call vote to approve the variance request to construct a gazebo 89’ from the ordinary high water level with the
conditions that a rain gutter is installed and that the water run-off is controlled. This decision is also based on the
Findings of Fact and Decision Form, which contains the criteria reviewed and the Board’s finding have been attached to
and incorporated as an official part of the minutes which have been placed on file with the Land & Resource
Management Department. The variance as approved does not directly or indirectly grant any other variances for future
development.

A variance may be granted only where the strict enforcement of county land use controls will result in a "practical difficulty". A
determination that a practical difficulty exists is based upon consideration of the following criteria:
The applicant identified the following practical difficulty: They would like a little coverage from the Sap from the trees and it was
previously a deck area and they would like to put a gazebo there. With the location of the well, sewer and electrical it makes it
difficult to meet the setbacks requirements.
1. Is the variance in harmony with the general purposes and intent of the official control? (The board shall consider the purposes
and intent of the official control).

Ordinance which was built prior to any zoning regulations in 1971.

The Board of Adjustment may impose conditions in the granting of variances. A condition must be directly related to and must bear
a rough proportionality to the impact created by the variance. {Mitigating impervious surface with storm water management, deep
rooted vegetative buffers, rain gardens, etc.)
It is the Board of Adjustment's job to apply appropriate legal standards to a specific fact situation. Variances are meant to be an
infrequent remedy where an ordinance imposes a unique and substantial burden.

Kurt Blotsky, Lot 1 Blk I of Smith's Comer, East Lost Lake (56-378), Sverdrup Township request the follow ing: I am proposing to
construct a gazebo 89’ from OHWL. The required setback is 100’. Requesting all’ variance. Land & Resource Management verified
the setback.
Kurt Blotsky, property owner represented the variance application. The audience was polled with no one speaking for or against the
variance application.
After consideration and discussion, Michael Donoho made a motion, seconded by Terry Marthaler and carried by roll call vote to
approve the variance request to construct a gazebo 89’ from the ordinary high water level w ith the conditions that a rain gutter is

Sidney & Denise Zier - Variance Application Approved (7:40 p.m.)
Sidney & Denise Zier, Pt of GL 4., West Leaf Lake (56-114), Leaf Lake Tow nship request the follow ing: Part of the cabin (1970) and
porch (1976) are within the SIZ. We want to put in a functional-sized patio on the lake side of the cabin. The property line to the south
is only 10 feet from the cabin. On the north side of the cabin, we w ould need to remove a section of a hill to extend the current small
patio, which is only about 25 feet from the new septic system mound. The only place that can work for the patio is on the east side of
the cabin. We purchased the property' in Sept of 2019. Currently the shore impact zone imp. surface coverage is 876 sq. ft. Propose to
add 252 sq. ft. for a total of 1,128 sq. ft. Impervious surface coverage in the shore impact zone. Required is not to cover over 260 sq.
ft. in the SIZ.
Sidney & Denise Zier, property owners represented the variance application. The audience was polled w ith no one speaking for or
against the variance application.
After consideration and discussion, Terry Marthaler made a motion, seconded by Darren Newville and carried by roll call vote with
Michael Donoho voting no. to approve the variance application to place a patio in the shore impact zone with the total impervious
surface coverage being 1,128 sq. Ft. This decision is also based on the Findings of Fact and Decision Form, w hich contains the criteria
review ed and the Board’s finding have been attached to and incorporated as an official part of the minutes w hich have been placed on
file w ith the Land & Resource Management Department. The variance as approved does not directly or indirectly grant any other
variances for future development.
