Preliminary Plat & Cond Use Permit - “Dead Lake Properties’/Dead Lake Properties LLC:
Mr. Kalar stated that the Planning Commissioner recommended denial of the Preliminary Plat
entitled “Dead Lake Properties”. Mr. Kalar provided copies of a letter received from the
Beeson Law Office dated December 18, 2006, requesting that the County Board table this
request and remand the matter back to the Planning Commission after the concerns cited at
the Planning Commission meeting have been addressed. Motion by Froemming, second by
Nelson, and unanimously carried to deny the Preliminary Plat entitled “Dead Lake Properties”
consisting of 3 lots and a Conditional Use Permit to construct a road and cul-de-sac to
service the plat for the reasons cited in the Planning Commission minutes of December 13,
2006, and because the lot line dispute may take some time to reach agreement. The
property is described as Lot 9 (40.90 AC), Section 26 of Dead Lake Township: Dead Lake
(56-383), NE.
Conditional Use Permit - James A. & Julie C. Espeland:
Motion by Froemming, second by Mosher, and unanimously carried to approve a Conditional
Use Permit to install a new basement with conditions as recommended by the Planning
Commission. The property is described as Pt GL 3 (.46 AC), Section 21 of Girard Township:
West Battle Lake (56-239), GD.

Use Permit for some of the after-the-fact work as recommended by the Planning Commission
and cited in the Planning Commission minutes of December 13, 2006, and to deny any

Conditional Use Permit - Hobart Township/Gerald Courneva & Steven Courneva:
Motion by Nelson, second by Block, and unanimously carried to approve a Conditional Use
Permit for the Hobart Township Scalp Trail Road Improvement Project as presented. The
properties are described as a 16.92 acre tract in pt of GL 10 & pt of GL 11 & a 6.95 acre tract
in pt of GL 10, Section 7 of Hobart Township: Scalp Lake (56-358), RD.
Conditional Use Permit - David Sherbrooke:
Motion by Erickson, second by Block, and unanimously carried to approve a Conditional Use
Permit to construct a driveway as presented. The property is described as Lots 7 & 8
Blyberg’s Point First Addition, Section 17 of Dunn Township: Fish Lake (56-768), GD.
Conditional Use Permit - Ernest & Judith Adamec:
Motion by Erickson, second by Mosher, and unanimously carried to approve a Conditional
Use Permit to operate a greenhouse business with conditions as recommended by the
Planning Commission. The property is described as Lots 4 & 5, Section 26 of Aurdal
Township: Moen Lake (56-679), NE.
Palms of Lida First Addition
Developer, Bruce Qvammen, addressed the Board regarding the plat entitled “Palms of Lida
First Addition” and requested the location of the common boat dock be moved to Lot 3 of the
original plat. Mr. Qvammen stated that he has an opportunity to buy back this lot and this is a

end at the property line. 3. The Wetland Conservation Act has not been addressed.
Voting: All Members in favor.
James A. & Julie C. Espeland - Approved With Conditions:
A Conditional Use Permit Application (as stated by the Applicant): To lift existing home, remove
existing crawl space and install a new full basement in the same location as the existing
house. Floor of new basement would be two feet below existing lowest crawlspace level.
Add entrance to road side of house, two foot addition or bay window to lakeside bedroom,
excavation as shown to allow for partial walkout from basement. Project should enhance
erosion control since a level area would remain allowing for runoff to soak into soil prior to
reaching lake. Estimated excavation for site grading 150 cu. yds. Hardship would result if
cabin addition of roughly 20’ were added toward lake which would still be behind set back,
however the neighbor’s view of lake would be impaired. The property is described as Pt
GL 3 (.46 AC), Section 21 of Girard Township; West Battle Lake (56-239), GD.
James and Julie represented the Application.
Motion: A motion by Estes, second by Boyer to approved provided: 1. A surface water
run-off plan is approved by Land & Resource Management. 2. Appropriate erosion control
methods are implemented during construction. 3. The impervious surface does not
exceed 25%. Voting: All Members in favor.
Break: At 8:24 the Commission took a 10 minute break.
James R. & Suzanne I. Kesler - Approved/Denied:
A Conditional Use Permit Application (as stated by the Applicant): Add up to 20 cu. yds of clean
fill (sand/gravel) to two areas near the lake shore for future beach and water craft access
and to partially fill a deep hole. Clear lot of severely bent over trees, storm damaged trees
and all vegetation within 10’ of the future home site & driveways (this is an After-the-Fact
request for clearing the area). Install a 20’ culvert with 20 - 30 yds of class 5 fill for
driveway access off Canterbury Lane. A silt fence has been installed along shoreline.
The property is described as Lot 4 BIk 1 Canterbury Sands, Section 28 of Everts Township;
Silver Lake (56-302), RD.

Hobart Township/Gerald Courneva & Steven Courneva - Approved As Presented:
A Conditional Use Permit Application (as stated by the Applicant): Gerald Courneya -
Excavation of the peat within the area westerly of the channel southerly of the road right-of-
way, northerly of the Type 7 wetland and southeasterly of the Grothe tract for the purpose
of stockpiling peat to use as topsoil borrow for the Hobart Township Scalp Trail Road
Improvement Project. The existing topsoil within the project is very thin and non-existent in
some areas. In order to have adequate topsoil to meet the MPCA requirements for turf
establishment, topsoil borrow will be required and the method proposed is the most cost
effective way to procure the topsoil. Earthwork will involve approximately 5,000 Cu. Yds.
