State of Minnesota v. Austin Korby
State of Minnesota v. Mark Sand & Gravel
RE:
On May 15, 1990, the matter of State of Minnesota v. Austin Korby was scheduled
for trial, but we reached an agreement to settle the matter. The case against
Mark Sand and Gravel had already been settled. Austin Korby pled guilty and was fined $700.00 with $500.00 stayed on condition that the fill be removed by
September 1, 1990. If the fill is removed, the defendant may move to have the
record of this conviction expunged. We will not oppose it. The same agreement
was reached with Mark Sand and Gravel and they will be filing a petition to
enter a plea of guilty. The terms of the guilty plea are the same as those
entered by Austin Korby. Apparently, Korby and Mark Sand and Gravel reached an
agreement as to how they will divide the costs of the removal. This had been
the major stumbling block in resolving this matter.
Please monitor this situation and if it appears as though the fill is not going
to be removed by September 1, we should probably take some action even before
the deadline occurs. The removal is going to be a major project.
