TRACT 3 DESCRIPTION
(Revised 5/29/2001)
All that part of Sub Lots 14, 15 and 16, Section 24, Township 133
North, Range 43 West of the Fifth Principal Meridian, Fergus Falls
Township, Otter Tail County, Minnesota, described as follows;
Commencing at the Southeast Corner of said Section 24; thence on
an assumed bearing of South 89 degrees 47 minutes 39 seconds West
on and along the south line of said Section 24 a distance of 547.07
feet to the point of beginning; thence continuing South 89 degrees
47 minutes 39 seconds West on and along said south line of Section
24 a distance of 473.00 feet; thence North 0 degrees 25 minutes 42
seconds West a distance of 230.32 feet; thence North 89 degrees 31
minutes 12 seconds East a distance of 473.00 feet; thence South 0
degrees 25 minutes 42 seconds East a distance of 23 2.58 feet to the
point of beginning.
The above described tract contains 2.51 acres more’ or less.
Also, there is herein granted to the purchasers a permanent
easement for right of way over and along the private roadway
extending westward from the northwest corner of said property to a
north-south road, said permanent easement lying in part on the
north 66 feet of the south 235 feet of Sub Lots 14 and 15, of said
Section 24, which private roadway has been heretofore built by
other purchasers from these grantors of lands to the west of the
tract herein described and there is hereby reserved an easement for
the purpose of a 100 foot diameter, terminal cul-de-sac, the center
point of'said cul-de-sac bearing South 48 degrees 16 minute 18
seconds West a distance of 50.00 feet from the northwest corner of
the herein described and conveyed property, and also reserved to
the grantors herein a permanent easement for right of way over the
above described access easement, said reservation being for the
benefit of the grantors herein named and, for the purchasers of any
tracts hear of adjacent to these demised premises which may be sold
by these grantors-under .the same •terms and-.conditions concerning

George Sholy and David Liquin represented the Application.
Bob Blatti stated that he is an attorney representing a neighbors William & Karen Doris
presented pictures showing the run-off onto the Doris property, he expressed concerns
regarding the amount of fill that has been placed on the property and requested the lot be
restored to it’s original level.
Motion: A motion by Trites, second by Boyer to deny as requested, reason being that the
modifications appear to increase the water displacement that adversely affects the
adjacent properties.
Voting: All members in favor.
David & Shawn Schneeberqer - Approved With A Condition: J
A Conditional Use Permit Application to build a driveway to allow us access to a single
family dwelling we are preparing to construct. The driveway would be a continuation of an
existing road across two easements then continuing up to the home. It would require the
grading of the existing terrain to allow for the 16’ road which will be covered with 4” - 6” of
Class V gravel and/or recycled asphalt. There would be a 2’ ditch on both sides of the
road to allow for adequate drainage and reduced snow buildup. During the construction of
the home, we will be excavating the basement area, utilizing some for fill under the garage,
cement pad, driveway and the balance for backfill and leveling around the house. We will
also be excavating the area from the home to the South lotline to accommodate the
walkout basement. The area would be approx. 50’ x 70’ at varying levels due to the slope
of the terrain with the fill used for similar purposes. All of the setbacks, sizes and heights
are adequate to meet the Ordinance standards. The property is described as Pt of SL’s
14,15 & 16 (2.5 AC) and S 235’ of E 134’ of W 268’ of SL 5 of SE1/4 (Richter) and S 235’
of W 134’ of SL 15 of SE1/4 (Zender) in Section 24 of Fergus Falls Township: Hoot Lake
(56-782), RD.

Diane Smith stated that she did not have any objections to the request, and had some
questions regarding the erosion control and the location of the easement.
Motion: A motion by Zimmerman, second by Bergerud to approve as presented, allowing
an extension of the September 1®' earthmoving deadline to October 15, 2001 provided an
