July 6, 2006 Meeting - After discussion and consideration, Steve Schierer made a motion, second by Michael Harris and carried with Rod Boyer abstaining, to approve a variance of 20’ from the required ordinary high water level setback of 75’ for the placement of the proposed development as depicted on the revised drawing submitted for the Thursday, July 6. 2006 Board of Adjustment meeting. The Board noted that the variance as approved for the proposed development does provide the applicants with a reasonable use of their property. Helen Greenberg - Approved the variance as requested. Rick Leitch and a friend of the applicant appeared with the applicant at the public hearing. The audience was polled with no one speaking for or against the variance as requested. After discussion and consideration, Cecil Femling made a motion, second by Steve Schierer and unanimously carried, to approve a variance of 90’ from the required ordinary high water level setback of 200’ for the placement of a structure 110’ from the ordinary high water level. (7:02 p.m.) Kit and Jacquelyn Nelson, Lots 4 and 5 Buehler’s Addition, Sybil Lake in Hobart Township, requested a variance of 23’ from the required ordinary high water level setback of 100’ for the construction of a 32’ by 40’ addition to an existing 26’ by 28’ cabin 77’ from the ordinary high water level. The audience was polled with no one speaking for or against the variance as requested. After discussion and consideration, Paul Larson made a motion, second by Michael Harris, to approve a variance of 22’ from the required ordinary high water level setback of 100’ for the construction of a 32’ by 40’ addition to an existing 26’ by 28’ cabin 78’ from the ordinary high water level. This motion failed with Cecil Femling, Randall Mann and Steve Schierer voting no. Those voting in favor of the motion noted the terrain and lot shape as the reasons for approving a variance. After additional discussion and consideration, Randall Mann made a motion, second by Steve Schierer and unanimously carried, to approve the placement of a 1,280 square foot addition between the existing 26’ by 28’ cabin and the road (north side) with the condition that the proposed addition can be closer to the ordinary high water level than what would be permitted when extending the easterly wall of the existing cabin in a northerly direction towards the road. It should be noted that the variance as approved does not directly or indirectly grant any other variances for the proposed development. Hardship is the terrain of the applicants’ property. The Board noted that the variance as granted will provide the applicants with a reasonable use of their property. ■ .7 . .
