Still, you have it in your power to allow and even forgive our folly. We are grateful to have an audience, though time and space prohibit our meeting face to.face. What you are addressing here is a place we call "home". Webster's first defi nition for this word, "home" reads "a family's place of residence". My enployment as a pastor inhibits the purchase of a house or dwelling to estab lish as a home "of our own". Our life is one of transience, as the places I serve as pastor will rarain long after our ministry in that place has ended. This lake property, upon which this building stands, is on our "home" property. This land is not property for speculation, so as to develop a return on some mone tary investment. This land is not recreation space, nor some vacation dwelling place. This land is "home". Wood ticks, mosquitos, horseflies and skunks are part of our home. Deer, eagles, wood ducks and beaver are part of our home. The trees and plants, the poison ivy and grape vine all share in our home. When we undertook to build this lakeside structure now under your scrutiny, we did.so with great care as to interference with our fellow home bodies. The struc ture stands upon pill^s, not upon a slab, because we didn't wish to scar the shore for years after this facility had fallen into.ruin. We chose the ONLY spot that would provide access to the lake without clearing trees or leveling land, both of which would,have caused great harm to the lake and its life. Our shelter has been accepted by our "home bodies". The deer tracks have not varied in their courses, the beaver have not wavered frcm their trails, and the bald eagels have come to scout the lakeshore from the trees about the house, every one of vAiich we left undisturbed in our building. The only folk left to please now are the neighbors. The human ones. This structure was built by persons ignorant of Minnesota's laws and property deliberations. We blew it. Should we have the opportunity to do more structure work at our home, we'll know better where to begin. Fletcher Pratt once wrote in a book called Ordeal by Fire these words: "Good government should abridge the liberty of the individual to the least possible extent; the nub of the question is what is possible. The concentration of society makes all the difference." Our home in Vining is remote. It doesn't mean we don't answer to people from elsevdiere, as these procedings clearly deironstrate. It does mean there is perhaps room for some deliberations and allowances for our foul-up. We are eager to do what we can to rrake things right, and to do our best to proceed with better cau tion and information next time around. •i' Our request, then, is for clemency; that our building be allowed to remain as is, v^ere is. The size of the structure is 12‘ by 12' at the base, with a second story that is 12‘ by 16‘. The property Is described as part of the SE1 /4, Section 19 of Folden Township on an unnamed lake. The applicants were represented at the hearing by Selmer Halverson, The audience was polled with no one speaking for or against the request. The following Individuals submitted letters In favor of the granting of this variance request: Paul Halvorson, Ruth Hanson and Nathan Hanson. After consideration, motion was made by George Walter, seconded by Craig Anderson and unanimously carried, to deny the variance request as no adequate hardship had been shown and to allow the applicants until April 1st, 1994, to correct the situation. The basement under the 18’ by 24' addition will be excavated about 2‘ and the finished floor will be about 1 foot above the ordinary high water level. The shoreland ordinance requires a structure height of 3' above the ordinary high water level. The applicant's basement addition is over 100' from the lake. The property is described as Lot 9, 1st Addition Freeman's Beach and part of Government Lot 4, Section 31 of Dead Lake Township on Dead Lake. The audience was polled with no one speaking for or against the request. After consideration, motion was made by John Everts, seconded by Craig Anderson and unanimously carried, to approve a variance of 2' from the required 3' structure height above the ordinary high water level for the placement of a basement, with a depth of approximately 4', under an 18' by 24' addition. The Intended use of this area Is for a crawl space and for a utilities area. The basement area is not intended to be used as livable area. Mervin and Phyllis Freeman requesedt that they be allowed to construct an 18’ by 26' addition rather than an 18' by 24'addition. The Board reviewed the above minutes and their action from the June 10th, 1993, meeting, and it was the Board's opinion that an 18' by 26' structure would not create any problems as the 2' increase in size is away from the lake. f With no further business.
