No. 13620 o50 T 6 OJ v>< V s MINUTES OF THE MEETING OF THE OTTER TAIL COUNTY BOARD OF ADJUSTMENT Thursday, November 4, 2010 The Otter Tail County Board of Adjustment met Thursday^ November 4, 2010, with the following persons in attendance: Michael Harris Randall Mann Scott Ellingson, Land and Resource Management David Hauser, County Attorney Paul Larson Steve Schierer Thomas Lee Called to Order - Randall Mann, Chair called the meeting of the Board of Adjustment to order at 6:30 p.m. Minutes Approved - The Board of Adjustment approved the minutes of the October?, 2010 meeting as mailed. The Board of Adjustment considered the following applications for variance: Dean and Mary Schumacher-Variance approved as requested. (6:30 p.m.) Dean and Mary Schumacher, part of Lot 6 and all of Lot 7 Dursch’s Silver Bay, Silver Lake in Everts Township requested the following: Propose to put 6/12 pitch roof on existing house (peak height approximately 21 feet) to match new garage roof (variance approved 9-2-10). Request variance of 2 feet from side lot - existing house is 8’ from lot line. Request variance of S'A feet on left side of house - existing house is 51 ’ from ordinary high water level, but 814 feet ahead of string test. Request variance of 4 feet on right side of house - existing house is behind string test but 46’ from ordinary high water level. Gary Dirks represented the applicants at the public hearing. The audience was polled with no one speaking for or against the variance as requested. After discussion and consideration, Steve Schierer made a motion, second by Thomas Lee and unanimously carried, to approve the variance as requested in the application dated October 8, 2010 and as depicted on the drawing submitted with the application. It was noted that the applicants’ proposed development plans will not change the existing footprint. Jerry and Jane Geisinger - Variance approved as requested with conditions. (6:36 p.m.) Jerry and Jane Geisinger, part of the East Half of the Northwest Quarter, Section 21 of Fergus Falls Township, requested the following: Split parcel into two parcels of 1.8 acres and 1.47 acres. Minimum size for metes and bounds parcels in a non-shoreland area is 2.5 acres unless the parcel contains a wetland in which case the minimum size is 5 acres. A letter from the Charles H. Grotte, Assistant County Highway Engineer, noting the need to apply for a permit for any additional driveways and the 40’ setback requirement from the county road was read for the record. The audience was polled with no one speaking for or against the variance as requested. Cory Reinertson, Contractor appeared with the applicants at the public hearing. The audience was polled with no one speaking for or against the variance as requested. After discussion and consideration, Paul Larson made a motion, second by Michael Harris and unanimously carried, to approve a variance of 25’ from the required ordinary high water level setback of 200' for the placement of a 26’ by 30’ detached garage 175' from the ordinary high water level. The proposed development is behind the existing dwelling. The variance as approved does not directly or indirectly grant any other variances for the proposed development. At that time, we could not complete the inspection and approve the system for use, for the following reason(s): There was not a visual alarm on the lift station. There was not an alarm on the holding tank. X There was not a dwelling on site. The non-conforming sewage system had not been destroyed. There was not a well on site. The Installer had not completed the air test. Our Office has not received the Well Abandonment Certificate. Our Office has not received a Road Right-of-Way letter from the Township. A Variance is required for non-complying setbacks (as follows): OHWL (Ordinary High Water Level) Lot Line Road Right-Of-Way Structure Miscellaneous Please be aware that failure of obtaining the Variance will result in removal of the non-complying portion of the system.
