It was noted that the granting of this request on this lake would establish precedence for this lake. After consideration, motion was made by Randall Mann, second by David Holmgren and unanimously carried, to table the applicant’s request, as requested by the applicant, until the September 2, 1999 meeting of the Board of Adjustment. Larry Hatch and Denise Larson - Denied Larry Hatch and Denise Larson, Milaca, MN, requested a variance of 28’ from the required ordinary high water level setback of 200’ for the construction of a 48' by 30’ structure 172’ from the ordinary high water level. The property is described as Lot 6, Block 1, Auditor’s Subdivision No. 112, Section 12 of Tordenskjold Township by Fiske Lake. The audience was polled with Bob Clausen, representing a number of property owners within the immediate area, speaking against the establishment of setback precedence for this area. After consideration, motion was made by Cecil Femling, second by Mark Steuart and unanimously carried, to deny the variance as requested as no adequate hardship had been shown and adequate room does exist on this large lot that will provide other reasonable alternatives that will not require the granting of a variance. It was noted that the granting of this request on this lake would establish precedence for this lake. Leo F. Myxter-Approved as requested. Leo F. Myxter Jr., Et. AL., Fargo, ND, requested a variance of 94’ from the required ordinary high water level setback of 200’ for the construction of a 10’ by 12’ shed 106’ from the ordinary high water level. The property is described as Lot 2, Freeman’s Beach First Addition, Dead Lake in Dead Lake Township. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Cecil Femling, second by Randall Mann and unanimously carried, to approve a variance of 94’ from the required ordinary high water level setback of 200’ for the construction of a 10’ by 12’ shed 106’ from the ordinary high water level noting that the shed will be placed behind the dwelling away from the lake. Placing the proposed shed in this location will not establish precedence and it will allow the applicant the ability to enjoy the same rights and privileges as others in the immediate area.
