This provision of the ordinance is not intended to prevent the development of agricultural properties, The applicant's property Is a farm operation. The location of the structure w11 be just inside the shoreland area approximately 900 feet from the ordinary high water level. The applicant will be changing the dimensions of the enclosed deck from 8' by 28' to 10' by 24', The enclosed area will be 48' from the ordinary high water level. After consideration, motion was made by Dan Oehler, seconded by Cecil Femling and unanimously carried, to approve the applicant's request as long as the enclosed deck does not exceed what the string line test would permit. Jim and Anne L. Eidsvold - Denied Jim and Anne L. Eidsvold, Alexandria, MN, requested a variance to subdivide 5.5 acres by metes and bounds description into three parcels of less than 2.5 acres, but meeting all the minimum shoreland ordinance requirements for platted lots on a recreational development lake. The applicant presently owns two parcels - one parcel contains 3,84 acres and the adjacent parcel contains 1.66 acres. The property Is described as part of Government Lots 1 and 2, Section 7 of Nidaros Township on Clltherall Lake. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Craig Anderson, seconded by Cecil Femling and unanimously carried, to deny the variance as requested and It was the Board's recommendation that the applicant work with the Planning Commission In the subdivision of this property. William J. Lachowitzer - Approved William J, Lachowitzer, Battle Lake, MN, requested a variance to subdivide four backlots of less than 2.5 acres from an existing parcel by metes and bounds description. The applicant presently owns approximately 71 acres. These backlots would be permanently attached to lots In the Cloverleaf Beach Addition directly across the public road. The lots would not be used for residential dwellings. Each lot would contain over 5,000 square feet. The shoreland ordinance permits the creation of platted backlots of 5,000 square feet or more if they are legally joined to a lakeshore parcel and contain permanent restrictions against residential construction. Magnus 0. Foss - Tabled Magnus 0. Foss, Jr,, Fargo, ND. requested a variance to construct a dwelling in the bluff impact zone. The dwelling will be 24'in front of the crest of the bluff. If the variance is approved the applicant will subdivide his three lots under different ownership.
