
A Conditional Use Permit Application to remove fill (as shown on drawings - available at
the Land & Resource Management Office, Courthouse, Fergus Falls, MN) and build
retaining wall around foundation to control nin-off and frost protection to foundation. This
is an After-the-Fact request. The property is described as Crystal-Lida Bchs SD Lot 9 BIk
2, Lot 3 & strip bg NE cor Lot 3 ...in Section 11 of Lida Township; Lake Lida (56-747),
GD.
George Sholy and Chuck Krekelberg (attorney) represented the Application.
Motion: A motion by Trites, second by Sha to approve as presented, provided Land &
Resource Management verifies that the 25% impervious surface requirement of the
Shoreland Management Ordinance is met. Voting: All members in favor, except
Zimmerman.
Mark & Cvnthia Vierkant- Tabled to November 14. 2001:
A Conditional Use Permit Application stating: We are trying to bring the grade of the lot
E-911 (42340) up to the level of the two adjoining lots, one of which we own. The reason
for this is every time we have rain we get standing water in this area, thus a breeding
ground for mosquitoes and also we can’t mow when we’ve had a lot of rain. Both
adjoining lots have been filled years ago and this was not, leaving this the lowest. VVe
would be filling near the house at 1% feet and gradually going back to a level of 6 inches,
not to exceed either level on both sides (700 cu yds). To take care of erosion we plan to
either hydroseed the area or use grass seed and a fiber blanket or grass seed & sod. On
the second small area that we are requesting 25 cu yds on, lot E-911 (42310) we want to
fill in a low spot in yard. Thank you for your consideration. The property is described as
Pt Lot 9, 100’ E of & Adj Lot 46 Pleasure Park Beach S of Rd and Pleasure Park Beach
