Dear Mr. Chairman
On Monday, April 14, 1980, Larry Krohn and I investigated the
above application. Mr. Hamness has indeed placed his footings
(old railroad ties) 135' from the ordinary high water mark.
The building site is located in the lowest spot in the area.
It is my opinion that not only is the site too close to the
lake, but because of its location, the owner will have drainage
problems and potential problems with a sewage disposal site
and a well site. There is a small knob to the east of his
footings that is on high ground with a good view of the lake
where the above problems could be eliminated.
Since this application meets none of the tests for hard ship
as defined in Minnesota Statutes chapter 394,27 Subd, 7,
this office must go on record as oppossing this application.
In case you are not aware, the fact that the applicant's foot
ings are in has no bearing on the matter. Somewhat recent
court cases in Pine and Itasca County, I believe, required
the owner to remove all of partially constructed buildings
set too close to the ordinary high water mark.
