November 4th, 1993. with the following persons in attendance: Craig Anderson John Everts Cecil Femling Dan Oehler Berton Olson George Walter Bill Kalar. Land and Resource Management Pat Eckert. Land and Resource Management Kurt Mortenson. Assistant County Attorney CALL TO ORDER - The meeting was called to order at 7:00 p.m. by Chairman George Walter. MINUTES APPROVED-October 7th. 1993 Hearing no corrections or additions the minutes of the October 7th, 1993 meeting were declared approved as mailed, The following variance requests were heard: Milton Bradley Bohlen - Denied Milton Bradley Bohlen, Minneapolis, MN, requested a variance of approximately 6 to T from the required ordinary high water level setback of 100' for the placement of a screened in enclosure on top of an existing 12‘ by 12' patio located approximately 93 to 94' from the ordinary high water level. The property is described as Lot 1, Block 1, Solar Shores, Boedigheimer Lake in Rush Lake Township. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Cecil Femling. seconded by Craig Anderson and unanimously carried, to deny the variance as requested as no adequate hardship had been shown. Tom Springer - Tabled Tom Springer, New York Mills, MN, requested a variance of 4' from the required 10' holding tank setback for the construction of a 24' by 24' garage 6' from the holding tank. The property is described as Lot 1, Springer's Beach, Big Pine Lake in Pine Lake Township. The audience was polled with no one speaking for or against the request. After consideration. motion was made by Bert Olson, seconded by Dan Oehler and unanimously carried, to table the variance request until the next scheduled meeting. November 4th, 1993 Page 2 David Pugh - Approved David Pugh, Fergus Falls, MN, requested a variance from the required 3' structure height above the ordinary high water level for the construction of a new basement floor that would match an existing basement floor which is 10" above the ordinary high water level. The property is described as Lot 8, 3rd Addition to Burau Beach, Wall Lake in Dane Prairie Township, The audience was polled with no one speaking for or against the request. After consideration, motion was made by Dan Oehler, seconded by Craig Anderson and unanimously carried, to approve the variance as requested. The granting of this variance will allow the applicant to construct an addition to his existing dwelling and to maintain the basement floor of the new addition at the same level as the existing basement floor. It should be noted that the applicant has not experienced any water problems in the basement and that the applicant has owned the property since 1988, The applicant stated that he was not aware of any water problems that the previous owner had experienced. The existing basement was constructed in 1961, Wm. Borman - Approved Wm, Borman, Hopkins, MN, requested a variance of 21' from the required ordinary high water level setback of 75' for the construction of a 4’ by 12' addition approximately 54' from the lake and approximately 8' in front of the string line. The property is described as Lots 38 and 39, Martins Perfect Beach, Big Pine Lake in Corliss Township, Letters from William and Virginia Packwood and Arnold and Jean Rosen were read for the record. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Craig Anderson, seconded by John Everts and unanimously carried, to approve a variance of 21' from the required ordinary high water level setback of 75' for the construction of a 4’ by 12’ addition approximately 54' from the lake. It should be noted that the proposed addition is already hidden from the neighbor’s view as the addition is behind the site line. Lynn Edward Amundson - Tabled Lynn Edward Amundson, Pelican Rapids, MN, requested a variance of 20’ from the required road right-of-way setback of 20’ for the construction of a 26' by 30' garage on the edge of the road right-of-way. The garage would be located 24’ from the driving surface. The property is described as Lot 3, 2nd Addition to Inlet Beach and vacated road, Lake Lida in Lida Township, The audience was polled with Clinton Strand speaking to the variance request. After consideration, motion was made by Cecil Femling, seconded by Craig Anderson and unanimously carried, to table this variance request until the next scheduled meeting for additional information. Robert E. Kugler - Approved Robert E, Kugler, Erhard, MN, requested a variance of 85’ from the required ordinary high water level setback of 200’ for the construction of a 30’ by 40’ pole building 1 15’ from the ordinary high water level. The property is described as Government Lots 6, 7 and 8, except tracts. Section 15 of Friberg Township on Evans Lake, The applicant was represented by Gordon Hanneman at the hearing. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Dan Oehler, seconded by Cecil Femling and unanimously carried, to approve a variance of 85’ from the required ordinary high water level setback of 200’ for the construction of a 30’ by 40’ pole building 115’ from the ordinary high water level.. Hardship being the terrain of the applicant’s property. Sheldon Tornquist Sheldon Tornquist. Minneapolis, MN. requested the Board of Adjustment to consider the granting of an 8' variance from the required ordinary high water level setback of 20' for the location of an existing water - oriented accessory structure 12' from the ordinary high water level. During discussion it was determined that when the structure was placed in its present location a setback of 10' would have been required. Mr. Tornquist had not obtained a permit prior to the placement of the water - oriented accessory structure. It was the general consent of the board members that since this structure would not have required a variance at the time of its placement Mr. Tornquist should apply for and obtain an after the fact permit. PLEASE NOTE; That since the meeting it has been determined that the structure was placed when the setback requirement was 20' from the ordinary high water level. Mr, Tornquist has made an application for the October 7th, 1993, meeting. Clarification The Land and Resource Office requested clarification of a variance request that was approved August 4th. 1976. A variance of 85' from the required ordinary high water level setback of 200' for the placement of a mobile home 115' from the ordinary high water level setback was requested by Robert Kugler. The applicant’s property was described as part of Government Lot 8, Section 15 of Friberg Township on Evans Lake. The office was questioning whether the setback of 115' would be applicable to dwelling structures other than a mobile home. It was the general consent of the Board of Adjustment members that the 115' setback would be applied to any type of dwelling unit located on this property and that the 115' setback does not just apply to the placement of a mobile home on this parcel.
