Minnesota August 4th, 1 994 Page 4 Jim Howe - Approved Jim Howe, Casseiton, ND, requested a variance of 67' from the required ordinary high water level setback of 75' and a variance of 29.5' from the required shore impact zone setback of 37.5' for the construction of a terraced and angled retaining wall with a 5' wide staircase 8‘ from the ordinary high water level and a variance of approximately 9' from the required west property line setback of 1 O' for the addition of a patio. No variance was granted on the width of the staircase. Robert Kappes - Approved Robert Kappes, St. Joseph, MN, requested a variance of 11' from the required ordinary high water level setback of 75' for the construction of a 26' by 30" addition to an existing dwelling 64' from the ordinary high water level. The addition will be approximately 2' closer to the lake than the existing structure. The property is described as Lot 22, Grace Etta Beach, West Battle Lake in Girard Township. The audience was polled with no one speaking for or against the r^iuest. After consideration, motion was made by Cecil Femling, seconded by Craig Anderson and carried with John Everts abstaining, to approve the construction of a 26' by 30' addition to an existing dwelling being no closer to the ordinary high water level than the existing structure or what the string line test would permit. The string line is to be applied from the neighbor's dwelling on the one side of ? the applicant's property to the 75' setback mark on the vacant lot that is on the other side of the applicant's property. Vernon D. Johansen - Approved Vernon D. Johansen, Underwood, MN, requested a variance of 12' from the maximum 18' height requirement of a non-dwelling structure for the construction of a 60' by 11 O' barn having a height of 30'. The property is described as the NW1 /4 SE1 /4 and Government Lots 8,9, 10 and 11, Section 30 of Sverdrup Township on Norway Lake. After consideration, motion was made by John Everts, seconded by Cecil Femling and unanimously carried, to approve a variance of 12' from the maximum 18' height requirement of a non-dwelling structure for the construction of a 60' by 110' barn having a height of 30'. After consideration, motion was made by John Everts. s«:onded by Randall Mann and carried with Cecil Femling voting no, to allow the enclosure of the existing deck, within the shore impact zone area, with the condition that the applicant be allowed no other water - oriented accessory structures on the lot.
