Motion
Motion was made by Cecil Femling, seconded by Robert Schwartz and unanimously carried, to approve a variance to
place a septic system and drain field on and/or across a common lot line and within 2 to 4’ of the back lot line noting a
written property owner’s agreement has been prepared and the proposed location has been recommended by a
licensed installer. Hardship is substandard lots of record.

This agreement, between Jo]in'J< Jrmelle LeRoy who own Lot #2 of
Jensens Surv lots Sec 01, Twp 133, Range 041-Ottertail Co. Mn, an d
Thomas E, & Carolyn A. Hiedeman who own Lot // 1 of Jensens Surv Lots
Sec 01, Twp 133, Range 041- Ottertail Co. Fin.Shall be attached to
each property involved and shall remain so until mutually agreed to
terminate. This agreement shall become attached should the proposed
septic system become a reality.
The septic system involved or parts of it will be ;)ointly installed
and that part or parts v/hich are jointly installed shall be maintained
or replaced if necessary on equal basis v/ith each lot owner being re
sponsible for 50% of the cost in cured whenever ouch maintenance or re
placement is necessary and whoever the owners may be at such time.
This agreement shall be binding to all parties involved and also
be transfered with o.ny property transfer involving tliese two parcels.
