Motion Jeffrey A and Stacy A Lundquist - Approved the drain field variance as requested and denied the septic tank variance as requested - (7:17 p.m.) Motion was made by Mark Steuart, second by Steve Schierer and carried with Bert Olson voting no, to deny a variance of 7’ from the required 10’ setback for the placement of a deck 3’ from the septic tank. It was noted that there is adequate room to place either the deck or the septic tank in a location, which will maintain the required 10’ separation. After additional discussion and consideration, motion was made by Mark Steuart, to deny the 5’ variance from the required 20’ setback for the placement of a deck 15’ from the drain field. It was again noted that there is adequate room to place either the deck or the drain field in a location, which would maintain the required 20’ separation. This motion died for lack of a second. After additional consideration, motion was made by Cecil Femling, second by Paul Larson and carried, with Steve Schierer and Mark Steuart voting no, to approve a variance of 5’ from the required drain field setback of 20’ for the placement of a deck 15’ from the drain field. Anderson, Rochester, MN, requested a variance of 130’ from the required ordinary high water level setback of 200’, a variance of 30’ from the required shore impact zone setback of 100’ and a variance of 9’ from the required road right-of-way setback of 20’ for the placement of a 10’ by 40’ Park Mobile Home 70’ from the ordinary high water level and 11’ from the road right-of-way (township road). The property is described as Lot H, Lillis Survey Plat of Government Lot 2, Section 16 of Dead Lake Township by Dead Lake. Pat Johnson, Century 21, represented the applicant at the public hearing. The audience was polled with Duane Bohne, Dead Lake Township Supervisor, noting that the Dead Lake Town Board is requesting that the 20’ road right-of-way setback be maintained. Mike Schantzen addressed the Board of Adjustment with concerns regarding parking, septic installation, bluff areas and snow removal. Bob Deutschman noted that the lot is very small, the road in this area is narrow and that the applicant’s request should be denied. After consideration, motion was made by Cecil Femling, second by Mark Steuart and unanimously carried, to deny the variance as requested and to support the position of the previously approved variance dated December 5, 2001. Todd and Tammy Bolstad - Approved the second story addition over the garage - (7:57 p.m.) Todd and Tammy Bolstad, Fergus Falls, MN, requested a variance of 16’ from the required ordinary high water level setback of 75’ for a second story addition on top of an existing attached garage (built in 1969) with a second story deck and a first story screened in porch being 59’ from the ordinary high water level. The property is described as Lot 12, Burau Beach Third Addition, Wall Lake in Dane Prairie Township. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Steve Schierer, second by Cecil Femling and unanimously carried, to approve a variance for the placement of a second story addition on top of the existing garage. The proposed second story deck must meet the sting line test. The Board of Adjustment is granting no variances for the proposed first story screened in porch area. It was noted that no more than 25% of the total lot area could be covered with impervious surfaces after the completion of the proposed project. It should be noted that had the variance been approved for the proposed-screened porch it would have had an impact on the view from the adjacent property. Walter and Sandra Morton - Approved with conditions - (8:08 p.m.) Walter and Sandra Morton, Richville, MN, requested a variance to subdivide a parcel of less than 5 acres (150’ by 150') from an existing 9.8 acre parcel for the purpose of permanent attachment to the adjacent lake lot currently owned by Walter Morton, Jr. The 150’ by 150’ parcel contains the drain field for the above referenced lake lot. The property is described as a 9.8 acre tract in the West 500’ of Government Lots 7 and 8 lying North of County Road 14 and a lake lot (.28 of an acre) in Government Lot 8, Section 25 of Dead Lake Township by Dead Lake. After consideration, motion was made by Steve Schierer, second by Paul Larson and unanimously carried, to approve the subdivision of a 150’ by 150’ parcel from an existing 9.8 acre parcel with the condition that it must be permanently attached to the adjacent lake lot, which is currently owned by Walter Morton, Jr. and with the condition that a registered surveyor’s drawing must be provided. It was noted that the granting of this variance would enhance a substandard lot and will also join the property, which contains the drain field with the lake lot, which is currently being served, by the drain field. SCANNED Ronald and Mary Heskett - Approved with condition - (7:08 p.m.) April 4, 2002 Page 3 Ronald and Mary Heskett, Bettendorf, lA, requested a variance of 5’ from the required side lot line setback of 10’ and a variance of 65’ from the required ordinary high water level setback of 100’ for a 10’ by 12’ addition to an existing garage (toward the road) and for the continuance of the gable roof over the current garage with the closest point being 5 ‘ from the side lot line and approximately 35’ from the ordinary high water level. The property is described as Lot 7 and part of Lot 8, Roy Ell Acres First Addition, Stalker Lake in Tordenskjold Township. The audience was polled with no one speaking for or against the request. After consideration and discussion, motion was made by Steve Schierer, second by Cecil Femling and unanimously carried, to approve a variance of 5’ from the required side lot line setback oflO’ and a variance of 65’ from the required ordinary high water level setback of 100’ for a 10’ by 12’ addition to an existing garage (toward the road) and for the continuance of the gable roof over the current garage with the closet part of the garage being 5’ from the lot line and approximately 35’ from the ordinary high water level with the condition that a letter from the adjacent property owner approving of the 5’ side lot line setback must be obtained. It should be noted that the 10’ by 12’ addition would be approximately 6.5’ from the side lot line at its closest point and would be 57’ from the ordinary high water level. Gerald and Mary Bartholomay - Withdrawn Gerald and Mary Bartholomay, Fargo, ND, requested the following: “We currently have a 12’ by 48’ trailer home with an addition. We wish to remove the trailer home and addition and build a 36’ by 30’ cabin with a basement. We wish to include a walkout from the basement. As shown in sketch, we would build the new cabin so that it is setback on the line between our neighbors on each side. Our variance request is to include a deck over the walk out on the lakeside that would extend 10 feet beyond the line between our neighbors. The edge of that deck would be approximately the same as the edge of the current addition. This proposal would allow us to have the walkout from the basement at the most advantageous position.” The property is described as Lot N, Ross Survey Lots of Government Lot 7, Section 31 of Dunn Township by Lake Lizzie, Prior to the scheduled public hearing the applicants submitted a letter stating their desire to withdraw their request.
