Mill St. Fergus Falls, MN 56537 "Otter Tail River Venture", Otter Tail River (56-OTR)RE: Dear Mr. Dave: On June 5, 1996, the Otter Tail County Planning Commission (PC) recommended that the preliminary plat of "Otter Tail River Venture" be approved provided several conditions were met (see enclosed copy of their meeting minutes). On June 11, 1996, the Otter Tail County Board of Commissioners (BC) approved this preliminary plat as recommended by the PC (see enclosed copy of their meeting minutes). As you will see, one condition of approval requires that Lot 5 be permanently attached to Lot 1 and that Lot 4 be permanently attached to Lot 2. notification to any potential owner of the aforementioned property that these restrictions exist. This condition presents a problem of As I mentioned during our telephone conversation(s), we believe that this notification can best be given by including language on the final plat which ties these lots together as required. While I understand your reluctance to do so since you feel that this is a zoning requirement (subject to change) and as such can not be included on a final plat (MN.Statutes 505), we disagree. We view this condition as a requirement for approval of the preliminary plat which is not subject to change. In other words, should an attempt be made to separate these lots, it could only be done by way of a new preliminary plat. Since this is the case, we hereby request that you place appropriate language on the final plat which indicates that Lot 5 is permanently attached to Lot 1 and that Lot 4 is permanently , attached to Lot 2.
