Steven and Denise Galletta, Lot I I Jerry’s Breezy Beach, Rush Lake in Rush Lake Township, requested the
following: Existing house footprint on Eastside and Westside lot lines are at 6’. Requirement is 10’ Request 4’
variance from each lot line for a new garage to be built on existing parking area, second story addition over
existing footprint dwelling and attached garage and new garage addition. Requesting an ordinary high water level
setback variance of 27’ from the required 75’ setback for the proposal to be at 48’ from ordinary high water level.
Existing impervious is at 31.2% new proposal will reduce total impervious surface to 27%. This will be a 4.2%
reduction in total impervious surface. Requesting variance of 2%. Driveway and sidewalks to be pervious
pavers. The audience was polled with no one speaking for or against the variance as requested. After discussion
and consideration, Rick Wilson made a motion, second by Ward Uggerud and unanimously carried, to approve
the variance as stated in the variance application dated November 10, 2016 and as depicted on the drawing
submitted with the application. It was noted that the proposed development will be no closer to the ordinary high
water level than the existing development and the proposed development will reduce impervious surface coverage
by 4.2%. The applicants’ proposal is an improvement to the property and is in part maintenance to the existing
development. The variances as approved do not directly or indirectly grant any other variance for the proposed or
future development. It was noted that the applicants must reduce imperious surface coverage to 27% or less
whether pervious pavers are used or,not used.

following: On September 8, 2016 the Board of Adjustment approved my request to subdivide my parcel into
tloree tracts. I am now requesting to alter the lot line between Tracts B and C. See attached map on file with the
County Auditor’s office for the new lot line location. Tract B will be approximately 3.21 acres and Tract C will
be 3.67 acres. Proposed to have parcels buildable for residential use. The applicant was represented by Michael
Walls. The audience was polled with no one speaking for or against the variance as requested. After discussion
and consideration, Paul Larson made a motion, second by Rick Wilson and unanimously carried, to approve the
proposed subdivision as described in the variance application dated’November 15, 2016 and as depicted on the
drawing submitted with the variance application. The variance as approved is substantially the same as the
variance granted September 8, 2016. The variance as approved does not directly or indirectly grant any other
variances for future development.
Dan and Andrea Bucholz-Variance application approved as requested (7:07 p.m.)

consideration, Darren Newville made a motion, second by Paul Larson and unanimously carried, to approve the
proposed subdivision as described in the variance application dated November 16'2016 and as depicted on the
drawing submitted with the variance application. The variance as approved does not directly or indirectly grant
any other variances for future development.
Gale and Andrew Peterson - Tabled (7:10 p.m.)
Gale and Andrew Peterson, part of Government Lot 10, Section 26 and part of Government Lot 2 Section 35 of
Candor Township by Loon Lake, requested the following: Proposing to construct a 22’ by 16’ addition to
dwelling being 49’ from the ordinary high water level and 8’ from the lot line. The required setback is 100’ from
the lake and 10’ from the lot line. Also proposing to construct an 8’ by 12’ deck being 17’ from the ordinary high
water level. Required setback is 100’. Currently there is 948 square feet coverage in the shore impact zone.
Proposing to increase the coverage by 118 square feet. For a total of 1066 square feet in the shore impact zone.

Enclosed is my application for variance related to my Heilberger lake property
located on County Highway 22, in Erhard, MN 56534 (Parcel 28000100071005).
As stated in my Variance Application, 1 am requesting a variance to modify the lot
lines between Tracts B and C, according to the attached site map, and as described
below:
• Parcel A - (Unchanged and has been sold and transferred.)
• Parcel B - (Would had 5.19 acres vs. proposed 3.21 acres. Tract B is for sale.)
• Parcel C - (Would had 1.69 acres vs. proposed 3.67 acres. Tract C is sold,
subject to approval of variance)
I have included the following information according to the application checklist:

Dear Bill,
Enclosed is my application for variance related to my Heilberger lake property
located at 25603 County Highway 22, Erhard, MN 56534.
The property has been owned by my parents since the 1950’s. 1 purchased this
property in May 2015 to assist my elderly parents to move to home in Fergus Falls.
My wife and I also own approximately 11 acres of land on Heilberger Lake, at 25479
County Highway 22, Erhard, MN 56534, which is located just one parcel away. We
have owned our property since 1986 and use it as our second home.
As stated in my application, I am requesting a variance to subdivide the existing
parcel into 3 tracts. According to the site map prepared by Anderson Surveyors,
• Parcel A would have 2.49 acres and about 350 feet of shoreline
• Parcel B would have 5.19 acres and 211 feet of shoreline; and
• Parcel C would have 1.69 acres and 200 feet of shoreline.
The size of these parcels would be much larger than the two existing adjacent
parcels to the south.
I am requesting the variance in order to preserve the existing wetlands and
woodlands along the existing road into the site. The current roadway has been in
existence for over 40 years.
I have removed the gate to the road for better access. Subject to the approval of the
variance, 1 will also add at least 2" of gravel to the existing road and expand the
width by approximately 2 feet. Although the existing road is more than adequate.
All three tracts are sold, subject to approval of the variance. Tract A is the existing
home site. Tract B and C are currently unimproved. All three purchasers have also
expressed a strong interest in retaining the existing private road in order to:
• preserve the existing wetlands and woodlands, and
• maintain privacy and security

I am the Fire Chief for the Underwood Fire Department. I understand that Tim
Long has requested a variance with Otter Tail County - Land and Resource
Management regarding his request to add two tracts of land to his current lake
home property at 25603 County Highway 22, Erhard, Minnesota. 1 further
understand that he would prefer to avoid a public road in order to preserve the
wetlands and woodlands along his existing driveway.
We responded to a 911 call for a fire at this address on June 27, 2016. We
responded with 3 fire trucks and found that the size of his existing driveway
adequate to access his property. It was also maintained well so the trucks had no
trouble reaching the fire. Fortunately no buildings were damaged.

I conducted a site evaluation at Parcel 28000100071005 owned by Timothy Long. The parcel is located at 25603
Co Hwy 22, Erhard, MN on Heilberger Lake. The purpose of the evaluation was to determine if there are suitable
soils throughout the parcel for the construction of onsite septic systems should the parcel be divided into three
separate parcels as shown on the drawing provided by Anderson Land Surveying for the construction of single
family homes.
I conducted several soil borings throughout the property to determine the type of soil and the depth to a
restricting layer. The soils within the staked areas for a septic system on the property are loam, clay loam, and
sandy loam. The depth to a restricting layer is roughly 24 to 36 inches in the three areas I have staked to be set
aside for a septic system drain field.
Based on my observations, if the parcel is to be divided as proposed on the drawing, each separate parcel has
suitable soils for a standard septic mound system. An area of 2500 square feet has been staked on each proposed
parcei as required by Ottertail County. These areas are not inclusive of the total area available for a septic system
drain field. They are simply areas that are suitable and must not be disturbed during construction of homes, other
buildings, driveways, etc. As with any proposed construction, I strongly advise the owner to consult a septic
system designer before any final decisions are made regarding construction on the property.
