Neighbor, Tim Chisholm, also speaking for the Taylor family, requested that Zorbaz stay the same
because there is no room to grow in this residential area.
Owner of Zorbaz, Tom Hanson, spoke to the fact that he was told about 10 years ago to acquire more
land in the area when possible. This purchase would create 6-8 more staff parking spaces. The
primary purpose of the entire purchase is to obtain more parking and mitigate an expensive piece of
property. He responded to commissioners’ questions regarding traffic, safety, congestion, and the ice
cream/clothing store adding to the problem.
Motion by Lindquist, second by Froemming, to remand the CUP Application of Al Buckmeier back to
the Planning Commission for review and consideration of solutions suggested by surrounding
property owners. County Attorney, David Hauser, stated that the applicant would be required to waive
the 60-day notice period. The applicant was not present at the meeting; therefore, the motion was
rescinded. Motion by Rogness, second by Froemming, to deny the Conditional Use Permit request of
Al Buckmeier to allow Zorbaz to purchase the property and use the existing structure for ice
cream/clothing sales for the following reasons; 1) the request is not compatible with the surrounding
residential area, 2) the request creates a safety hazard by adding a business across Highway 72,
3) the request is not suitable for the area, 4) parking is inadequate and 6 additional parking spaces
will not mitigate the increased parking need when adding a business - the ice cream/clothing store
exacerbates the situation, and 5) precedence has been set by requiring the Graystone to acquire
more property for parking purposes in a similar situation. Chairman Erickson called for a roll call vote

At 11:55 a.m.. Chairman Nelson declared the meeting of the Otter Tail County Board of
Commissioners closed to the public for the purpose of evaluating the performance of GIS
Coordinator, Sherry Leabo, pursuant to M.S. Chapter 13D.05 Subd. 3. All five seated
commissioners were present for the evaluation. A summary of performance conclusions will
be provided at the next regular County Board meeting. At 12:10 p.m.. Chairman Nelson
declared the meeting of the Otter Tail County Board of Commissioners reconvened in open

Doug Everhart had questions and expressed concerns regarding the purpose of the road &
indicated that he opposes it if the plan includes subdividing the land. Linda Kugler
expressed concerns regarding the purpose of the road. Greg Kugler (Townboard Member)
indicated that the Township has not been approached to take over the road. Jeanne
Everhart questioned the use of the road (public or private).
Motion: A motion by Maske, second by Lachowitzer to approve as presented with the

Please read this into the Public Hearing scheduled for July 14,2004 at 9:30 p.m.
We are concerned about the environmental impact of the construction of this road to bird and
animal habitat and to our quality of life.
High Island Lake is a srfiall, quiet private lake in a pastoral setting. The homes surrounding this
rural lakeshore respect the harmony of a natural wildlife setting. Loons, ducks and geese nest \ here, arid in the clear shallow waters and surrounding w^lafrds because of the undisturbed
natural surroundings. Many other birds, as well as mammals are a part of the ecosystem current
resident's enjoy. The privacy of the area is recognized and appredated by friends and neighbors
here and: a large subdivision or deyelopmerit would not be compatible with the nature of this small
farming, pasture setting on this lake.
What limits can a small lake and surrounding existing homes accommodate? The request as
stated by the applicant does not sound like a residential driveway. If this road is being created to
accommodate a subdivision then the county and area residents need to be apprised of the
following:
What will the imp^ be on pur present private well. How many wei|s can the underground water table, which we depend on. Support ? How will existing wells be p^ected from contamination?
What is proposed for septic systems. How many, and what will be the impact to the lake and
wetlands?
Lakes like Pelican, Lida, and Lizzy vrith tiny lots do not enjoy the rural nature and privacy that is
the reason many of us feel privileged to live in the environment of the shores of this tiny lake.
Larger, heavily concentrated lakes in the county have experienced water and sewer problems This small community cannot ab^rb the cost of a public water system or sewer system that a
targe development might demand.
The application asks for a driveway of 24 ft. wide, however the niap drawing shows a road 33 ft
on center. Does this mean the actual right of way will be 66 feet wide? If this is a driveway to
give access to a one family dwelling and not a subdivision road, then why is there a conditional
use penhit application?
Page 4 of the Subdivision Controls Ordinance of Otter Tail County, under Service Road definition:
“A public road having a traveled surface of at l^ist 24 feet in vwdth lying parallel and adjacent to
an Arterial Road or Highway and which provide access to abutting properties and protection
from through traffic”, seerhs to reflect the application and indicate there will be more than a one
family dwelling. How many lot's does the applicant intend to divide this property into? Is this to
be a Service Road as defined, therefore giving public access? If there are more than two lots how
many will te giv^ access to the take and will High island Lake th^ become a public access lake
rather than a’private lake?

We have had the enjoyment of watching a blue winged teal nest in the grass on a hilltop and all
nine of her eggs have hatched and she now keeps them concealed in the reeds in a pond within
our view. We are hopeful that one of the many snapping turtles that also lay eggs in the area will
not view her downy ducklings as a rheal. This aress Bob O Link and Blue Winged Teal, are
among the birds depending on prairie and grassland habitat according to DNR, and are Midwest
birds declining because of loss of habitat and incr^sing human population. A mix of farmland
and grasslands now provides habitat for birds like theiBob o link which declined 60% between
1966 and 1996. The eastern meadowlark declined 55 %, and Grasshopper Sparrow 80 %. the
Blue Winged Teal, homed lark, Sedge Wren, Common Nighthawk, Short Earred Owl, Northern
Harrier, Hen^aws Sparrow, Lark Sparrow and many more are among the birds that are declining because of loss of habitat. We enjoy watching ^ hearing the loons and seeing the flight
training of young geese getting res^ to migrate. A|so nesting in the area are wood ducks,.Goid
finches, orioles, grouse. Blue Heron and many, many more birds delight us. Insect and
mosquito eatere like pilated woodpeckers, swallows and purple martin inhabit our area. How
much habitat will be destroyed with the construction of a 66 foot wide road right of way, and
additional building on this property? What will the impact be to the t»rds?
We would (^ect to a subdivision road that would give public access to the lake, impact our sewer
and water system, and the nature of our ecosy^em as stated previously. We ask the
commissioners to take into consideration the compatibility and the quality of life of present
residents on High Island Lake.
