No - The need for a variance is not due to circumstances unique to the property created by the property owner because the property owner is creating his own circumstances by wanting to build on the lot and stay in the existing house which he currently resides in. 4. Minimum Structure Setback Requirements, Lakes and Rivers; Setback from OHWL; Dwellings; Natural Environmental VARIANCE REQUEST: Authorization to construct a dwelling 100' from OHWL, a variance from 200' setback DESCRIPTION OF VARIANCE We are requesting a variance from the 200’ setback from OHWL of Little Anna Lake for construction of a new dwelling, due to practical difficulties in complying with the Ordinance. The applicants currently reside in an existing dwelling on the property and desire to reside there during construction of a new dwelling. The existing dwelling and several dilapidated outbuildings would be removed following construction of a new dwelling. The location of the existing dwelling, an old farmhouse, is arguably in the ideal building area. However, if applicants needed to demolish existing structures (including the existing dwelling), place household belongings in storage, and reside elsewhere during construction of a new dwelling - - this would contribute to considerable delay, disruption, and economic burden. In addition, there are numerous circumstances unique to the property which were not created by the applicants, and that limit the applicants' options for buildable areas. These include lot configuration and adjacent wetland. While there is a buildable area just north and west of the existing dwelling, use of this area would (i) require grading changes to existing topography and considerable tree removal (which would reduce a natural screen from the neighboring residence to the west), (ii) require construction of additional gravel road surface (at considerable cost and potential environmental impact), (iii) require alteration of the essential character of the locality, and (iv) afford inadequate access to direct sunlight for solar energy systems the applicants may incorporate into the new dwelling's design.
